That the Planning Commission adopt Resolution No. 4150 determining that the location,
purpose, and extent of the vacation of "Old" Del Amo Avenue between "New" Newport
Avenue and "New" Del Amo Avenue is in conformance with the Tustin General Plan.
BACKGROUND/DISCUSSION
The Newport Avenue Extension/SR-55 Ramp Reconfiguration Project (CIP No. 7130)
included reconstruction of Newport Avenue between Edinger Avenue and Valencia
Avenue, relocation of the northbound on/off ramp to SR -55, and realignment of Del Amo
Avenue (Figure 1 and Attachment A). This project is now complete.

As a result of the newly constructed improvements, the "old" Del Amo Avenue is no
longer necessary and needs to be vacated and eventually conveyed to the adjacent
property owner (Figure 2 and Attachment B). Currently the "Old" Del Amo Avenue is a
roadway easement dedicated to the City of Tustin and owned by Cate] lus/ProLogis.
Catellus/ProLogis indicated that they will quitclaim the ownership of "Old" Del Amo
Avenue to the City. The quitclaim is currently in process.

Section 65402(a) of the California Government Code (Planning and Zoning Law)
requires a general plan conformity determination from local planning agencies prior to
vacation of a street by a local agency. The City's General Plan envisions the Newport
Avenue Extension/SR-55 ramp reconfiguration and realignment of Del Amo Avenue as
shown on the Land Use Map (Figure 3 and Attachment C). The completion of this
project furthers Land Use Element Goal 11 which is to provide for the integrated
business park environment in the Pacific Center East area. The vacation on "Old" Del
Amo Avenue would create cohesive land uses within the Specific Plan area.
Figure 3
Pursuant to Section 65402 (a) of the Government Code, the Planning Commission is
authorized to determine whether the location, purpose, and extent of the proposed
vacation is consistent with the General Plan. Based upon the City's adopted Land Use
Element, the location, purpose, and extent of the proposed vacation of "Old" Del Amo
Avenue is in conformance with the approved General Plan. Accordingly, staff
recommends that the Planning Commission adopt Resolution No. 4150.
