1. Minutes of the March 28, 1994 Planning Commission meetinq.
Correction was made to page 11, Commissioner Butler comments,
paragraph three, replacing the word ceasing with seizing.
Commissioner Baker moved, Butler seconded, to approve the Consent
Calendar. Motion carried 5-0.

MINISTERIALLY EXEMPT PURSUANT TO THE PROVISIONS OF
SECTION 15268 OF THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
AUTHORIZATION TO EXTEND A TEMPORARY USE PERMIT FOR
AN ADDITIONAL TWO (2) MONTHS RESULTING IN AN
EXPIRATION DATE OF JUNE 3, 1994, FOR THE SALE OF
STRAWBERRIES FROM AN OPEN-AIR STAND.
Recommendation - It is recommended that the Planning Commission
approve the request to extend Temporary Use Permit 94-001 by Minute
Order.

The Public Hearing opened at 8:22 p.m.
Mr. Ted S. Thacker, son of the owner of Thacker Berry Farms asked
to have the forwarding address for future mailing changed to 11615
Firestone Blvd. #311, Norwalk, Ca.
The Public Hearing closed at 8:23 p.m.
Commissioner Butler moved, Kasalek seconded, to approve the request
to extend Temporary Use Permit 94-001 by Minute Order. Motion
carried 5-0.
3. Code Amendment 94-001

IT HAS BEEN DETERMINED THAT THIS PROJECT WOULD NOT
HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT AND A
NEGATIVE DECLARATION HAS BEEN PREPARED.
AN AMENDMENT TO CITY CODE SECTION 9299 ET. SEQ.,
ENTITLED ZONING ADMINISTRATOR, TO CLARIFY AND
UPDATE PROVISIONS OF THE SUBJECT CODE SECTION THAT
WOULD IMPROVE THE EFFICIENCY IN PROCESSING CERTAIN
DISCRETIONARY APPLICATIONS WHICH ARE MINOR IN
NATURE AND OFTEN NONCONTROVERSIAL.
Recommendation - It is recommended that the Planning Commission
take the following actions: 1. Approve the Environmental
Determination for the project by adopting Resolution No. 3245; and
2. Recommend to the City Council approval of Code Amendment 94-001
by adopting Resolution No. 3247, as submitted or revised.

Commissioner Stracker asked how many members of the Commission had
to request appeal if the Planning Commission wanted to appeal an
item.
Staff noted that the Zoning Ordinance would be under review and
would be handled as a follow up under Phase II to the General Plan
program. As such this section would provide an ability for appeal
to any party to request an appeal.

Commissioner Baker moved, Kasalek seconded to approve the
Environmental Determination for the project by adopting Resolution
No. 3Z45 as submitted. Motion carried 5-0.
Commissioner Baker moved, Kasalek seconded to recommend to the City
Council approval of Code Amendment 94-001 by adopting Resolution
No. 3247 as submitted. Motion carried 5-0.
REGULAR BUSINESS:

STAFF CONCERNS:
4. Report on Actions taken at April 4, 1994 City Council Meeting
Staff reported on the subject agenda and briefly summarized
the following items:
There was approval of a consulting engineering service
agreement with an engineering firm which would start on the
final project study report for the new ramps to set the new
alignment for the Newport Avenue extension in the Pacific
Center East project area.
Action was taken to continue Council discussion on requests
for bus shelter proposals.
The Agency took action to have staff prepare an RFP for a
library study so that the City can study options concerning
the renovation of the existing library system at the Civic
Center site and also to recommend an action plan for upgrading
library services and to respond to the need for a new facility
on the site.
Action was taken to approve the time extension
Frontrunner Homes for the car wash on E1 Camino.

There will be no regular scheduled business meeting of the
Council on the 19th as a celebration for the appointment of
the new mayor and seating of the Council, pending the election
results, will take place and an invitation to attend was
extended to the Commissioners. The next regularly scheduled
business meeting of the Council will be on May 2, 1994.
COMMISSION CONCERNS:
5. MCAS, Tustin Closure Status Update
The following is a summary of the oral report presented by
Christine Shingleton concerning the land use plan information.
The Task Force met on March 31 and took action to allow staff
to proceed with development and complete the project
description which will be utilized to begin preparation of the
environmental impact statement and the future specific plan.
The Task Force made a recommendation on the preferred use plan
and that plan will now become the base under which the
specific plan regulations will be developed.

The scope of work was outlined. The consultant is to provide
a community facility and infrastructure plan in the form of a
technical memorandum looking at all the alternatives and
identifying appropriate infrastructure systems necessary to
support each of the alternative plans as well as the preferred
plan.
There also will be a detailed computer based fiscal model that
will be developed and used to analyze projected cost and
revenues. Once phasing detail, infrastructure cost and
opportunities are reviewed then a variety of financial options
and testing of these options would occur through the market
consultant. A Specific Plan will be developed in draft form
and will include a land use master plan. From a marketing
standpoint the goal is to make this site the easiest site to
go through the development process anywhere in the county.
Highlights were given on the content of the land use plan
which involves two levels of administration namely,
neighborhoods and planning units. The eight proposed
neighborhood projects were reviewed.
The schedule involves creating a schematic draft specific plan
by the end of May and final environmental documentation by
October, 1994, with adoption before the end of this year of
all documents. Simultaneously a redevelopment project area
will be in creation.
Commissioner Baker
- Asked if toxic waste had been considered.
Staff noted that this issue is broadly summarized in the
EIS but that it is a separate process under state and
federal law (RAB and SERFA). The Navy, under the
Restoration Advisory Board, will be directing the process
which will ultimately be defined as to priority clean up
by marketing demand.
Asked if street alignment has been taken into
consideration in relation to the Santa Fe land use
specific plan.
Staff noted that a traffic analysis would be updated for
the entire city traffic model to reflect all projects
that have been approved to date.
Commission Butler
Thought it interesting that most people he has talked to
were in favor of retaining the hangars.
Staff noted that as a result of the community survey it
was found that most residents and the business community
wanted to retain at least one hangar and with the
adoption of the urban regional park property by the
County it is certain that one hangar will remain.
Marketing and use would drive the decision to develop the
remaining property or not. Although the City would have
to go through the State Section 106 process because it is
a National Registered Property, a variety of scenarios
will be laid out for its use to determine the feasibility
of retaining the second hangar.

Commissioner Weil
Asked if the financing plan would include a contingency
plan in case the current bills proposed for
redistribution of sales tax were passed.
Asked if the education village would provide housing for
the support staff in the LDR village.
Staff noted that the barrack location will provide a
place to stay for visiting professors and students in the
village area only.
Commissioner Butler
Reminded everyone that April 12 was the City Council
election and encouraged all to vote.
Commissioner Baker
Noted that April 23, 1994, was "Volunteer Day" and will
be celebrated at the Senior Center at 10:00 a.m.
Thanked staff for the Graffiti Report which was included
in the current packet and asked staff to follow up on
recent graffiti on Irvine Boulevard.
Commissioner Stracker
Mentioned that he had also heard of some recent graffiti
on Tustin Ranch Road.
Noted that he had received official notification of his
appointment to the Orange County Division of the League
of Transportation and Public Works Advisory Committee.
Commissioner Kasalek
Thanked the City Attorney for their efforts in removing
the billboard sign at Nisson Road.

Commissioner Baker moved, Kasalek seconded, to adjourn the meeting
at 9:10 p.m. Motion carried 5-0.
The next regular meeting of the Planning Commission is on April 25,
1994 at 7:00 p.m. in the City Council Chambers at 300 Centennial
Way, Tustin.
