HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE TUSTIN COMMUTER RAIL STATION PROJECT (CIP NO. 7138) SUMMARY Construction of the Tustin Commuter Rail Station (ClP No. 7138) has been Completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 02-32 accepting the Tustin Commuter Rail Project (CIP No. 7138) and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one-year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that 35-days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $462,856.28. This amount, together with previous contract payments and change order amounts of $4,165,706.52 represents 100% of the final contract cost. FISCAL IMPACT The final construction cost of this projeCt is $4,628,562.80. The project is funded by a combination of City Capital Improvement Program funds, State Transit Capital Improvement Program funds, State Proposition 116 funds, various Measure M Program funds, and Motor Vehicle Registration Subvention funds (AB 2766). Acceptance of Public Improvements and Authorization to File the Notice of Completion for the Tustin Commuter Rail Station Project April 1, 2002 Page 2 BACKGROUND AND DISCUSSION The construction of the Tustin Commuter Rail Station (CIP No. 7138) was completed on March 22, 2002. The City has also received notification from Metrolink that their construction items have been completed to their satisfaction. Currently, there is one outstanding construction change order for additional construction items at the station. The costs for these items have been negotiated with the Contractor and staff is preparing the change order documents for approval. These costs are included in the final contract amount shown on the previous page. The Station opened to the public for service on January 21, 2002. Since that time staff has been working with the City Attorney's Office and the Contractor to complete construction of this project and resolve outstanding payment issues. Although the final payments and change orders are still in progress, it is mutually agreed by staff and the City Attorney's Office that the Notice of Completion should be filed when construction has been completed. All of the construction work for this project has been completed to the satisfaction of the City Engineer, and is now ready for City Council acceptance. Tim D. Kasdan Engineering Services Manager Attachments: Resolution No. 02~32 Location Exhibit 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 02-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE TUSTIN COMMUTER RAIL STATION PROJECT (CIP No. 7138) WHEREAS, Urbantec Engineers, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public ~mprovement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Tustin Commuter Rail Station (CIP No. 7138) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said works and improvement described herein as required by law.
