Binsack, Zoning Administrator Doug Holland, City Attorney Christine Shingleton, Assistant City Manager Dana Ogdon, Assistant Community Development Director Doug Anderson, Transportation/Development Services Manager Edmelynne Huffer, Associate Planner Eloise Harris, Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC MEETING: 1. CONCEPT PLAN 09-001 - a request for approval of the Phase 3A Concept Plan, a concept plan encompassing Sub-Planning Areas 1-A and 1-E, approximately twenty-eight actress, of the Advanced Technology. & Education Park at the Tustin Legacy with the potential development of 305,000 square feet of educational use. APPLICANT/ PROPERTY OWNER: GARY POERTNER SOUTH ORANGE COUNTY COMMUNITY COLLEGE DISTRICT LOCATION: MCAS TUSTIN SPECIFIC PLAN: PORTION OF PLANNING AREA 1-A AND 1-E, TUSTIN, CA 92782 ENVIRONMENTAL STATUS: ON JANUARY 16, 2001, THE CITY OF TUSTIN CERTIFIED THE PROGRAM FINAL ENVIRONMENTAL IMPACT STATEMENT/ ENVIRONMENTAL IMPACT REPORT (FEIS/EIR) FOR THE REUSE AND DISPOSAL OF MCAS TUSTIN. ON APRIL 3, 2006, THE CITY COUNCIL ADOPTED RESOLUTION NO. 06-43 Zoning Administrator Agenda July 26, 2010 Page 2 APPROVING AN ADDENDUM TO THE FEIS/EIR. THE PROPOSED PROJECT IS CONSISTENT WITH THE MCAS TUSTIN SPECIFIC PLAN AND IS DETERMINED NOT TO RESULT IN ANY NEW SIGNIFICANT ENVIRONMENTAL IMPACTS, PROPOSE SUBSTANTIAL CHANGES OR A SUBSTANTIAL INCREASE IN THE SEVERITY OF ANY PREVIOUSLY IDENTIFIED SIGNIFICANT IMPACTS IN THE FEIS/EIR AND ADDENDUM. MOREOVER, NO NEW INFORMATION OF SUBSTANTIAL IMPORTANCE HAS SURFACED SINCE CERTIFICATION OF THE FEIS/EIR AND ADDENDUM. THE ZONING ADMINISTRATOR HAS ALSO REVIEWED AND CONSIDERED THE ADDENDUM TO THE FEIS/EIR ADOPTED BY SOCCCD ON MARCH 24, 2009. THE ADDENDUM SUPPORTS THE DETERMINATION THAT THE PROPOSED PROJECT WILL NOT RESULT IN ANY NEW SIGNIFICANT ENVIRONMENTAL IMPACTS OR PROPOSES SUBSTANTIAL CHANGES OR INCREASES IN THE SEVERITY OF ANY PREVIOUSLY IDENTIFIED SIGNIFICANT IMPACTS IN THE FEIS/EIR. RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action No. 10-002 approving Concept Plan 09-001. Presentation: Dana Ogdon, Assistant Director of Community Development The Zoning Administrator opened the meeting, reviewed the process, and requested a staff report from the Assistant Director. Dana Ogdon reviewed the staff report, indicating that Condition 1.1 had been modified to allow more flexibility regarding the actual development of the site. The Zoning Administrator asked if that modification was intended to provide flexibility regarding possible future requests for amendments to the approval. Mr. Ogdon answered in the affirmative. The Public Hearing opened at 10:42 a.m. Randy Pebbles, ATEP Provost, spoke on behalf of the College District, including the following from the Acting Chancellor's letter dated July 26, 2010. "The City's approval today is an important and critical step in the development of the ATEP Campus and will demonstrate the City's support and desire for this Zoning Administrator Agenda July 26, 2010 Page 3 Campus to be successful. We look forward to jointly celebrating the groundbreaking of our new facilities, and having the City by our side on this important occasion." Jeremy Krout, architect/consultant, indicated he was available to answer any questions. There were no questions. The Zoning Administrator approved Zoning Administrator Action No. 10-002 approving Concept Plan 09-001. The Zoning Administrator explained that this item may be appealed to the Planning Commission within 10 calendar days. If there are no appeals, this action becomes final. REGULAR BUSINESS: None ADJOURNMENT: The Public Hearing closed and the meeting adjourned at 10:46 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
