Minutes of the October 9, 1995 Planning Commission Meeting. Commissioner Kasalek corrected the comment attributed to her in the Commission Concern section of the minutes to reflect that the trees were not bombarding pedestrians, but that thrips were dropping from the trees at E1 Camino and Main. Denial of Variance 95-010. Recommendation - It is recommended that the Planning Commission deny Variance 95-010 by adopting Resolution No. 3396, as submitted. Commissioner Lunn moved, Vandaveer seconded, to approve the Consent Calendar as corrected. Motion carried 5-0. Code Amendment 95-004 APPLICANT: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: CITY OF TUSTIN COMMUNITY DEVELOPMENT DEPARTMENT 300 CENTENNIAL WAY TUSTIN, CA 92680 CITYWIDE CITYWIDE IT HAS BEEN DETERMINED THAT THIS PROJECT WOULD NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT AND A NEGATIVE DECLARATION HAS BEEN PREPARED. AMENDMENT TO THE OFFICE OF ZONING ADMINISTRATOR TO EXPAND THE TYPES OF CONDITIONAL USE PERMITS, SPECIFIED DEVELOPMENT PROJECTS AND VARIANCES TO BE AUTHORIZED BY THE ZONING ADMINISTRATOR Recommendation- It is recommended that the Planning Commission take the following actions: Approve the Environmental Determination for the project by adopting Resolution No. 3401. Recommend to the City Council approval of Code Amendment 95- 004 by adopting Resolution No. 3402, as submitted or revised. Presentation: Rita Westfield, Assistant Development Department Director, Community The Public Hearing opened at 7:08 p.m. The Public Hearing closed at 7:08 p.m. Commissioner Kasalek feels that the routine review of the Zoning Administrator public hearing notices, which are submitted to the Planning Commissioners as soon as they are available, is very important and suggested this be included in the Ordinance language to ensure that this procedure continues. Lois Bobak, Deputy City Attorney, suggested leaving procedural items out of the Ordinance language. She noted that as long as there is no problem with the procedure and it is being followed there is no need to codify it by putting it in the Ordinance. Commissioner Kasalek asked if it would be automatically assumed that an item was controversial if a lot of public input was received concerning an item. Staff responded, "not necessarily". There could be a case with a lot of public input in favor of a project and that would not cause concern about controversy. If a number of residents opposed an item, and the Zoning Administrator moved for denial, the applicant could always appeal to the Planning Commission. In addition, the Zoning Administrator can always defer any item to the Planning Commission even at the Zoning Administrator meeting level. Motion carried 5-0. Commissioner Vandaveer moved, Bone seconded, to reoommend to the City Council approval of Code Amendment 95-004 by adopting Resolution No. 3402 as submitted. Motion carried 5-0. REGULAR BUSINESS: 4. Siqn Code Exception 95-007 PROPERTY: OWNER APPLICANT: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: WALLACE OWENS ENDERLE % THOMPSON, C.R. 14081 SO. LAKE FOREST, CA 92630 ATT: MALCOLM HALE 14081 YORBA STREET PLANNED COMMUNITY COMMERCIAL (PC-COMM) THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 11) PURSUANT TO SECTION 15311 OF THE CALIFORNIA EQUALITY ACT (CEQA) TO INSTALL A CENTER IDENTIFICATION WALL SIGN FOR ENDERLE CENTER Recommendation - It is recommended that the Planning Commission approve Sign Code Exception 95-007 by adopting Resolution No. 3403, as submitted or revised. Presentation: Daniel Fox, AICP, Senior Planner Craig Oka, Architects Design Consortium, stated he was available on behalf of the owner, to answer any questions of the Commission. Commissioner Bone moved, Vandaveer seconded, to approve Sign Code Exception 95-007 by adopting Resolution No. 3403 as submitted. Motion carried 5-0. 5. Zoning Ordinance Comprehensive Update - Status Report Recommendation - Receive and File Commissioner Bone asked if there was a target date for each task and if the Base was to be included. He also requested a copy of a Zoning Map. Commissioner Vandaveer also requested a copy of a Zoning Map. Staff responded that there would be no target dates since the consultant has suggested providing the Commission with the entire code at one time, once it is drafted and affirmed that the Base would be a separate issue. Staff will forward a copy of a Zoning Map to Commissioners Bone and Vandaveer. Commissioner Vandaveer moved, Lunn seconded, this report. Motion carried 5-0. to receive and file Planning Commission Minutes October 23, 1995 Page 4 Status Reports Recommendation - Receive and File Commissioner Bone asked if a column could be added to the report to identify the number of buildouts in East Tustin and show those percentages. Staff stated that once the amendments and appeals on the high school site are finaled, the report will be reformatted to reflect the new conditions and also those sites which would accommodate residential development. The figure of 20.2% allowed units will remain the same, based on 9178 and when the final number of new apartments are actually approved for the high school site that figure will go up to no more than 25%. The remaining two columns reflect all of the construction approved which is currently less than 8,058. Commissioner Kasalek inquired about Code Enforcement and if there was a report available. Staff stated that the City now has two new Code Enforcement Officers and a report of their activities will be available shortly. Co--issioner Vandaveer moved, Lunn seconded, this report. Motion carried 5-0. to receive and file STAFF CONCERNS: 7. Report on Actions taken at the October 16, 1995 city Council Meetinq. Staff reported on the subject agenda. COMMISSION CONCERNS: Commissioner Vandaveer Asked to have the old Utt Juice Company building secured since the doors are continually open and invite unauthorized entry. Staff will see that this is done. Commissioner Bone Asked if a ride-along could be set up with the City's Code Enforcement Officers. Staff suggested the Commissioners advise them of the most convenient days and times so that a schedule can be arranged. Inquired if there was a target date for the widening of E1 Camino. Staff stated that it was several years away. Reported that on a recent Police Department ride-along he noticed a number of ice cream vending trucks operating in the City and asked if this type of operation required a Business License. Planning Commission Minutes October 23, 1995 Page 5 Staff affirmed that a Business License is required for this type of business and will alert Code Enforcement to watch for them. Commissioner Lunn Asked for an update on the paving of the parking area and fencing on Kenyon Place. She also inquired if Caltrans was using the construction staging area in that location since it was full of trash. staff will check into this. Commissioner Mitzman Stated that he had occasion to be at the Rancho Cucamonga Planning Department recently, explained one of their procedures which is to have the applicant appear before the Planning Commission on an informal publicly noticed workshop basis prior to the formal hearing and asked staff if this was something worthwhile for the City of Tustin to do. Staff stated there was some merit to this type of process and Tustin has used it for major issues, such as the high school site and the patio homes development, but extending the process would only serve to add more time for the applicant and added expense in staff time and noticing for the City. The City's goal is to get the technical input before going to the Planning Commission and in most cases a workshop would not make that much of a difference.
