REGULAR MEETING

1. Minutes of the March 22, 1993 Planninq Commission meetinq.
Commissioner Baker complimented staff on production of the minutes.
Commissioner Weil moved, Baker seconded to approve the Consent
Calendar. Motion carried 5-0.

Withdrawal of Appeal of Temporary Use Permit for BJ Tree
Service
Presentation: Scott Reekstin, Assistant Planner
Bobby Gilbert, BJ Tree Service, 17300 Seventeenth Street, Suite J-
231 stated that he recently sent a letter to stop his appeal; that

he is in the process of moving his facility and asked to be able to
stay until June 30. He continued with stating that many businesses
are going out of business; that he felt that the City was running
him out of town; that he has been a resident for 16 years and in
business for 10 years, 3 years at this location.
Commissioner Kasalek thanked the applicant for his comments and
stated that City staff is only doing their job and following the
law.
Commissioner Weil moved, Butler seconded to receive and file this
report. Motion carried 5-0.
3. Modification to Desiqn Review 92-049
Commissioner Weil moved, Butler seconded to receive and file
this report. Motion carried 5-0.

THIS PROJECT HAS BEEN DETERMINED TO BE
CATEGORICALLY EXEMPT (CLASS 01) PURSUANT TO SECTION
15301 OF THE CALIFORNIA EQUALITY ACT (CEQA)
1) TO DETERMINE THAT ARCHITECTS OFFICES ARE A
PERMITTED SECONDARY USE WITHIN PLANNING UNIT 1
OF SUBAREA 2 OF THE FIRST STREET SPECIFIC PLAN
2) TO APPROVE A DESIGN REVIEW FOR A 240 SQUARE
FOOT ADDITION TO THE EXISTING COMMERCIAL
BUILDING AT 145 WEST FIRST STREET.
Recommendation - It is recommended that the Planning Commission
take the following actions: 1. Determine by Minute Motion whether
architects offices should be a permitted secondary use within
Planning Unit 1 of Subarea 2 of the First Street Specific Plan; and
2. Approve Design Review 92-054 by adopting Resolution No. 3134,
as submitted or revised.

Commissioner Butler commented that a car would not be able to exit
the tandem parking spaces.
The Director replied that the rear parking is actually parallel,
not tandem; that there is additional space for pull in; that the
length is now 25 feet long by 10 feet wide and that the City only
requires 22 feet wide by 9 feet long.
Commissioner Baker asked if staff had investigated the location and
if the parking lot was full at any time.
Staff replied negatively.
Wayne Siu, applicant, stated that his office would have 5
employees, and that the other tenant would have 3; that they
generally do not use the rear parking lot; and parking is not a
problem with their business.

Commissioner Kasalek asked how the applicant felt about changing
the color.
Mr. Siu replied that he thinks the building looks appropriate for
an architect's building; that they considered awnings and
decorative trim on the front facade, but it did not look right on
the elevation; that if they were closer to the street, then awnings
would, be appropriate for providing shading along the sidewalk; and
that he feels comfortable with the color and would rather not
change it since it blends well with the wood paneling. Mr. Siu
distributed color photographs of the building to the Commissioners.
Commissioner Weil stated that she would feel more comfortable
allowing Mr. Siu make the color decisions since he is an architect;
that the original First Street Specific Plan committee tried to
encourage more retail in the area, it seems to be more auto
related; and that an architect's office would be appropriate for
that area.
Commissioner Butler stated that he should be able to paint it
whatever color he chooses; that he was concerned with the parking
only if it changes to a commercial or retail use, but it would have
to come back to the Commission for approval.
The Director responded that if it was a primary use outside of the
redevelopment area, it would not have to come back to the
Commission; that the only reason this came to the Commission was
due to the Use Determination; that where there is any discretion
involved, the Commission has authority over design review items on
First Street between Centennial and the SR 55 Freeway.
Commissioner Kasalek noted that the report stated that it was
fairly limited as to what type of usage could be located there.
Commissioner Butler stated that the addition should be allowed.
Commissioner Weil moved, Stracker seconded to approve by Minute
Order that architect offices be permitted as a secondary use within
Planning Unit 1 of Subarea 2 of the First Street Specific Plan.
Motion carried 5-0.
Commissioner Weil moved, Baker seconded to approve Design Review
92-054 by adopting Resolution No. 3134 as submitted. Motion carried
5-0.
5. General Plan Annual Report 1992-93
Recommendation - It is recommended that the Planning Commission
review the General Plan Annual Report 1992-93 and authorize staff
to forward the report to the City Council for their consideration.
Presentation: Anne Bonner, Associate Planner
Staff made a correction to the report stating that it should be an
annual report, not fiscal.
Commissioner Weil complimented staff member Bonner on the report,
noting that it was user friendly; and asked if the Council had
considered putting the Helicopter Base under Redevelopment; and
that it will be blighted by time it is finished.
The Director replied that they are considering exploring that
potential; that there is a problem with the definition of what is
"urbanized" under State Development Law; that they are monitoring

the progress of two current blls in the State legislature for
possible applicaiton to Tustin.
Commissioner Kasalek complimented staff on the report and noted
that it was very informative in a concise manner.
Commissioner Stracker moved, Butler seconded to forward this report
to the City Council for their consideration. Motion carrie~ 5-0.
6. Moulton Parkway Super Street - Environmental Impact Report
Commissioner Stracker asked if staff attended the April 1 meeting.
Staff member Doug Anderson, affirmed; and stated that notification
went out with release on March 31.
Commissioner Kasalek complimented staff on their efforts to notify
the homeowner groups.
Commissioner Weil noted that she appreciated that staff included
the Commissioners' names on the notification list.
Commissioner Butler asked the status of the Irvine super street.
Staff replied that the Irvine super street has been renamed the
Irvine Street Restriping Plan and has been put on hold pending
opening of the First Street Bridge and Main Street Undercrossing;
that the neighbors felt that the traffic will be rediverted with
the opening of the bridges; that parking and noise studies will be
done.
Commissioner Stracker asked the status of Warner Avenue super
street.
Staff denied that it was being considered; and that funding will
just be sufficient to cover the streets that have already been
designated.
Commissioner Butler moved, Weil seconded to receive and file this
report. Motion carried 5-0.
STAFF CONCERNS:
7. Report on actions taken at April 5, 1993 City Council meetinq
Staff reported on the subject agenda. The Commissioners were
advised of a Task Force meeting to be held Thursday, April
22nd at Irvine at 7:00 p.m., followed by a Community Workshop
on Saturday, April 24th at 9:00 a.m. A Beautification
Committee meeting will be held at 6:00 p.m. at the Senior
Center on Wednesday, April 14th.
Commissioner Kasalek noted that the Commissioners were concerned
with the Conditional Use Permit (CUP) running with the land.
The Director commented that it will continue to be a monitoring
item for staff to follow if desired by the City Council; that the
CUP will run with the land; that if there are violations, the
Commission can initiate revocation procedures; that the City
Council has not formally voted, but asked staff to bring back an
alternate resolution.

COMMISSION CONCERNS:
Commissioner Weil
- Concerned about the Commuter Rail submittal and project
design. She inquired if there had been a location chosen
as yet.
Staff reported that OCTA will reserve the grant
allocation for the City of Tustin until a

- Inquired as to why the City Council was concerned
about satellite dish guidelines.
Staff reported that due to the recent deregulation of the
cable industry, coupled with the rising costs of cable
service, that Councilman Potts appeared to be concerned
about the possibility of satellite dishes being used more
prevalently.
- Commissioner Weil discussed some background on the
Coalition of Regional Airport Solutions, of which she is
a member, and encouraged the Commissioners to join. She
expressed her delight that the City had renewed
membership in this group.
Commissioner Stracker
- Inquired as to what was known concerning future plans
in the Tustin Market Place.
Staff responded that although nothing had been officially
known, the Director has heard that the access point on
East Drive was being looked at and that the Edwards
Theaters were seeking to expand.
Commissioner Baker
- Inquired about the East Tustin area, particularly the
site at Irvine/Jamboree.
Staff reported that they believed that property was sold
and/or in a final transaction stage.
Commissioner Butler
- Stated that he is pleased with the recapping of the
minutes of the City Council with the new type style since
it is easier to read.
Commissioner Kasalek
- None

The next regular meeting of the Planning Commission is on April 26,
1993 at 7:00 p.m. at the Tustin Senior Center, 200 S. "C" Street,
Tustin.
