At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdic- tion of the Commission (NO action can be taken off-agenda items unless authorized by law). REQUEST: AMENDMENT TO CONDITIONAL USE PERMIT 79-002 TO ADD A MENU BOARD SIGN TO THE EXISTING DRIVE-THROUGH RESTAURANT AT 14510 NEWPORT AVENUE. Recommendation - It is recommended that the Planning Commission approve Conditional Use Permit 93-017 by adopting Resolution No. 3169, as submitted or revised. Presentation: Scott Reekstin, Assistant Planner Commissioner Baker asked if the date of 1972 noted in paragraph two of the background information was correct. Staff responded that they thought the date of 1972 was correct but would follow up. Commissioner Butler noted that it may have been approved for a drive-through, but not for the Beef Bowl; and asked if there had been any complaints regarding back-up in the drive-through aisle. Staff replied negatively. Commissioner Butler asked how long the Taco Bell queuing distance was. Staff replied that there is a seven car stacking lane at Taco Bell, and that a traffic study is being done. Commissioner Kasalek commented that it could vary depending upon location. The Director affirmed and stated that it could also depend upon the type of fast food. The Public Hearing was opened at 7:10 p.m. The Public Hearing was closed at 7:11 p.m. Commissioner Kasalek stated that center has not been particularly busy and that there should not be a problem with stacking. Commissioner Baker stated that it should expedite traffic. Commissioner Baker moved, Butler seconded to approve Conditional Use Permit 93-017 by adopting Resolution No. 3169 as submitted. Motion carried 5-0. 3. Design Review 89-044 and Variance 90-011 APPLICANT/ LANDOWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: MR. AMAURI NICASIO 25282 DE SALLE ST LAGUNA HILLS, CA 92653 13651 GREEN VALLEY MULTIPLE FAMILY RESIDENTIAL (R-3 2,700) CATEGORICAL EXEMPTION CLASS 3, SECTION 15303 EXTENSIONS OF TIME TO THE EXPIRATION DATES DESIGN REVIEW 89-044 AND VARIANCE 90-011 OF Recommendation - It is recommended that the Planning Commission approve a one (1) year extension of time to the expiration dates of Planning Commission Minutes August 9, 1993 Page 3 Design Review 89-044 and Variance 90-011 by adopting Resolution No. 3170, as submitted or revised. Presentation: Joann Lehmer, Associate Planner Commissioner Butler referred to Condition 1.5 and asked if the site plan and elevation changes had been completed. Staff referred to Exhibits B and C at the end of Attachment A of Resolution 2896; stated that the property owner decided to create a duplex at the end of the review process, but has not completed construction. Commissioner Stracker asked if there would be a common driveway; and if the applicant needed approval of the neighbors. Staff affirmed and stated that there would be a garage to the rear and one to the right with a carport; and that as part of the Design Review process the neighbors were noticed and there have been no complaints. The Director noted that the applicant has all of the dimension requirements for an on-site driveway. Commissioner Weil stated that the common driveway is handling both parts of the duplex, and that it is not shared by the neighbors. Commissioner Stracker noted that the applicant could split the property. Staff replied that the applicant could apply for a lot split but that the applicant would then have to meet the minimum lot size standards of this variance and it is doubtful that the standards could be met. Commissioner Butler suggested making a condition to do a design revision. The Director replied that the Public Hearing has been advertised as an extension request; that the Commission has the right to make changes, but would not recommend changes other than regarding time frames of the extension. The Public Hearing was opened at 7:20 p.m. The Public Hearing was closed at 7:21 p.m. Commissioner Weil stated that this application was extensively reviewed, originally; that she is in favor of the extension; and that the economic climate is a legitimate reason for the extension. Commissioner Butler moved, Weil seconded to approve a one (1) year extension of time to the expiration dates of Design Review 89-044 and Variance 90-011 by adopting Resolution No. 3170, as submitted. Motion carried 5-0. OLD BUSINESS: 4. Draft Circulation and Noise General Plan Elements These two elements were discussed by Christine A. Shingleton, Assistant City Manager, John Bridges, representative of Cotton Beland (CBA) and City Attorney, Lois Bobak, who responded to the questions of the Commissioners as each document was reviewed. Mr. Planning Commission Minutes August 9, 1993 Page 4 Bridges will make the changes/corrections to the documents that were noted by the Commission. NEW BUSINESS: None STAFF CONCERNS: 5. Report on actions taken at Auqust 2, 1993 City Council meetinq The Director reported on the subject agenda. Commissioner Weil asked for clarification of the addition of the Mello Roos act to the extension of the Tentative Tract Map. The Director replied that the City Council requested addition of standard language citing that residents could be subject to assessment districts with the Mello Roos Act. Commissioner Butler asked about the time frame of undergrounding utilities on Yorba between Irvine and Seventeenth Streets. The Director replied that due to a lack of resources, the project will not move ahead for approximately 10 years, but was moved up in priority. COMMISSION CONCERNS: Commissioner Butler In reading the Council Action Agenda of 8-2-93 noticed that there were two claims rejected from claimant Allen Meadows and he wished to know the nature of them. Staff responded that they had to do with arrests. Noted his appreciation of the work done by John Bridges of CBA on the General Plan. Commissioner Weil Thanked staff for the employee emergency telephone number listing. Asked if there was a plan for signage at the new building to designate Council Chambers. Staff responded that there would be a sign indicating Community Center and Council Chamber locations at the entry to the building. Noted an invitation to the Tustin Rehab Hospital art show which features the art work of the patients and wanted to encourage everyone to attend. Commissioner Stracker - Asked about the status of the depression on Vintia. Staff replied that it was not a hazard, but placed repair on a priority for required street maintenance. - Asked about stop signs and barricades at the Auto Center. Planning Commission Minutes August 9, 1993 Page 5 Staff replied that it was a security mitigation measure. Commissioner Kasalek - Asked about the status of the billboard on Nisson. Staff replied that the sign had been knowingly altered and that the matter was referred to the City Attorney. ADJOURNMENT: Commissioner Baker moved, Butler seconded to adjourn the meeting at 9:25 p.m. Motion carried 5-0.
