REQUEST:
APPROVAL OF A MASTER SIGN PLAN FOR TUSTIN AND A
SIGN CODE EXCEPTION TO PERMIT STRUCTURAL
ALTERATIONS TO AN EXISTING POLE SIGN.
Recommendation - It is recommended that the Planning Commission 1)
approve Conditional Use Permit 92-031 by adopting Resolution No.
3093, as submitted or revised; 2) Provide direction to staff on the
Sign Code Exception.

The Public Hearing was opened at 7:06 p.m.
Larry Musil, Musil, Perkowitz and Ruth, 911 Studebaker Road, Long
Beach, stated that they will replace the two (2) existing Ralph's
signs with one (1) sign; that they are performing the remodeling
voluntarily without use of Redevelopment funds; that they wish to
dress up the pole sign and make wall signs more proportionate to
the buildings; that no structural changes are proposed for the pole
sign; that they cannot afford replacement of the pole sign due to
economy; and requested extension of completion date to December 31,
1993 as noted in Item 1.6 of page 2 of Exhibit A of Resolution
No.3093.
Commissioner Stracker asked if the pole sign is needed for
financial reasons; and the cost of a new sign.
Mr. Musil replied that the tenants want to retain the pole sign;
that it is also for financial reasons; and it would require $20-
22,000 to replace it.
Francine Riqhter 1262 Olwyn, stated that she was concerned with the
new lighting proposed; that the neighbors dislike the pole sign,
that it is a nuisance; that it is one of the only non-standard pole
signs remaining; that two (2) years ago, the Planning Commission
was intending to standardize pole sign heights, but now has been
informed that this sign is grandfathered into the center; would
like to see it lowered for modernization; and that she refuses to
shop at Ralph's as a protest to the sign.
Mr. Musil replied that there are no plans to modify the lighting;
and that channel letters are intended for the building signs.
Guy Riqhter, 1262 Olwyn, stated that the sign was installed in 1965
and has always been a mess; that the lights are on all night long;
asked if the sign would become brighter; and asked why it cannot be
lowered.
Mr. Musil replied that the sign would be subdued with architectural
features, but same wattage.
The Director replied that the sign is not automatically grand-
fathered; that the applicant is requesting a sign code exception to
the non-conforming standard; that the applicant has the right to
request a variance; and that staff is looking for direction from
the Planning Commission on this matter.
Vickie Dewey, RREEF Management Company, 1630 N. Sunkist, Anaheim,
representing the owner of the center, stated that the variance is
requested because the tenants like the sign and they are leasing
the space; that they would like to keep the tenants happy and the
neighbors; and that they are proposing to improve the sign.

Commissioner Stracker suggested the Righters see the proposed
design; asked if additional landscaping was proposed and requested
representation from the applicant; and suggested it be conditioned.
Staff replied that the applicant has been requested to provide
additional landscaping.
The Director responded that the Commission can propose conditions,
but they need to be related to the request and that this is for a
master sign plan; and that since it is unrelated, discouraged that
approach.
Mr. Musil replied that they plan on additional landscaping and to
redo the existing.
Commissioner Baker asked the intent of the tall trees that block
the pole sign.
Ms. Dewey replied that they are on City property.
Commissioner Weil suggested that the applicant request trimming.
The Director suggested that the request could be transmitted to
Public Works.
The Public Hearing was closed at 7:20 p.m.
Commissioner Weil stated that she was on the Planning Commission in
the early 1980's when the Commission gave the owner of the property
an exception to the pole sign with the understanding that it would
be lowered upon the next remodeling; that all other centers have
complied and would like to see this center conform; that she agreed
with larger signs on the facade.
Commissioner Kasalek agreed and stated that it was out of balance
with the City, even being higher than freeway signs; that monument
signs are at driver's eye level; but agreed with the larger wall
signs.
Commissioner Stracker congratulated the applicants for voluntarily
improving the center; stated that he would like additional
landscaping; agreed that the pole sign should conform.
Commissioner Baker asked the maximum pole sign height allowed.
Staff replied that 20 feet was the maximum.
Commissioner Baker replied that it would not be seen from blocks
away; that they should be looking for the ability to attract people
into the center; that the pole sign is difficult to see due to the
trees; and that he agreed with the other Commissioners.
The Director suggested that the items be separated; and that the
Commission has the right to request modification of the pole sign.
Commissioner Baker moved, Weil seconded to deny a Sign Code
Exception to permit structural alterations to an existing pole
sign. Motion carried 4-0.
Commissioner Kasalek moved, Baker seconded to approve Conditional
Use Permit 92-031 by adopting Resolution No. 3093 revised as
follows:

Insert Item 1.8 to read as follows: (5) 1.8 Approval of
Conditional Use Permit 92-031 for the Master Sign Plan for Tustin
Heights Shopping Center is contingent upon the requirement that the
existing non-conforming sixty (60) foot pole sign on the subject
site be brought into conformance with the City of Tustin's current
Sign Code. No sign permits consistent with the new Master Sign
Plan for the shopping center nor structural alterations to the
facade of the shopping center shall be approved prior to one of the
following conditions being met: a. The existing, non-conforming
pole sign is removed; or b. A Conditional Use Permit for a new
pole sign or modification of the existing pole sign is submitted
and approved by the Planning Commission, authorizing a pole sign
which meets all requirements of Tustin Sign Code Section 940462
including that the sign be compatible with the project design and
not exceed twenty (20) feet in height and fifty (50) square feet in
copy area (encompasses the extreme units of copy with any frame or
trim forming an integral part of the display such as sign cabinet);
or c. A monument center identification sign is installed which
meets the requirement of Tustin Sign Code Section 9408.

Recommendation - It is recommended that the Planning Commission
take the following actions: 1. Approve the Environmental
Determination for the project by adopting Resolution No.3090; and
2. Recommend to the City Council approval of Code Amendment 92-006
allowing mini warehouses as permitted uses in the Industrial
(M) District by adopting Resolution No.3091-A; or 3. Recommend to
the City Council approval of Code Amendment 92-006 allowing mini
warehouses as conditionally permitted uses in the Industrial (M)
District by adopting Resolution No.3091- B, as submitted or
revised.

Commissioner Weil asked if the staff was aware of any problems with
code enforcement.
Staff replied that there has been no recent code enforcement
action.
The Director responded that historically there has been a problem
with PM located facilities, but not currently.

Commissioner Stracker noted that traffic and fire department
concerns have been a problem in the past in other cities; and that
these uses should be continued as a Conditional Use Permit and
brought before the Commission.
Commissioner Weil disagreed, and stated that her personal
experience indicates that they are well designed; that due to the
hard economic times, she feels that staff should approve the
applications, instead of charging a CUP fee; requested that the
storage facilities allow storage only, and nothing like band
rehearsal.
Commissioner Kasalek stated that she was comfortable with staff's
decisions and would maintain the quality needed for Tustin.
Staff replied that it is implied in the use as a self-storage and
mini-warehouse that no band rehearsal is allowed; and would be
handled through the code enforcement process if needed; and that
some facilities allow a caretakers unit, which would come to the
Planning Commission for review.
The Director suggested that a definition could be added to the use
to eliminate confusion.
Commissioner Baker asked if there was a parking problem at U-Haul
which has storage units with parking outside and walking in; and
that a CUP might be an appropriate mechanism for review.
Staff replied that U-Haul is a commercial property which today's
code would not allow; that it is a non-conforming use which cannot
be expanded without a variance; and that some cities require a CUP
in commercial districts, but allow in the industrial district.
The Director suggested that this is an opportunity to identify this
as a permitted use and add development standards; suggested re-
opening the hearing to determine the applicant's time constraints.
The Public Hearing was re-opened at 7:39 p.m.
Larry Williams, Irvine Co. stated that they would not oppose the
condition of a Conditional Use Permit for this type of use.

Mr. Williams replied that they have opportunities in the market
place for that type of property; and would like to make the use an

Commissioner Weil asked if there are other Industrial (M) Districts
that could be affected.
Staff replied that there is an area on Valencia towards Warner, an
area east of the Barn Restaurant, and near Parkway Loop on the east
side of Red Hill.
Commissioner Stracker stated that he was confident with staff's
decisions, but that these are the types of facilities that have
problems and would like the items to come before the Planning
Commission.
Commissioner Weil moved, Stracker seconded to approve the
Environmental Determination for the project by adopting Resolution
No.3090. Motion carried 4-0.

Commissioner Weil moved, Stracker seconded to recommend to the City
Council approval of Code Amendment 92-006 allowing mini warehouses
as conditionally permitted uses in the Industrial (M) District by
adopting Resolution No.3091- B, as submitted. Motion carried 4-0.
4. Code Amendment 92-007

IT HAS BEEN DETERMINED THAT THIS PROJECT WOULD NOT
HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT AND A
NEGATIVE DECLARATION HAS BEEN PREPARED.
AMEND VARIOUS SECTIONS WITHIN THE COMMERCIAL AND
INDUSTRIAL DISTRICTS OF THE CITY OF TUSTIN ZONING
CODE TO:
1. AUTHORIZE, AS A PERMITTED USE, OFF-SITE
ALCOHOLIC BEVERAGE SALES ESTABLISHMENTS WITH

15,000 SQUARE FEET.
Recommendation - It is recommended that the Planning Commission
take the following actions: 1. Approve the Environmental
Determination for the project by adopting Resolution No. 3088; and
2. Recommend to the City Council approval of Code Amendment 92-007
by adopting Resolution No. 3089, as submitted or revised.

Commissioner Baker asked if there was any further investigation
made regarding the percentage of usage.
The Director replied that the Commission could identify the
percentage of square footage that would be allowed for alcoholic
sales.
Commissioner Weil asked who was noticed and if there was any
response.
Staff replied that an eighth (1/8) page display was placed in the
newspaper only; and that no members of the public inquired.
Commissioner Stracker asked for a clarification of the ABC
requirements with a CUP application.
Staff replied that Alcoholic Beverage Control (ABC) cannot issue a
license until the City of Tustin approves the Conditional Use
Permit; that the distance requirements require so many feet be
satisfied before an application can be submitted; that a new
supermarket or one that moves cannot apply for a license if within
the restricted use areas; that the license could be transferred to
the new owner; that code requirements do not allow issuance if
distribution requirements are not met.

Commissioner Kasalek asked if there was an option to allow the
applications to be reviewed individually.
Staff replied that it could be set up as a development standard
subject to the variance process.
The Director stated that findings would have to be provided for
other than economic reasons.
Staff commented that it would also be open to the small convenience
market which staff needs discretion over.
Commissioner Weil asked the City Attorney if this proposal would
create discrimination.
John Shaw, City Attorney, stated that there would be no legal
problem due to the broad authority the courts give to creation of
zoning classifications.
Commissioner Stracker asked if this proposal would allow a store
like Liquor Barn to open.
Staff affirmed.
The Public Hearing was opened at 7:51 p.m.
Rob Balen, LSA Associates,1 Park Plaza, Irvine, representing DIHO
Market at 11112 Walnut, stated that the owners are interested in
the amendment passing so that the market can offer liquor for
outside sales; that they were informed that the previous owner took
the liquor license after they purchased the market; that the Code's
prohibitions disallowed them to appeal; that their success as a
full service market depends upon alcoholic beverage sales; that the
center relies on foot traffic and benefits from a market; that they
would be selling specialty beers and wines as well as food; that
their clientele must go to other cities; and that the Code is
overly restrictive and should be changed to reflect a more common
sense approach to alcoholic beverage sales; and that they fully
support the code amendment.
The Public Hearing was closed at 7:56 p.m.
Commissioner Weil provided a history of the ABC guidelines and took
exception to the applicant's comment that the code is outmoded.
She continued with stating that one of the reasons cited for the
Los Angeles riots was the proliferation of alcoholic beverage
stores; that she understands the size difference of small liquor
stores and larger markets; that she understands it from an economic
point of view; that she feels that the code could be adjusted to
allow equal competition among equal size businesses; that the way
the ordinance is set up, a store like Liquor Barn could open
without a protest, and must be changed.
Commissioner Baker suggested that where the primary purpose of the
store is to sell other products with a limited amount of floor area
for liquor products may be a way of conditioning the matter.
The Director stated that that was a possible approach, and
suggested continuing the item until the next meeting to allow staff
to look at existing supermarkets so as not to create non-conforming
situations; and to allow for analysis of their records.
Commissioner Stracker suggested a certain square footage with a
percentage of sales related to alcohol sales.

The Director responded that it would be difficult to monitor; and
that staff would provide information at the next meeting.
Commissioner Weil stated that City Council is in favor of making
this a workable situation; and that two (2) Council members are
willing to work with two (2) Commission members.
The Public Hearing was re-opened to continue the item at 8:03 p.m.

Commissioner Weil moved, Kasalek seconded to continue the item to
the October 12, 1992 Planning Commission meeting to allow staff the
time to research existing alcoholic beverage sales establishments.

Commissioner Kasalek asked why parking would not be assigned; and
was concerned that workers would utilize priority spaces.
Staff replied that there are so few spaces needed that they did not
want any business to monopolize a certain amount.

Tullio Vigano, 12045 Arroyo, Santa Ana, Tarbell
representing the applicant, introduced himself.

Commissioner Stracker asked who owned the property to the rear.

Staff replied that it was possibly owned by the dry cleaners.
Commissioner Baker asked for a clarification of the operatories
needed and cleaning procedures.
Mr. Vigano replied that they are requesting six (6) operatories;
and that SB198 as adopted by OSHA requires each room to be
disinfected after each use which takes approximately 30 minutes.
Commissioner Baker asked if Dr. Valdez would be the only dentist;
and noted that with six (6) operatories he would be capable of
handling three (3) dentists plus a hygienist.
The Director responded that Condition 3.4 restricts the maximum
employees to four (4) including the dentist.
Marissa Valdez, dentist's wife, 18755 Winnwood Lane, Santa Ana,
stated that the employees would be (1) full-time dentist, (1) full-
time front office person, herself, and Dr. Valdez; that he would be
the only dentist and there is no additional hygienist; and that it
was difficult to maintain the business with three (3) operatories
due to the disinfecting procedures.
Commissioner Weil noted that this was an expensive answer to the
problem of disinfecting.
Commissioner Stracker asked if Item 3.1 was reviewed regarding a
parking demand study; what would trigger a study; and what other
uses could be located in the center.
The Director replied that a parking problem affecting either the
off-site or on-site condition would trigger the study; that it
would be identified by the Public Works Department and concurred by
Community Development; and that it is a mechanism under CEQA
monitoring to impose a condition requiring it be addressed with
other alternatives.
Staff replied that it is commercially zoned allowing a variety of
retail establishments with a higher parking ratio.
The Director stated that this is an appropriate location for office
and support; that they brought in an economist for the RU/DAT
report who identified this area as transitionary support area which
should encourage uses for daytime employment providing support to
the downtown retail core.
Commissioner Kasalek asked about 20 minute curbing in the front and
if there was an option to remove if more spaces are needed.
The Director replied that limited time spaces are placed at the
request of the property owner and removal could be requested by the
property owner through the Public Works department; and that the
process requires noticing of other tenants.

Commissioner Stracker noted that the dental use would not be as
significant as other uses if the newspaper moves.
Commissioner Baker commented that hopefully the area would become
fuller, as it is so vacant.
Commissioner Kasalek was confident that the conditions would
alleviate any parking problems.

Commissioner Weil stated that she was comfortable with the
proposal; and that a customer base is needed to create retail
business in the downtown area.
Commissioner Stracker suggested that a parking demand study be made
if other uses move into the center.
Commissioner Weil moved, Kasalek seconded to adopt Resolution No.
3094 approving Conditional Use Permit 92-032 and Variance 92-007,
as submitted. Motion carried 4-0.
OLD BUSINESS:
6. Status Reports
Recommendation - Receive and file.
Commissioner Weil asked if the report included Phase I information.
Staff referred the Commissioner to Page 4.
Commissioner Baker asked the difference on Shadowbrook.
Staff replied that there is a reservation lot for drainage and a
freeway overcrossing, and a potential for 16 more units.
The subject report was received and filed.

each week.
Staff replied that the purchasers could take items upon purchase.
Commissioner Weil asked if there would be storage of non-flammable
construction equipment; and the hours of operation.
Martin Price, Elite Finish Products, applicant, replied that there
would be no finished wood; construction equipment would be saws,

wheelbarrows, etc.; hours of operation would be 7:00 a.m. to 5:00
p.m.; and that shipments are made approximately once every two
weeks, with most material being delivered to the job.
Commissioner Stracker asked about the type of trucking used for
delivery; and if it would park on-site.
Mr. Price replied that it was usually a pick-up flat bed or a
bobtail (small semi) truck; and affirmed that there is enough room
to unload at a large door at the rear of the building.
Staff pointed out the site plan and traffic flow for the
Commission.
Commissioner Stracker moved, Weil seconded to determine by Minute
Order that wholesale building product showrooms and interior
storage for construction materials/equipment should be a permitted
use within the Planned Industrial District. Motion carried 4-0.

-Inquired about the seating of a new Chairman and Vice
Chairman
Staff answered that the item would be agendized for the next
meeting.
Commissioner Kasalek
-Asked about the status of her inquiry on Walnut Street.
Commissioner Weil
-Informed staff that the parking standards are not adequate
for an area on B Street.
-Inquired about the date of receipt of a letter from an
applicant and the timing of approval.
Commissioner Stracker
-Asked about the status of the Chevron station on Nisson.
-Inquired about a property in the County area.
-Asked staff for an update on the ETC in the near future.
