At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken off-agenda items unless authorized by law). IF YOU WISH TO ADDRESS THE COMMISSION ON ANY MATTER, PLEASE FILL OUT ONE OF THE CARDS LOCATED ON THE SPEAKER'S TABLE SO THAT YOUR REMARKS ON THE TAPE RECORDING OF THE MEETING CAN BE ATTRIBUTED TO YOU. Minutes of the September 27, 1993 Planninq Commission meetinq. Commissioner Weil moved, Baker seconded to approve the Consent Calendar. Motion carried 5-0. PUBLIC HEARINGS: None Scheduled IF YOU CHALLENGE AN ITEM CONSIDERED AT A PUBLIC HEARING IN COURT, YOU MAY BE LIMITED TO RAISING ONLY THOSE ISSUES YOU OR SOMEONE ELSE RAISED AT THE PUBLIC HEARING DESCRIBED IN THIS AGENDA, OR IN WRITTEN CORRESPONDENCE DELIVERED TO THE CITY OF TUSTIN AT, OR PRIOR TO, THE PUBLIC HEARING. OLD BUSINESS: Draft General Plan, Draft Program Environmental Impact Report and Mitiqation Monitorinq Proqram Discussion The Planning Commission had an open discussion on the Draft General Plan and Draft Environmental Impact Report (EIR) and identified certain minor corrections in the final draft of the General Plan and Draft EIR. Board of Appeals The Planning Commission had an open discussion on the Board of Appeals process with the major issues being: The Board of Appeals is the final body before court with no right of appeal to the City Council; Extra due process has been added due to being more adjudicary than normal; - A standard oath will be given en masse; - The applicant may ask more questions than normal; Hearsay will be acceptable with other evidence, but the finding cannot be supported solely by hearsay; - Findings will be in writing; - If the matter goes to a lawsuit, the evidence considered will be administration of record with all notices, appeal, transcripts and documentary evidence; A staff report will be prepared; - The appellant may be represented by an attorney; - A court reporter may type the process for the appellant, but the Appeal Board will not; and that the petitioner is required to undertake the cost of transcription; - The hearing will be taped for ease in transcription, if necessary, and the appellant should be informed; - The Planning Commission's discussion will be done in public; - If continued, the hearing could be continued to the next regular Planning Commission meeting; - The guidelines for conduct of a hearing encourage members not participating in the full process to not participate at all. Commissioner Baker moved, Stracker seconded to receive and file this report. Motion carried 5-0. STAFF CONCERNS: 4. Report on actions taken at October 4, 1993 City Council meetinq Staff reported on the subject agenda. Attorney Bobak responded to a request which had been made at the last meeting from the Commission for information on the Brown Act bills. If the bills are signed by the Governor, the attorney's office will prepare a summary for the City Council with copies available for the Planning Commission. Planning Commission Minutes October 11, 1993 Page 3 COMMISSION CONCERNS: Commissioner Butler -Thanked staff for the news clippings he had requested. Commissioner Baker - None Commissioner Weil -Asked for an update on the Base Closure procedures. Staff noted that Commissioner Weil had shared an article which appeared in the L. A. Times concerning the Norton Base closure and the fact that a homeless organization has declared their right to seek transfer of the entire Norton facility to them. Staff recognizes that there is concern about the impact of the McKinney Act on our base site and although the McKinney Act cannot be ignored the Task Force and community objective is to recognize the balance needed to produce economically pro- ductive uses on the property. Both the Senate and Congress have recently adopted bills which would provide that the Federal screening process be completed within 6 months which would include the McKinney Act. This would mean only one round of screening would occur and would greatly help in terms of our own process; basically precluding what is happening at Norton. Staff reported that a Tustin case study was recently presented in Orlando, Florida, and will also be presented at Oakland showing a real acknowledgement of our process. -Inquired about the Micro Center progress. Staff replied that although they are making rapid progress they probably would not be finished by their November 1st deadline. Commissioner Stracker -Asked if the Commission was to appear in an official capacity at the Tustin Draft General Plan Workshop open house on October 12. Staff stated that since this was an open house and there would be no public testimony, the consultant team would be leading the discussion and the Commission could attend as guests. -Inquired about the progress of K Mart. Staff noted that their goal was to be finished in November and it looks like they will accomplish this. -Referred to an article which appeared in "Metropolitan" concerning Santa Ana and the Enterprise Zone negotiation with a major Tustin employer's move to Santa Ana. Staff noted that they were aware of it and that so far all Santa Ama had accomplished was dialogue. Inquiries of this sort are being taken through Southern California Edison and staff has field interviewed the affected business. The Planning Commission Minutes October 11, 1993 Page 4 Economic Development Council is making rapid progress in terms of attraction, location and retention programs in an outreach to these companies. -Stated that he thought the Ralphs Center looked very good. -Noted that the traffic lights at Browning and Irvine Boulevard were short cycling on weekends. Staff acknowledged that there had been a problem with the time clock in that area. Commissioner Kasalek -Inquired as to where Irvine obtained the funds for the underpass work at Culver. Staff stated that the major portion of funding was through State funding through a TCI grant to Irvine with 50% matching obligation funds in the form of bonds which are paid for by the residents.
