EXTENSION OF A TEMPORARY USE PERMIT FOR A TEMPORARY

Recommendation - It is recommended that the Planning Commission
approve an extension of Temporary Use Permit 92-004 by Minute
Order, subject to the conditions contained in Exhibit A.

Commissioner Le Jeune moved, Weil seconded to approve an extension
of Temporary Use Permit 92-004 by Minute Order, subject to the
conditions contained in Exhibit A revised as follows:
Item 1, delete "six (6) months from the expiration of Temporary Use
Permit 92-004" and insert "March 24, 1993." Motion carried 5-0.
4. Variance 92-005

approve Variance 92-005 by adopting Resolution No. 3068, as
submitted or revised.

Commissioner Kasparian asked where the house would be identified as
a Cultural Resource (CR); if other buildings on the property were
included; how long the CR designation remains with the house; that
the designation was a key to allowing the house to move in; the
address of the new building; if it was allowed to be sold
separately; and that he understood that this information may not be
germane to the height, but it might influence his decision.
Staff replied that it was part of the Cultural Overlay; that other
buildings would not necessarily be included; that this house would
not necessarily be formally designated as a contributing structure
to the CR District; that the survey would have to be revised to
indicate that the house was moved into the district; that Public
Works would provide an address; that it cannot be sold separately;
The Public Hearing was opened at 7:14 p.m.
Bill Collins, 430 W. Main Street, stated that he still opposes the
new building which is still too close to his property and the
street; that newer houses were used to compare the setbacks; that
it should not be considered part of the Cultural Resource District
since it is not an original part of Tustin; that other neighbors
are also protesting.
Winston Jewson, 17662 Sherbrook Drive, Tustin, stated that he did
not know the issue, but would like the matter delayed for more
input.
Brian Barrinqton, 415 W. Main Street, objected to how easily this
project was approved without sufficient information, since other
neighbors have had much more difficulty; and that he hoped he would
be given the same consideration for his home; and that they were
now protesting the matter of approval for those in the system
versus those who are not.
Commissioner Weil asked if the railing at the top of the roof was
creating the need for a variance.
Commissioner Kasparian asked if there was access to the railing.
David Parker, project architect, stated that without the railing
the building would still be 2 feet 8 inches too high.; that the
railing is ornamental, without access, and typical of that type of
house.
Commissioner Le Jeune, 440 W. Main, applicant, stated that the
height variance is necessary due to the construction of the
building; and that he could put it on a concrete slab which would
be three feet lower, but this type of house would not have been
built that way.
Commissioner Kasparian asked if the house was the same height when
in Orange.
Commissioner Le Jeune affirmed.
Commissioner Baker asked how long project completion would take.
Commissioner Le Jeune replied that the foundation would be
installed in late October and the outside of the house finished in
March; and that they will paint and landscape the outside first.

Commissioner Kasalek stated that she noticed a variety of setbacks
and heights upon viewing the neighborhood; and that since the
majority of the properties are similar to this, it would be an
asset to the neighborhood.
Commissioner Weil stated that it was an appropriate place for the
house; that the Cultural Resource District was created to preserve
houses like this; that lowering the height would destroy the
integrity. She also noted that people in the system do not get
preferential treatment, they have the advantage of knowing how it
operates; that the information is available to everyone; and that
other projects would go through seemingly smoother, also, if
applicants availed themselves of the information ahead of time.
Commissioner Kasparian stated that it was irrelevant that the house
was not from Tustin; that the height variance was not a problem;
that since the other house was set so far back, the new house would
look like the first house; that the height would be lost when
installed and will not detract from other heights; and that no
special consideration has been given.
Commissioner Baker stated that it would be nice to have something
put on the front of that lot since the current house can hardly be
seen; and that it would hopefully be an asset.
Commissioner Kasparian moved, Kasalek seconded to approve Variance
92-005 by adopting Resolution No. 3068 revised as follows:
Change all instances of "24 feet, 6 inches" to "25 feet, 2 inches"
Change all instances of "23 feet" to "23 feet, 8 inches"
Page 2, Item d.: change the average height from "19 feet, 6
inches" to "19 feet, 4 inches". Change the percentage of roof
structure over 20 feet from "25 percent" to "26 percent"
Part I, Section d, line 12 change the percentage of roof structure
below 20 feet from "75 percent" to "74 percent"
Motion carried 4-0. Commissioner Le Jeune abstained.
5. Conditional Use Permit 92-029 And Design Review 92-037

IS REQUIRED.
AUTHORIZATION TO CONSTRUCT A NEW 16,000 SQUARE FOOT
GYMNASIUM AND RELATED SITE IMPROVEMENTS.
Recommendation - It is recommended that the Planning Commission
take the following actions:l.Approve the Environmental
Determination for the project by adopting Resolution No. 3073; and,
2.Approve Conditional Use Permit 92-029 and recommend to the

Redevelopment Agency approval of Design Review 92-037 by adopting
Resolution No. 3074, as submitted or revised.

Commissioner Kasparian asked the height of the building.
Staff replied that it was approximately 36 feet.
Commissioner Weil asked if there was any response to notice; and
asked for clarification of Item E2 on Page 2 of Exhibit A.
Staff replied that they received a reply expressing support; and
that E2 was a standard Fire Department requirement.
The Public Hearing was opened at 7:36 p.m.
Commissioner Kasparian asked how the structure would be policed.
Ed Elowe, architect and project manager, replied that the park
would be illuminated, the building would be accessible from 3
sides, and be able to be driven all around for security; that the
Police Department required the berms to be of limited height for
visibility; that there will be no dark spots, and no seating around
the back of the building; that there will be benches near the
parking lot; that the Police Department has not yet detailed the
plans, but conforms to the master plan for security.
The Public Hearing was closed at 7:40 p.m.
Commissioner Weil asked if she could vote since she was part of the
original task force.
John Shaw, City Attorney, affirmed.
Commissioner Weil moved, Le Jeune seconded to approve the
Environmental Determination for the project by adopting Resolution
No. 3073 as submitted. Motion carried 5-0.
Commissioner Weil moved, Le Jeune seconded to approve Conditional
Use Permit 92-029 and recommend to the Redevelopment Agency
approval of Design Review 92-037 by adopting Resolution No. 3074 as
submitted. Motion carried 5-0.

RED HILL AVENUE HAS NOT BEEN ABANDONED
Recommendation - It is recommended that the Planning Commission
adopt Resolution No. 3076 instructing staff to defer enforcement of
the City's Sign Code for 13922 Red Hill Avenue until August 9,
1993.

Commissioner Weil stated that an excellent job was done by staff.
Commissioner Weil moved, Kasparian seconded to adopt Resolution No.
3076 instructing staff to defer enforcement of the City's Sign Code
for 13922 Red Hill Avenue until August 9, 1993. Motion carried 5-
9.
7. Status Reports
A discussion was held regarding a Planning Commissioner being
included in the Design Review phase.

NEW BUSINESS:
8. Sidewalks In Industrial Areas
A discussion was held regarding the options proposed by the
City Council. The general opinion of the Planning Commission
was to install all sidewalks at once by supporting an
assessment district.
Requested that staff inform City Council that the Planning
Commission supports the concept of establishing Assessment
Districts for the installation of sidewalks in industrial
areas.
9. Commission Term Limitation
The Planning Commission discussed the merits and negative
aspects of term limitations.
Planning Commission unanimously decided to recommend to City
Council limitation of commission terms to six years (three 2-
year terms) with reappointment possible after a two year
period.
10.
Redevelopment Housing Set-Aside Workshop -September 8, 1992 at
5:30 p.m.
Jim Kane, Chairman of Parks and Recreation Committee, stated that
the community park was for organized sports, was 19 1/2 acres, had
extensive parking and lighted fields.
Commission was informed of subject workshop.

-Requested that Edinger Avenue - Super Street Rail Station be
agendized for the September 14th meeting.
Commissioner Le Jeune
-Requested that staff look at code enforcement on vacant lots
more frequently.
ADJOURNMENT:
Commissioner Weil moved, Le Jeune seconded to adjourn the meeting
at 8:28 p.m. Motion carried 5-0.
The next regular meeting of the Planning Commission is on September
14, 1992 at 7:00 p.m. in the City Council Chambers, Tustin Senior
Center, Tustin.
