Code Amendment 95-002 APPLICANT: LOCATION: ZONING: ENVIRONMENTAL STATUS: CITY OF TUSTIN COMMUNITY DEVELOPMENT DEPARTMENT 300 CENTENNIAL WAY TUSTIN, CA 92680 CITYWIDE CITYWIDE IT HAS BEEN DETERMINED THAT THIS PROJECT WOULD NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT AND A NEGATIVE DECLARATION HAS BEEN PREPARED. REQUEST: AN AMENDMENT TO THE TUSTIN ZONING CODE TO AMEND PROVISIONS RELATED TO POLITICAL CAMPAIGN SIGNS AND TO ADD PROVISIONS RELATED TO NON COMMERCIAL SIGNS ON RESIDENTIAL PROPERTIES. Recommendation- It is recommended that the Planning Commission take the following actions: Approve the Environmental Determination for the project by adopting Resolution No. 3347; and Recommend to the City Council approval of Code Amendment 95- 002 by adopting Resolution No. 3348, as submitted or revised. Presentation: Rita Westfield, Assistant Director Community Development Department Commissioner Lunn asked how costs would be recovered. Staff stated that in the case of political signs the campaign committee would be named on the sign and responsible. Commissioner Lunn asked what happened if the campaign committee had dissolved. Staff stated that costs may not be recoverable in all cases. Commissioner Lunn asked if the candidate could be made responsible. Lois Bobak, Deputy City Attorney, stated it would have to be on a case by case basis. Planning Commission Minutes April 10, 1995 Page 3 Commissioner Lunn is concerned that given the amount of signs posted in the last election and feels the City should not be responsible for the costs. Commissioner Weil agreed. Commissioner Kasalek suggested the cost be split between the property owner and the candidate. Staff stated there were two instances of placement, property and public property. private Lois Bobak stated it would be a violation of the Ordinance to post a sign in private property without the property owner's permission. The Director stated that in elections which the City sponsors, the candidates are informed of their obligations. Other elections, such as county etc. would be more difficult to control. This Ordinance would give the City the ability to remove the signs. Commissioner Kasalek asked for clarification about the distance from the sidewalk when a sign is placed in a parkway. Staff stated that Public Works Department had given input concerning problems which had been encountered by that department such as obstruction of street sweeping etc. which provided the information concerning the parkway. Commissioner Weil stated there should be some allowance for people without parkways and language included for positioning of signs so as not to obstruct the street sweepers. Commissioner Lunn said she has observed that most signs are placed on public property and asked if that was allowed by the City. Staff stated yes, at this time no permission is needed. The Public Hearing opened at 7:21 p.m. Matt Nisson, 14462 Red Hill Avenue, stated that there did not seem to be much protection for the property owner. He is concerned with placement of signs two feet from the curb. He stated that in the last election, eleven different signs were on his property and his wife was quite disconcerted to see signs right by their residence front entrance. He wished to have some language in the Ordinance to prevent signs being placed in tree wells since this tends to kill the roots of the trees and to have no more than three signs posted on residential property. Commissioner Well moved, Lunn seconded, to continue this public hearing until the next regularly scheduled Planning Commission meeting on April 24, 1995. Motion carried 3-0. REGULAR BUSINESS: None STAFF CONCERNS: 4. Report on Actions taken at April 3, 1995 City Council Meeting Staff reported on the subject agenda.
