A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN MAKING CHANGES IN THE AMOUNTS OF
CERTAIN ASSESSMENTS IN THE CITY OF TUSTIN
REASSESSMENT DISTRICT NO. 95-2 (TUSTIN RANG
AND MODIFYING THE REASSESSMENT REPORT
THEREFOR
WHEREAS, the City Council (the "City Council") of the City of Tustin (the "City"),
pursuant to the Municipal Improvement Act of 1913 (Division 12 of the California Streets and
Highways Code) (the "Act"), by Resolution No. 86-81 adopted on June 16, 1986, resolved its
intention to form City of Tustin Assessment District No. 85-1 ("District 85-1") and to issue bonds
to represent unpaid assessments therein;
WHEREAS, the City Council, by Resolution No. 86-81, adopted on June 16, 1986,
confirmed said assessments;
WHEREAS, the City Council, pursuant to the Act, by Resolution No. 88-61, adopted on
June 13, 1988, resolved its intention to form City of Tustin Assessment District No. 86-2
("District 86-2") and to issue bonds to represent unpaid assessments therein;
WHEREAS, the City Council, by Resolution No. 88-81, adopted on July 18, 1988,
confirmed said assessments;
WHEREAS, the City Council, by Resolution No. 95-118, adopted on November 20,
1995 (the "Resolution of Intention"), conducted reassessment and refunding proceedings under
the Refunding Act of 1984 for 1915 Improvement Act Bonds (Division 11.5 of the California
Streets and Highways Code) for the City's Reassessment District 95-2 (Tustin Ranch) (the
"Reassessment District");
WHEREAS, the City Council, pursuant to Resolution No. 96-10, adopted on January 15,
1996, adopted and approved the reassessment report for the Reassessment District, dated
January 15, 1996 (the "Original Report"), and levied on the property within the Reassessment
District the reassessments (the "Reassessments") as specified therein;
WHEREAS, Sections 10350 through 10352 of the Act provide that, with respect to any
assessment district established pursuant to the Act, at any time after improvements are ordered
and during the pendency of the proceedings with respect thereto, the legislative body may make
changes in the assessment (including the amounts of any of the individual assessments in the
assessment district), which changes do not increase the total amount of the assessment or which
changes provide for the elimination or addition of work or substitutions therein, though they
result in an increase in some assessments, provided that the owners of the property affected
request in writing that the changes in the work and in the assessments be made;

WHEREAS, the Reassessment District encompasses portions of both District 85-1 and
District 86-2 and the proceedings with respect thereto have not been completed;
WHEREAS, the actual and planned development in portions of the Reassessment District
is different than that contemplated at the time the Reassessments were confirmed;
WHEREAS, the owners of certain parcels of property in the District have requested in
writing that, in order to better reflect the benefits received by such parcels, taking into account the
current development plans with respect thereto, the Reassessments on certain of said parcels be
increased and the Reassessments on certain other of said parcels be correspondingly decreased;
WHEREAS, there has been prepared, filed and presented to this meeting a supplemental
report (the "Supplemental Report"), which modifies the Original Report;
WHEREAS, the Supplemental Report reapportions the Reassessments on such parcels in
accordance with said written request of the owners thereof; and
WHEREAS, the City Council desires to modify the Original Report by adopting the
Supplemental Report;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THE CITY
OF TUSTIN, as follows:
Section 1. The Supplemental Report is hereby approved and adopted, and the Original
Report, including the reassessment diagram and the reassessment contained therein, is hereby
modified in accordance with the provisions of the Supplemental Report. The Original Report, as
modified by the Supplemental Report, shall stand for all subsequent proceedings under and
pursuant to the Resolution of Intention.
Section 2. The officers and employees of the City are, and each of them hereby is,
authorized and directed to execute and deliver any and all documents and instruments and to do
and cause to be done any and all acts and things necessary or proper to accomplish the purposes
of this Resolution.
Section 3. All actions heretofore taken by the officers and employees of the City in
connection with or related to the actions contemplated by this Resolution, are hereby approved,
confirmed and ratified.
Section 4. This Resolution shall take effect immediately upon its adoption.

Reassessment District No. 95-2 (Tustin Ranch)
Overview
The City of Tustin, Reassessment District No. 95-2 (Tustin Ranch) consists of the original
variable rate Assessment Districts No. 85-1 and 86-2 consolidated into one new variable rate
Reassessment District.
In February 1996, the Tustin Public Financing Authority issued Revenue bonds to purchase
the Reassessment District No. 95-2 (Tustin Ranch) Refunding Bonds. For further
information on these bonds see the Tustin Public Financing Authority Revenue Bonds
Indenture of Trust.
Sections 10350 through 10352 of the California Streets and Highways Code allow the
legislative body to make changes to assessments, including the amounts of individual
assessments in the assessment district , as long as the changes do not increase the total
amount of assessments for the district. Additionally the affected property owners must
request in writing that changes in the work and assessments be made. This revised report
has been prepared at the request of the affected property owners, in order to change the
individual assessments due to zoning and land use changes that have take place within the
district.

Reassessment
WHEREAS, on November 20, 1995, the City Council of the City of Tustin, California,
pursuant to the provisions of the Refunding Act of 1984 for 1915 Improvement Act Bonds
(the "Act"), .adopted its Resolution of Intention No. 95-115 for the Reassessment of the
real property within the boundaries of the City's Reassessment District No. 95-2 (Tustin
Ranch) (the "District") and for the refunding of the outstanding principal amounts of
certain improvement bonds of the City, all as more particularly described in the
Resolution of Intention (the "Prior Bonds"), and to pay the costs of said reassessment
refunding;
WHEREAS, said Resolution directed the undersigned to make and file a report
presenting a schedule setting forth the unpaid principal and interest of the Prior Bonds to
be refunded and the total amounts thereof, the total estimated principal amount of the
reassessment and of the refunding bonds and the maximum interest thereon, together with
an estimate of the cost of the reassessment and of issuing the refunding bonds, the auditor's
record showing the schedule of principal installments and interest on all unpaid original
assessments and the total amounts thereof, the estimated amount of each reassessment,
identified by reassessment number corresponding to the reassessment number of the
_ reassessment diagram, together with a proposed auditor's record for the reassessment, and
reassessment diagram showing the assessment district and the boundaries and dimensions
of the subdivisions of land within the district. Each subdivision, including each separate
~__ condominium interest as defined in Section 783 of the Civil Code, shall be given a separate
number upon the diagram to which Resolution reference is hereby made for further
particulars;

WHEREAS, the Supplemental Report reapportions the Reassessments on such parcels in
accordance with said written request of the owners thereof;
NOW THEREFORE, the undersigned, by virtue of the power vested in me under the
Act and the order of the Council of said City, hereby makes the following changes to
assessments to cover the portion of the estimated cost of said acquisitions, work and
improvements and the costs and expenses incidental thereto to be paid by the assessment
district.
The amount to be paid for said refunding, together with the expenses incidental thereto,
and the reassessment balance are set forth herein.
And I do hereby reassess and apportion said portion of said total amount of the cost and
expenses of said reassessment and refunding upon the several lots, pieces or parcels or
portions of lots or subdivisions of land liable therefor and benefited thereby, and
hereinafter numbered to correspond with the numbers upon the attached diagram, upon
each, severally and respectively, in accordance with the benefits to be received by such
subdivisions, respectively, from the acquisitions and improvements, and more particularly
set forth in the list hereto attached and by reference made a part hereof.
As required by the Act, a diagram hereto attached showing the reassessment district and
also the boundaries and dimension of the respective subdivisions of land within said
reassessment district as the same existed at the time of the passage of said Resolution, each
of which subdivisions having been given a separate number upon said diagram.
Said reassessment is made upon the several subdivisions of land within said assessment
district in proportion to the unpaid principal amount of the original assessment recorded
as a lien against each said subdivisions of land. The diagram and reassessment numbers
appearing herein are the diagram numbers appearing on said diagram, to which reference is
hereby made for a more particular description of said property.
Each subdivision of land reassessed is described in the reassessment list by reference to its
parcel number as shown on the Assessor's Maps of the County of Orange for the fiscal year
1995-1996 and includes all of such parcel. For a more particular description of said property,

County Recorder of said County.

Tustin Reassessment District No. 95-2 (Tustin Ranch), on file in the office of the City

rated basis.

Method of Reassessment
Each Reassessment has been computed as a proration of the existing individual assessments
to the total existing assessment. As requested by the property owners and directed by the
legislative bond, in order to better reflect the benefits received by such parcels, taking into
account the current development plans with respect thereto, the Reassessments on certain
of the said parcels have been increased and the Reassessments on certain other of said
parcel have correspondingly been decreased.
The calculated reassessment assumes that the maximum amount of authorized bonds are
sold. The maximum amount of authorized bonds includes the potential sale of
