At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken off-agenda items unless authorized by law). Recommendation -It is recommended that the Planning Commission approve a two year time extension of Conditional Use Permit 93-016 by adopting Resolution No. 3258 subject to the conditions contained in Exhibit A as submitted or revised. Presentation: Rita Westfield, Assistant Development Department Director, Community The Public Hearing Opened at 7:06 p.m. The Public Hearing Closed at 7:06 p.m. Commissioner Baker noted that he was glad to see Silicon Systems asking for this extension since it is firms like this that the Economic Development Committee is concerned about keeping in Tustin. Commissioner Weil stated she agreed 100% Commissioner Baker moved, Butler seconded to approve a two year time extension of Conditional Use Permit 93-016 by adopting Resolution No. 3258 subject to the conditions contained in Exhibit A as submitted. Motion Carried 4-0. Commissioner Kasalek abstained. 3. Code Amendment 94-002 INITIATED BY: LAND OWNER: LOCATION: ZONING: CITY OF TUSTIN COMMUNITY DEVELOPMENT DEPARTMENT 300 CENTENNIAL WAY TUSTIN, CA 92680 NOT APPLICABLE CITYWIDE CITYWIDE ENVIRONMENTAL STATUS: REQUEST: IT HAS BEEN DETERMINED THAT THIS PROJECT WOULD NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT AND A NEGATIVE DECLARATION HAS BEEN PREPARED. TO AMEND THE TUSTIN CITY CODE SECTIONS 9271 AND 9297 TO INCLUDE PROVISIONS RELATING TO OUTDOOR VENDING, PUSHCARTS AND OTHER PORTABLE VENDING DEVICES Recommendation -It is recommended that the Planning Commission take the following actions: Approve the Environmental Determination for the project by adopting Resolution No. 3259; and Recommend to the City Council approval of Code Amendment 94- 002 by adopting Resolution No. 3260, as submitted or revised. Presentation: Dana Ogdon, Senior Planner Commissioner Stracker noted that Page 3, Section 5330 contains both the words regulate and allow and asked which of these the code meant to do. Staff noted that both words were correct, that the code both regulates and allows outdoor vending for parades, street fairs and other types of large outdoor gatherings. Planning Commission Minutes May 9, 1994 Page 3 Commissioner Stracker noting Item 1, of the staff report, under "Discussion", asked why that specific item concerning approval of design review by the Director of Community Development was included. Staff stated that in terms of places like the Tustin Market place where push carts might be on a more permanent basis this item was included to make sure push cart design fit the design of the shopping center. Commissioner Stracker stated he was concerned about this since he believes these items should come before the Planning Commission. Staff noted that this exact wording is contained in the Interim Ordinance and has been there for the past two years. Commissioner Baker asked why a similar item on push carts was brought before the Commission four to six months ago if it had already been approved. Attorney Bobak noted that the Director has the discretion of bringing any item believed to be controversial, before the Commission for decision rather than deciding that issue on her own. Commissioner Stracker noted that he had a safety concern with push carts especially where children were concerned. Commissioner Weil didn't want to see the city get so business friendly that there was a loss of control and asked if a conditional use permit was required. Staff noted that it is a permitted use. Commissioner Kasalek stated that she was in favor of bringing push cart items for decision before the Commission. Commissioner Baker asked for a description of a push cart. Staff noted that a definition was listed on page 2, Exhibit A Section 1, Subsection No. (1) of the staff report and that staff would look at each item on a case by case basis as something that was not a permanent structure. Commissioner Weil stated that she has seen push carts at some shopping centers jammed in and lined up to look like a flea market and was not in favor of this look. Staff asked if the Commission would support this Ordinance if the language in Subsection Item lA and Section No. 4 was changed to bring push cart items before the Commission. Commissioner Stracker noted that he had a concern about design review. Commissioner Baker asked how long the term "temporary" meant and what was staffs definition of a "kiosk". Staff noted that portable and temporary would be interpreted to mean not a permanent structure and does not necessarily require a building permit. A kiosk is not defined as a typical retail space in a commercial center. The Public Hearing Opened at 7:34 p.m. The Public Hearing Closed at 7:34 p.m. Commissioner Butler moved, Baker seconded, to approve the Environmental Determination for the project by adopting Resolution No. 3259 as submitted. Motion carried 5-0. Planning Commission Minutes May 9, 1994 Page 4 Commissioner Butler moved, Baker seconded, to recommend to the City Council approval of Code Amendment 94-002 by adopting Resolution No. 3260 revised as follows: Ordinance No. 1123, page 2, revise Section 4, to strike the words, by the Director of Community Development. Ordinance 1123, page 2, Section 1 (a), line 6, revised to read "upon Planning Commission review and approval of a proposal subject to the findings required for approval of a Design Review application and upon final approval of a Design Review application by the Director of Community Development." Motion carried 5-0.
