Minutes of the August 14, 1995 Planning Commission Meeting. A typographical error in roll call showed Commissioner Kasalek absent. This was corrected prior to the meeting to show Commissioner Lunn absent instead. Commissioner Bone moved, Vandaveer seconded, to approve the Consent Calendar. Motion carried 4-0. Commissioner Lunn abstained. MARK BUCHANAN 4343 VON KARMAN NEWPORT BEACH, CA. 92660 14272 FRANKLIN AVENUE PC-INDUSTRIAL (PC-IND) A NEGATIVE DECLARATION HAS BEEN PREPARED IN ACCORDANCE WITH THE PROVISIONS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) 1. Delgadillo, Assistant Planner The Public Hearing opened at 7:05 p.m. Robert Sundstrom, representing the applicant, stated that he had nothing to add, has reviewed the staff report and resolution and concurs with the conditions of approval· The Public Hearing closed at 7:05 p.m. Commissioner Bone moved, Vandaveer seconded, to certify the Negative Declaration for the project as adequate by adopting Resolution No. 3377 as submitted. Motion carried 5-0. Commissioner Bone moved, Vandaveer seconded, to approve Variance 95-003 by adopting Resolution No. 3378 as submitted. Motion carried 5-0. Commissioner Bone moved, Vandaveer seconded, to recommend to the City Council approval of Tentative Parcel Map 95-115 by adopting Resolution No. 3379 as submitted. Motion carried 5-0. Planning Commission Minutes August 28, 1995 Page 3 Conditional Use Permit 95-001 and Variance 95-008 APPLICANT: OWNER: FIRST KOREAN BAPTIST CHURCH OF TUSTIN 30 BENNINGTON IRVINE, CA 92720 DONALD CHAPMAN, JR. 14272 CHAMBERS ROAD TUSTIN, CA 92680 LOCATION: 14272 CHAMBERS ROAD ZONING: PLANNED COMMUNITY-INDUSTRIAL, IRVINE COMPLEX ENVIRONMENTAL STATUS: REQUEST: INDUSTRIAL A NEGATIVE DECLARATION HAS BEEN PREPARED IN CONFORMANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AUTHORIZATION TO ESTABLISH A CHURCH AND A VARIANCE TO ALLOW SHARED PARKING Recommendation - Pleasure of the Planning Commission. Presentation: Greg Gubman, Assistant Planner Commissioner Kasalek, inquired if the proposed church was located 950 feet from Colonial Bible Church as noted in the staff report or 1,180 feet as stated in the Resolution. Staff stated that the difference should have been clarified. The 950 feet is a straight line distance from the nearest points of each property line and the 1,180 feet is the actual distance to travel between the two uses. Commissioner Bone noted that Exhibit A, Resolution 3383, Condition 5.1, states the need for a sign permit and he believes a sign is already on the site that identifies the church and which covers up the monument sign. Staff stated that the temporary sign is in violation of the Sign Code if they do not have a temporary sign permit, the sign should be removed and proper procedures followed to obtain a permit. Commissioner Bone asked if the applicant was aware that this approval was needed. Staff stated that the staff report made the applicant aware of the need for a sign permit and now they are also aware that their temporary sign is in violation and must be removed. The Public Hearing opened at 7:15 p.m. John MurDhy, representing the applicant, stated they are in full support of all the conditions of approval. He understands that the proposed use is in compliance with Planning Commission guidelines for churches, and that the church is compatible with the surrounding area and has no need for shared parking. Regarding the economic issue for use of warehouse space in the industrial area, the space utilized is currently office space and should have no impact on future warehouse space. In reference to the temporary sign they were not aware that it was in violation and on his way home tonight it will come done. This is a very small church of only about 60 people and they appreciate the cooperation the City has given already and support staff recommendations. Commissioner Kasalek asked if they intended to use permanent signage. Planning Commission Minutes August 28, 1995 Page 4 John Murphy replied that an architect will be hired and conditions of approval are quite specific and at a later date a sign will be put in. Commissioner Kasalek asked if the applicant would work with staff regarding the temporary signage. John Murphy replied that he would correct the problem immediately. The Public Hearing closed at 7:20 p.m. Commissioner Mitzman asked if there was something the City could do to allow the temporary sign for 30 or 60 days? The Director stated that the applicant would have the advantage to use whatever the code provides. Staff does not have the ability to waive the time limits for a grand opening or for temporary signage. There is a Sign Code exception process which allows the Zoning Administrator or Planning Commission to allow Sign Code exceptions. There should be no problem as the time limits are to the benefit of the tenant. Commissioner Lunn moved, Vandaveer seconded, to certify the Final Negative Declaration for the project as adequate by adopting Resolution No. 3382 as submitted. Motion carried 5-0. Commissioner Lunn moved, Mitzman seconded, to approve Conditlonal Use Permit 95-001 and Variance 95-008 by adopting Resolution No. 3383 as submitted. Motion carried 5-0. REGULAR BUSINESS: 4. Siqn Code Exception 95-001 APPLICANT: OWNER: LOCATION: ZONING: REQUEST: SUPERIOR ELECTRICAL ADVERTISING, INC. 1700 WEST ANAHEIM STREET LONG BEACH, CA 90813-1195 GEORGE W. WILLIS, TRUSTEE 660 LOS ALTOS DRIVE LONG BEACH, CA 90814 14152 NEWPORT AVENUE COMMERCIAL RETAIL (C-i) DISTRICT TO REDUCE THE HEIGHT AND MODIFY THE SIGN CABINET OF AN EXISTING NONCONFORMING POLE SIGN Recommendation -It is recommended that the Planning Commission approve Sign Code Exception 95-001 by adopting Resolution No. 3380, as submitted or revised. Commissioner Lunn asked if approval was granted, how soon could the existing sign be removed. Her concern is to have the old sign removed as soon as possible. George Adams, representing Superior Electrical Advertising, Long Beach, stated the sign must be fabricated and he estimates that 3 to 4 weeks would be a good estimate. Commissioner Bone asked if a certain date could be given, perhaps that in 30 days it would be completed. Georqe Adams replied affirmatively and indicated that 30 days would be more than enough time. Commissioner Lunn asked if a condition could be included to have the sign removed even if the new one is not finished so that the existing sign has to be down in 30 days. Planning Commission Minutes August 28, 1995 Page 5 The Director stated that the signs' current condition is a code violation but they are using the post for the new cabinet; work involves removing the cabinet and adding a new cabinet, using a crane. Commissioner Vendaveer moved, Bone seconded, to approve Sign Code ~xception 9S-001 by adopting Resolution No. 33S0 revised as follows. Condition 1.3 shall read, "Sign Co4e Exception approval shall become null and void unless a sign permit and building permit are issued for the monument sign and construction of the monument sign is completed within sixty (60) days of the date of this exhibit. Time extensions may be gr&nted by the Director of Community Development if a written request is received by the Community Development Department within five (5) days prior to expiration." Motion carried 5-0. 5. Status Report Receive and File Comm~s~ioner Va~daveer moved, Mitzman seconded, to receive and file this report. Motion carried 5-0. STAFF CONCEI~NS= 6. Report on Actions taken at the August 21, 1995 City Council Meeting. Staff reported on the subject agenda. COMMISSION CONCERNS= Commissioner Vandaveer - None Commissioner Mitzman Inquired of the City Attorney about his conflict of interest concern on the East Tustin Specific Plan amendments and what was the correct procedure to follow in order to express his personal concerns to the Irvine Company on this issue. The City Attorney informed Commissioner Mitzman that he would not be violating the conflict of interest regulations and had the right to meet with the Irvine Company about his own interests as a homeowner as long as he did not represent himself as speaking for the Planning Commission. Commissioner Bone Asked for a map which would identify existing tracts in East Tustin. Staff will provide an exhibit which will show the tract numbers and names of developments for all of the Commissioners. Planning Commission Minutes August 28, 1995 Page 6 Was concerned that the Planning Commission does not currently have representation on the Task Force Committee for the Base Closure. The Director stated that the Task Force Committee at present is limited to 17 members. Former Planning Commissioner members had been retained on the Committee, leaving no representation from the present Commission membership and if they wanted to be adequately represented the City Council should be approached by the Commission to request that the matter be agendized. The next Task Force meeting is scheduled for September 7th at 4:00 p.m. and the Director suggested that any Commission members who were available attend the meeting as a member of the audience even before an appointment by the City Council is made. The City Attorney suggested that any of the Commission members who are interested in being appointed to the Task Force, contact the Director in the morning.
