At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken off-agenda items unless authorized by law). Minutes of the August 22, 1994 Planning Commission Meeting. Commissioner Well moved, Lunn seconded to approve the minutes of the August 22, 1994 Planning Commission meeting. Motion carried 5- 0. 2. I ......... ! -' Planning Commission Minutes September 12, 1994 Page 2 Recommendation - It is recommended that the Planning Commission approve Sign Code Exception 94-004 by adopting Resolution No. 3293, as submitted or revised. Presentation: Daniel Fox, Senior Planner Commissioner Kasalek moved, Weil seconded, to approve Sign Code Exception 94-004 by adopting Resolution No. 3293 with revision to Exhibit A, Condition of Approval 1.3. Condition of Approval 1.3 shall read, "Sign Code Exception approval shall become null and void unless a sign permit and building permit are issued for the monument sign and construction of the monument sign is completed within twenty four (24) months of the date of this exhibit. Time extensions may be granted by the Director of Community Development if a written request is received by the Community Development Department within thirty (30) days prior to expiration." Motion carried 5-0. AMENDMENT TO THE CONDITIONS OF APPROVAL OF CONDITIONAL USE PERMIT 93-025. Recommendation - It is recommended that the Planning Commission amend Conditional Use Permit 93-025 by adopting Resolution No. 3299, as submitted or revised. Presentation: Scott Reekstin, Assistant Planner This item was withdrawn by the applicant prior to the commencement of the meeting. REGULAR BUSINESS: 4. Use Determination 94-004 APPLICANT: LOCATION: ZONING: ENVIRONMENTAL BRINDLES BOOKSTORE 13721 NEWPORT AVENUE, SUITE 1 TUSTIN, CALIFORNIA 92680 13721 NEWPORT AVENUE, SUITE 1 PLANNED COMMUNITY (PC) DISTRICT Planning Commission Minutes September 12, 1994 Page 3 STATUS: REQUEST: THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO SECTION 15303 OF THE CALIFORNIA EQUALITY ACT (CEQA) TO DETERMINE THAT SECONDHAND SALES ARE PERMITTED WITH A CONDITIONAL USE PERMIT WITHIN THE COMMERCIAL GENERAL (CG) DISTRICT Recommendation - It is recommended that the Planning Commission determine by Minute Motion that secondhand sales are permitted with a conditional use permit within the Commercial General (CG) District. Presentation: Daniel Fox, Senior Planner Commissioner Mitzman asked if books would be purchased as well as sold. Staff stated "yes". Commissioner Baker stated that his concern was with appearances and perceptions in the shopping center. He assumes the landlord would do the policing on this and he has no problem with this particular use. Commissioner Weil stated that approval of this item is opening up the possibility of any kind of second hand sale not just for books. Since the next use may not be quite so appealing she is very much in favor of the conditional use permit requirement. Commissioner well moved, Lunn seconded, to approve Determination 94-004 by Minute Motion. Motion carried 5-0. Use 5. Capital Improvement Program/General Plan Compliance Report Receive and File Presentation: Rita Westfield, Assistant Director, Community Development Department Commissioner Well moved, Kasalek seconded, to adopt Resolution 3300 as submitted, finding that the proposed fiscal year 1994-95 capital Improvement projects are in conformance with the Tustin Area General Plan. Motion carried 5-0. STAFF CONCERNS: 6. Report on Actions taken at September 6, Meeting Staff reported on the subject agenda. 1994 City Council I .... T ...... .......... Planning Commission Minutes September 12, 1994 Page 4 COI~IISSION CONCERNS: Commissioner Kasalek Commented that she would have liked to have attended the Town Hall meeting which was scheduled for the same time as the Planning Commission meeting tonight and asked if this was just an oversight or a scheduling problem. Staff stated that this was apparently the only date and place available for the Town Hall meeting. Commissioner Mitzman - None Commissioner Weil Stated that she and Commissioners Baker and Lunn had attended the APA Planning Commission Workshop. Commissioner Lunn - None Commissioner Baker Commented that he thought it was a good workshop and a good opportunity to meet with the other Commissioners and work with them. Stated that a telephone call had been received on his unlisted line at home saying that the City of Tustin was conducting a survey through a Charleston Survey Group and advised the other Commissioners that as far as he is aware the City has not asked for this survey. ADJOURNMENT: Commissioner Well moved, Kasalek seconded, to adjourn the meeting at 7:15 p.m. Motion carried 5-0.
