At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken off-agenda items unless authorized by law). JERRY GREUBLE ALEXANDRA FOUR 12805 NEWPORT AVENUE TUSTIN, CA 92680 IRA AND PATRICIA THELEN TRUSTEES OF THE THELEN TRUST 14442 HOLT AVENUE SANTA ANA, CA 92705 14442 HOLT AVENUE R-1 (SINGLE FAMILY RESIDENTIAL) THIS PROJECT IS CONSIDERED MINISTERIALLY EXEMPT PURSUANT TO SECTION 15268(b) OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AUTHORIZATION TO CREATE FOUR (4) NUMBERED PARCELS AND ONE (1) LETTERED PARCEL TO ACCOMMODATE FOUR (4) SINGLE FAMILY DWELLING UNITS Recommendation It is recommended that the Planning Commission adopt Resolution No. 3138 recommending to the City Council approval of Final Parcel Map 91-288, as submitted or revised. PUBLIC HEARINGS: IF YOU CHALLENGE AN ITEM CONSIDERED AT A PUBLIC HEARING IN COURT, YOU MAY BE LIMITED TO RAISING ONLY THOSE ISSUES YOU OR SOMEONE ELSE RAISED AT THE PUBLIC HEARING DESCRIBED IN THIS AGENDA, OR IN WRITTEN CORRESPONDENCE DELIVERED TO THE CITY OF TUSTIN AT, OR PRIOR TO, THE PUBLIC HEARING. 3. Time Extension for Variance 91-15, Al's Woodcraft Recommendation - It is recommended that the Planning Commission approve a twelve month time extension to Variance 91-15 by adopting Resolution No. 3137, as submitted or revised. Presentation: Dan Fox, Senior Planner The Public Hearing was opened at 7:02 p.m. The Public Hearing was closed at 7:03 p.m. The Public Hearing was re-opened at 7:03 p.m. Bill Mathis, 14051 Stratton, Santa Ana, applicant, stated that the extension to the variance was requested due to the economy and that the State has not paid him; and that the improvements should cost approximately $50,000, which he does not have. The Public Hearing was closed at 7:04 p.m. Commissioner Butler asked if the fee had been waived as requested; and if that needs to be part of their approval. Staff replied that the City Manager reduced the fee to $100; and that it does not need to be part of the motion. Commissioner Baker stated that this was one more indication of the hardships that have occurred due to the freeway construction and that it should be approved. Commissioner Baker moved, Stracker seconded to approve a twelve month time extension to Variance 91-15 by adopting Resolution No. 3137, as submitted. Motion carried 4-0. OLD BUSINESS: 4. Open Air Produce Stands/Temporary Uses, Status Update Recommendation - Pleasure of the Commission. Commissioner Butler stated that he would like to see the first draft and ordinances from other cities to assist in their decision making. Staff replied that information is arriving from other cities which they will compile for comparison. Commissioner Weil asked if a subcommittee was necessary to review the draft in advance. Staff replied negatively; and noted that once the uses are reviewed, staff could provide a draft for the Planning Commission. Planning Commission Minutes May 10, 1993 Page 3 Commissioner Baker stated that it was a good idea to see what is effective in other cities. Commissioner Stracker stated that it was a good idea to take an overall look at the information. Commissioner Baker moved, Stracker seconded to receive and file. Motion carried 4-0. 5. Measure M - Oversiqht Committee Commissioner Weil stated that she appreciated the report. Commissioner Butler thanked staff and stated that it gave a clearer understanding of who could be on the committee. Commissioner Butler moved, Baker seconded to receive and file. Motion carried 4-0. 6. MCAS Opportunities & Constraints Commissioner Butler asked if the opinion question regarding preservation of the blimp hangars was a blanket question, or with the knowledge of maintenance costs. Staff replied that it was a blanket question as to whether they should keep one, two or none; that 99% at the meeting said yes to saving the hangars, but pulled back when they realized that it costs $500,000 per year to maintain the hangars. Commissioner Baker stated that the hangars are on the National Registry, and that people feel that they cannot be removed. Commissioner Weil asked if they were on the Registry, or just on the recommended list. Staff replied that they are on the National Registry of Historic Places, but that does not guarantee protection; that it only makes the City be careful when recommending demolition or re-use; that their importance to the national interest needs to be recognized. Commissioner Baker stated that the meeting of April 24 was good with good material, but that there were only a few people present from the Community. Staff stated that they were equally disappointed; they published one-eighth page ads twice in both local newspapers; that personal invitations were sent to those within 300 feet; and that every homeowners association in Tustin and approximately nine in Irvine were notified; that there are probably approximately 100 people on the contact list. Commissioner Weil stated that the closer they get to the actual closure, the more interest will be shown. Commissioner Baker noted that the group putting together these meetings were listening to the people; that the ideas are for a museum, a park, a golf course, but that they should be self- supporting. Commissioner Weil asked if they were trying to get someone to attend the next meeting that was knowledgeable about the McKinney Act. Planning Commission Minutes May 10, 1993 Page 4 Staff replied that that was the purpose of the subcommittee; that they are making arrangements for a person from HUD to meet with the subcommittee; that Councilperson Thomas has volunteered; and that a presentation will be made to the subcommittee who will provide recommendations to the task force as to how to treat the issue. Commissioner Weil volunteered for the task force subcommittee. Commissioner Butler moved, Baker seconded to receive and file. Motion carried 4-0. Receive and file. NEW BUSINESS: STAFF CONCERNS: 7. Report on actions taken at May 3, 1993 City Council meetinq Staff reported on the subject agenda. Commissioner Weil asked if there were presently standards for the bus shelters; that the Planning Commission be tied into the loop regarding bus shelters. Staff affirmed that they had minimum standards requiring no advertising of alcohol or tobacco, but that they needed other criteria such as maintenance standards; that they have obtained standards from other cities indicating problems to be aware of. Commissioner Butler requested the history and resolution of the sprinkler ordinance. Staff replied that the Council required all new detached homes over 3,600 square feet to have sprinklers; and that code modifications were minor. Commissioner Weil also requested that the Commission be updated regarding the fire retardant wood shake and shingle roofing materials report that went to Council; and specifically inquired regarding code requirements for roofing and when the Building Code would be updated. Staff offered to provide a presentation at the next meeting by the Building Official on all items. COMMISSION CONCERNS: Commissioner Baker -Attended the graffiti sub-committee meeting and was impressed with the turnout. Asked when the next meeting would take place. Staff indicated that it was set for June 8, at 6:30 p.m. at Aldersgate Church. Commissioner Weil -Asked the Commission if they were interested in going on the Metrolink tour. Commissioners Stracker, Butler and Weil all wish to participate.
