At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken off-agenda items unless authorized by law). Minutes of the January 10, 1994 Planning Commission meeting. Co~missioner Well questioned the fact that there had not been a vote noted following the motion on Item 2, Conditional Use Permit 93-018, page 4. That vote should have shown passage, 5-0. Commissioner Kasalek moved, Baker seconded to approve the Consent Calendar. Motion carried 5-0. EDGAR PANKEY 26112 VIA PERA MISSION VIEJO, CA 92691 13850 RED HILL AVENUE RETAIL COMMERCIAL (C-i) DISTRICT THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO THE PROVISIONS OF SECTION 15303 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. Presentation: Becky C. Stone, Assistant Planner The Public Hearing was opened at 7:15 p.m. Commissioner Baker asked if the actual hours of operation were according to the application. Staff replied in the affirmative. Commissioner Kasalek noted that there was no mention in the Resolution conditions of approval if the applicant was forbidden to serve prepared foods. Staff replied that in order to do that they must have a permit from Orange County Health Department. The Public Hearing was closed at 7:17 p.m. Commissioner Butler moved, Baker seconded to approve Conditional Use Permit 94-001 by adopting Resolution No. 3229 as submitted. Motion carried 5-0. 4. Amendment to Conditional Use Permit 93-029 and Variance 93-008 LAND OWNER/ APPLICANT LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: DR. WILLIAM STANFORD 18532 SAUGUS AVENUE SANTA ANA, CALIFORNIA 92705 190 EL CAMINO REAL CENTRAL COMMERCIAL (C-2) DISTRICT; COMBINING PARKING AND CULTURAL RESOURCES (OVERLAY) DISTRICTS THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO PROVISION OF THE SECTION 15303 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. TO AMEND CONDITION NO. 1.1 OF PLANNING COMMISSION RESOLUTION NO. 3191 TO ELIMINATE VARIOUS LANDSCAPED AREAS, PROPERTY LINE BLOCK WALLS AND PARKING LOT CURBING AS PREVIOUSLY APPROVED IN CONJUNCTION WITH THE APPROVED DEVELOPMENT PLANS Recommendation - It is recommended that the Planning Commission adopt Resolution No. 3230 approving Amendment to Conditional Use Permit 92-029 and Variance 92-008, as submitted or revised. Presentation: Daniel Fox, Senior Planner Commissioner Stracker asked what kind of landscaping was previously next to the trash enclosure. Staff replied shrubs and ground cover. Commissioner Stracker asked if that area was to be irrigated. Staff replied it would be irrigated with an underground system. Commissioner Kasalek asked was property was directly behind. Staff replied it was an office building. Commissioner Weil asked if there had been any comments from the neighbors. Staff replied that only one, a Meat Market, and they were satisfied. The Public Hearing opened at 7:25 p.m. Commissioner Stracker stated that he would appreciate more landscaping in this area. He wanted to know what was going into the area where the street light would have been and if the applicant was prepared to maintain the landscaping and how much area is involved. Staff replied 80 square feet. T .......... T TIlt Planning Commission Minutes January 24, 1994 Page 4 Dr. William Stanford the applicant, stated that the was concerned with a planter in the area of the trash enclosure because of a potential hazard with skate boarders using it as a jump off point. He stated that he had decided to put concrete in that area. Commissioner Stracker noted that he was concerned with vehicles parking in that area. Dr. Stanford replied that the parking area was designated and he felt that no one would park there. The Public Hearing closed at 7:27 p.m. Commissioner Baker made a comment that he appreciated what Dr. Stanford is dealing with concerning the skate boarders. Commissioner Butler moved, Baker seconded, to adopt Resolution No. 3230 approving Amendment to Conditional Use Permit 92-029 and Variance 92-008, as submitted. Motion carried 5-0. 5. Conditional Use Permit 93-011 and Variance 93-002 PROPERTY OWNER/ APPLICANT: CHURCH OF SCIENTOLOGY 1451 IRVINE BOULEVARD TUSTIN, CA 92680-3844 LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: ATTENTION: MS. MARIE MURILLO 1451 IRVINE BOULEVARD PROFESSIONAL (PR) DISTRICT TO BE DETERMINED 1. A CONDITIONAL USE PERMIT TO AUTHORIZE AN EXISTING EXPANSION OF USE FOR AN EXISTING MOTIVATIONAL SCHOOL TO OCCUPY AN ENTIRE OFFICE COMPLEX. A VARIANCE TO REDUCE THE REQUIRED NUMBER OF PARKING SPACES FROM 214 SPACES TO 117 SPACES. Recommendation - It is recommended that the Planning Commission table this item pending the receipt of additional information from the applicant and completion of the environmental analysis by the Community Development Department. Presentation: Scott Reekstin, Assistant Planner Commissioner Weil indicated that she had been called and asked if the Commission would hear from the applicant. The Director advised the commission that other residents (in the 300 foot radius) had been informed by mail of the recommendation to table this matter and that she would prefer that there be no public hearing at this time. Commissioner Baker moved, Kasalek seconded, to table this item pending receipt of additional information from the applicant and completion of the environmental analysis by the Community Development Department. Motion carried 5-0. OLD BUSINESS: 6. Status Report Commissioner Weil stated that she appreciated these reports. Received and Filed. Planning Commission Minutes January 24, 1994 Page 5 NEW BUSINESS: 7. Design Review 93-035 APPLICANT/ ARCHITECT PROPERTY OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: JAMES R. HARRIS 2120 MAIN ST. #230 HUNTINGTON BEACH, CA 92648 JAMES PARKINSON 30 AUTO CENTER DRIVE TUSTIN, CA. 92680 50 AUTO CENTER DRIVE PC-MIXED USE - EAST TUSTIN SPECIFIC PLAN THIS PROJECT IS COVERED BY A PREVIOUSLY CERTIFIED EIR (85-2) FOR THE EAST TUSTIN SPECIFIC PLAN. NO ADDITIONAL DOCUMENTATION IS REQUIRED TO CONSTRUCT A 29,000 SQUARE FOOT AUTOMOBILE SALES AND SERVICE FACILITY Recommendation - It is recommended that the Planning Commission: Approve the Environmental Determination for this project by adopting Resolution No. 3226; and Approve Design Review 93-035 by adopting Resolution No. 3227, as submitted or revised. Presentation: Sara J. Pashalides Commissioner Butler asked if there was any possibility that the Auto Center would be continued over the E1 Modina Channel and if the channel was part of this property. Staff replied "no". Commissioner Stracker asked where the service entrance was. Staff pointed out the orange area on the exhibit board. Commissioner Stracker asked how many vehicles could be qued on site for service. L.W. Pettett of Harris, Pettett and Kent, Architects for the applicant, replied that the queing area can hold 12 cars bumper to bumper and that any cars waiting would then be taken to the roof area. Commissioner Butler asked why this project was not part of the Auto Center at its initial approval. Staff stated that the City had agreed to commit 1.3 million dollars to channel improvements and now with these improvements were completed and the pad elevations brought back up the area can now be made available for development. Commissioner Baker moved, Stracker seconded, to approve the Environmental Determination for the project by adopting Resolution No. 3226 as submitted. Motion carried 5-0. Commissioner Baker moved, Review 93-005 by adopting Motion carried 5-0. Stracker seconded, to approve Design Resolution No. 3227, as submitted. Commissioner Stracker asked if the CC&R's included anything about test driving through the neighborhood. Planning Commission Minutes January 24, 1994 Page 6 Staff replied, "no" but that the Police Department is enforcing abuse in the area. 8. Old Town Educational Video Project Presentation Commissioner Weil asked how the videos would be used. Staff replied that they would be used as an education and promotional tool. Commissioner Baker asked how many had been ordered so far and what was the cost. Staff replied that over 10 had been ordered almost immediately following the notification that they were ready for sale and that the cost was under $6.00. Commissioner Baker noted that it would be good to distribute these to the Chamber of Commerce as well. Received and Filed. Commissioner Weil stated that she had received a letter from Sunshine Strawberries concerning a temporary use permit. Staff replied that the city was not processing temporary use permits but that the applicant has a right to apply until the code is in place. Dan Fox will follow up with a letter to them. STAFF CONCERNS: Report on actions taken at January 17, 1994 City Council meeting Staff reported on the subject agenda. Commissioner Weil asked the status of the General Plan. Staff replied that no further public testimony was to be taken and that it would be back on the Council agenda February 7th for action. Commissioner Stracker inquired on the bids for the Sports Park. Staff replied that bids were higher than had been expected. Staff reminded the Commission of a Task Force Meeting, February 3, 1994 at 4:00 p.m. at the Senior Center. COMMISSION CONCERNS: Commissioner Kasalek Asked staff if the Public Works "Do Not Block" signs were effective and if one could be installed at E1 Camino and East. Staff responded that the signs did have a positive effect since the Police Department can legally enforce them and that a sign could be placed at this location. Planning Commission Minutes January 24, 1994 Page 7 Commissioner Stracker - Asked if the earthquake had done any damage in Tustin. The Director responded that a thorough inspection had been done and that there was no damage to report. - Extended an invitation from the Los Angeles City Engineer, through his firm, for volunteers with technical knowledge to help access damage to buildings in the earthquake area. Commissioner Baker Asked, in lieu of what has happened in Northridge, would the City be considering any revision to the code concerning tuck under parking. The Director responded that the buildings at greatest risk are the tilt ups built between 1970 and 1976 before they were required to be reinforced to withstand earthquakes. The State is now working on an ordinance for mandatory retrofit requirements. The Director noted that the City of Tustin has one of the best Building Officials in the county with extensive training and personal experience in the earthquake field. He is now evaluating the current risks and will follow up with the property owners. Commissioner Butler Asked if other cities also have approval to produce videos. The Director stated that Tustin had applied for a competitive grant, was ranked competitively and subsequently became one of only 16 cities chosen to be awarded this grant. Asked if all Commissioners could attend the Task Force meeting on February 3rd. The Director responded that there could be as many members of the Commissin present at the Task Force meeting as want to participate. Commissioner Weil Was concerned about earthquake preparedness. She has sent for a video with suggestions for things to do and will share it with anyone who would like to see it. - Thanked staff for the Tustin Market Place report. There followed an informal earthquake discussion. · ....
