Presentation: Becky Stone, Assistant Planner Commissioner Kasparian asked for a clarification of who was required to sign the dedication; and suggested that line 2 of page 6 of the staff report should indicate Condition 2.1. Staff replied that the landowner makes the agreement as required by the Conditions of Approval; and changed the staff report as recommended. Commissioner Kasparian suggested moving the handicapped ramp for better visibility. Staff replied that this complies with Condition 3.2 and will comply with Public Works. The Director added that there are specific standards relating to the location of the handicapped ramps; and that modifications must be consistent with the standards set by the State. The Public Hearing was opened at 7:11 p.m. Nathan Lujan, 1020 Iowa Avenue, Riverside, J.J.C. Construction representing the applicant, stated that they were willing to comply with the requirements, but asked for a clarification of the ten (10) foot dedication. The Director replied that this was not a dedication document, but an offer to dedicate; that it will not affect the existing business. The Public Hearing was closed at 7:15 p.m. Commissioner Kasalek stated that the changes were good and the site needed improvement. Commissioner Weil assured the applicant that dedication was required of all new construction. The Director provided language to modify Condition 3.3, as moved. Commissioner Le Jeune moved, Weil seconded to approve Conditional Use Permit 92-009 by adopting Resolution No. 3046, revised as follows: Exhibit A, add sentence to end of item #3.3: "A modified handicap ramp shall be constructed consistent with current Public Works right-of-way standards and all American Disability Act requirements." Commissioner Kasparian asked for clarification of Item 1.3 Exhibit A. of Staff replied that it referred to a security fence which was currently in place; and that it could be considered a construction fence if construction started within 24 months. The Public Hearing was opened at 7:21 p.m. The Public Hearing was closed at 7:22 p.m. Commissioner Le Jeune moved, Kasparian seconded to approve Conditional Use Permit 92-021 by adopting Resolution No. 3042, revised as follow: Resolution No.3042, page 1, item I.C.2. delete the words "on the" in the first sentence. Motion carried 5-0. 4. Design Review 92-018 APPLICANT/ LANDOWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: THE IRVINE COMPANY P.O. Approve the Environmental Determination for the project by adopting Resolution No. 3043; 2. Approve Design Review 92-018 by adopting Resolution No. 3044, as submitted or revised. Presentation: Paula Rankin, Associate Planner Staff received consensus to keep the issues regarding building plan and sign plan separate. Commissioner Weil asked if there was any further response to notice. Staff replied negatively; and proposed a change to Item 3.6 of Page 4 of Resolution No. 3044, as moved. Commissioner Kasparian asked if the drawings provided were an exact replication; if there was provision for a signal on Bryan Avenue; and if sidewalks were to be installed along the perimeter. Staff replied that the drawings were developed as a phasing plan and were supplied to orientate the Commission; that a signal is on the Tract Map; and that sidewalks would be provided. The Public Hearing was opened at 7:32 p.m. Clarence W. Barker, Vice President for Irvine Company, introduced himself and the project team. Michael McDaniel, K-Mart Corporation, stated that the Tustin store was the result of a significant amount of work over ten (10) years; that they have an excellent credit history; that their image has become tainted; and that this store will bring an upgraded exterior. Greg Simonoff, Gregory Simonoff Architects, stated that they created the project to fit in with the center and environment; that the color scheme is responsive to the neighborhoods; and that they brought down the scale of the building. Commissioner Kasparian asked for a clarification of the tall trees shown on the drawing. Mr. Barker stated that those trees are 25 feet high and are located at the Market Place. Commissioner Le Jeune asked about the stairway at the corner indicated on the drawing. Mr. Simonoff replied that it was the employee access to the garden shop; and suggested providing a low concrete masonry wall to conceal carts in a staging area located outside the building. Commissioner Le Jeune asked how many carts would be located outside during the day. Mr. McDaniel stated that there would be about 150 carts maximum. Staff provided language to Item 5.4 of Exhibit A of Resolution No. 3044, and added Item 3.13, as moved. Mr. Barker stated that an eight (8) foot wall around the center was inappropriate; that the approved landscape plan was for 26 trees and they are providing 46; that foliage will provide a screen. Planning Commission Minutes June 8, 1992 Page 5 Sandy Wollanqk, 13440 Via Alicante, Board of Directors Sevilla Homeowners Association, stated that she echoed Mrs. Nichols concerns; and that their association would like the same screening considerations for Bryan Avenue. Mr. Barker stated that the landscaping is very dense on the project; that the City required 14 and that they would provide 26, not counting the field of trees in the parking lot; that the distance from the nearest residence is 660 feet. Commissioner Baker asked the type of trees on Bryan; and about the trees in the median. The Director affirmed that there are trees in the median that are placed to maintenance capability; and that there is a median modification in conjunction with the signal. Mr. Barker replied that there was a mix of olive, eucalyptus, and pine trees. Commissioner Le Jeune asked how many trees would be on Bryan. Mr. Barker replied that there were at least 25 trees on Bryan, but did not have the working drawings present. The Director stated that it was comparable to the E1 Camino elevation; that the northerly side of the project is adjacent to the pad buildings and there will be parking lot trees as a screen. Commissioner Baker asked how tall the parking lot trees were. Mr. Barker replied that they would not be tall; and were not intended to be 28 feet tall. Commissioner Kasalek suggested planting more trees residents' side of the street to increase the screening. on the The Director stated that not all of the trees were planted at one time so that they would mature separately; that rapid growing trees were encouraged; that she was confident that the trees, shrubs and 36-inch berms would provide a screen; that buffering of the "K" is not a reasonable expectation of the landscaping; and that these conditions cannot be imposed on the sign plan. Commissioner Weil stated that they had the same concerns with the size of the plantings at the Market Place; that what the applicant has provided would be adequate; and that the community needs to be patient as the plantings grow rapidly. Commissioner Baker asked how tall the eucalyptus trees were; and if there was to be a gas station on the corner. The Director replied that the trees are about 25 feet tall; and that the gas station would be located at Bryan and Myford, not in this center. Commissioner Kasalek asked if the City would be willing to provide trees on the residents' side of the street if there was a continued problem with screening. The Director replied that all improvements are done within the assessment/maintenance district; that if the installation was inadequate, there could be a modification of the subdivision map initiated by the City with the Irvine Company; and that the City would be willing to work with the residents. Planning Commission Minutes June 8, 1992 Page 6 Commissioner Baker stated that it has been just recently that the Market Place has grown enough to provide screening. Commissioner Weil stated that there is a screening problem within the City; and that it was time for people to take responsibility for screening upon themselves. Mrs. Wollanqk stated that the Market Place, in comparison to this project, did not open out towards the residents; and that their only leverage was to provide additional landscaping. Marqaret Cunninqham, homeowner, was concerned about the number of trees, thought the gas station was canceled, and was concerned with the additional traffic; and asked if Bryan was a major entrance to the center. Commissioner Baker noted that there is an overall increase in traffic from the south. The Director replied that there are two major entrances on Bryan and E1 Camino, as well as secondary entrances; that there was a comprehensive traffic study which was completed estimating the number of vehicles and imposed mitigating conditions; and that Bryan Avenue would be fully signalled. Commissioner Le Jeune informed Ms. Cunningham that the original plan was to accommodate a hotel and retail. The Public Hearing was closed at 8:40 p.m. Commissioner Weil stated that sensitivity has been shown by the applicant by expansion of the landscaping; and that it would be more than adequate in time. Commissioner Kasparian stated that the landscaping being provided would provide sufficient screening; and recommended patience on the part of the residents. Commissioner Le Jeune did not agree that the best possible job was done at the Market Place in regards to landscaping; and that Mrs. Nichols did an excellent job. Commissioner Kasalek was impressed with K-Mart's sensitivity; and that the landscaping was more than adequate. Commissioner Baker was pleased with the efforts made here. Commissioner Kasparian moved, Weil seconded to approve the Environmental Determination for the project by adopting Resolution No. 3043. Motion carried 5-0. Commissioner Weil moved, Kasalek seconded to approve Design Review 92-018 by adopting Resolution No. 3044, revised as follows: Exhibit A, change: Last sentence in item #3.6 to read: "Prior to issuance of building permits, a photometric study will be required to ensure that no direct light rays extend beyond the site boundaries." Add a new item #3.13 "A wall, adequate in height to screen the cart staging area, shall be provided parallel to the main building wall and outside of the pedestrian walkway. The specific height, location and design of the wall shall be subject to review and approval of the Community Development Department." Conditional Use Permit 92-013 APPLICANT/ OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: THE IRVINE COMPANY 500 NEWPORT CENTER DRIVE P.O. BOX 1 NEWPORT BEACH, CA 92658-8904 SITE BOUNDED BY EL CAMINO REAL, TUSTIN RANCH ROAD, BRYAN AVENUE AND MYFORD ROAD MIXED USE - EAST TUSTIN SPECIFIC PLAN THE PROJECT IS CATEGORICALLY EXEMPT (CLASS 11) PURSUANT TO SECTION 15311(A) OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) APPROVAL OF CONDITIONAL USE PERMIT 92-013 TO ALLOW A MASTER SIGN PLAN FOR THE TUSTIN ANNEX (ANNEX TO THE TUSTIN MARKET PLACE) Recommendation - It is recommended that the Planning Commission approve the Master Sign Plan for the Tustin Annex (annex to the Tustin Market Place) by adopting Resolution No. 3047, as submitted or revised. Presentation: Paula Rankin, Associate Planner Commissioner Le Jeune asked if the arcade signs were allowed to be lighted. Staff affirmed, and noted that few retailers have chosen to use arcade signs. Commissioner Kasparian noted that some signs exceeded sign code requirements. Staff replied that the scale and size of the building warranted the exceptions; and that their master plan is more stringent. Commissioner Kasalek asked if graphics were allowed as in the Entertainment Village; and noted that there was no listing of the colors in the sign plan. Staff replied that the provisions and standards are similar; that there is an amended sign plan for the entire center; and that the sign plan document might not be the best place, as modification to building colors would require modification of the sign plan. The Public Hearing was opened at 8:53 p.m. Clarence Barker, Vice President of Irvine Company, noted that a 14- foot sign has been requested for E1 Camino and Tustin Ranch Road for direction and to announce entrance to the Market Place; that the other monument signs were reduced to seven (7) feet and limited in number; that they were concerned with the "K" sign; that the center was a transition site to the residences. He then continued with a slide presentation of the Riverside location to show the comparison of day and nighttime viewings of the sign at different distances. He also indicated that the lighting would illuminate the sign only, not the building, and would be turned off within 30 minutes after closing. Planning Commission Minutes June 8, 1992 Page 8 Commissioner Le Jeune asked if the presentation showed limited plantings. Mr. Barker affirmed. Commissioner Kasparian asked about the glare from the pole lights. Mr. Barker replied that the heights are lower than in the slides, would be about 25 feet and would have a different hood. Commissioner Le Jeune asked about security lights in the evening. The Director replied that the Uniform Security Ordinance requires one (1) foot candle of light in any portion of the parking lot. Michael McDaniel, K-Mart Corporation, stated that they could not reduce the size of the "K" sign without chairman's approval, since it has been drastically reduced from the original; that the sign is very small compared to the size of the building. Commissioner Kasalek asked about an inquiry from a resident regarding a monument sign as an alternative. Mr. McDaniel replied that it has been attempted unsuccessfully. Sandy Wollanqk, Sevilla Homeowners Association, asked which color represented the "K" background. Mr. McDaniel indicated the color on the color board as red. Cheryl Bell, 2346 Aspen Street, President Sycamore Glen Homeowners Association, thanked the Irvine Company for working with the residents; inquired of banners and pad signs; noted that more vibrant colors for signage were being proposed; that monument signs were appealing; and asked why the sign at E1 Camino Real and Tustin Ranch Road would be so high. Commissioner Le Jeune noted that accent banners were permitted under the sign code. The Director replied that they were considered theme banners and were different from temporary banners; that they could be colored and decorative, but without advertising; that the pad signs could have corporate image or logo. Mr. Barker stated that the intent of the banners was to tie the two centers together; and that the banners were restricted to the main flow areas in front of K-Mart and Costco. Staff stated that the description of the banners would have to be approved by the City; that page 14 of the sign plan has a site map with theme banner placement along the main drive; and only for major tenants, K-Mart and Costco. Commissioner Kasalek asked if the temporary banners would be increased to 64-square feet; and if it was due to the size of the center. Staff affirmed that one would be allowed per street front. The Public Hearing was closed at 9:20 p.m. Commissioner Le Jeune stated that it was a comprehensive package in which a lot of work was put into. Planning Commission Minutes June 8, 1992 Page 9 Commissioner Kasalek was convinced by the slides that the "K" would be a reasonable size and will not be offensive to neighbors. Commissioner Weil thanked the Irvine Company and K-Mart for their cooperation in the project; and that they have shown patience and listened to the Community. Commissioner Kasparian stated that it was a reflection on the Irvine Company and K-Mart that they were able to bring this package to a point where there was virtually no opposition from the neighbors; that the sign package and the trade-off's were well done. Commissioner Baker stated that he was looking forward to seeing the center in effect. Mr. Barker thanked the staff and the Commission for their hard work. Commissioner Kasalek moved, Le Jeune seconded to approve the Master Sign Plan for the Tustin Annex (annex to the Tustin Market Place by adopting Resolution No. 3047. Motion carried 5-0. OLD BUSINESS: NEW BUSINESS: 6. Sign Code Exception 92-001 APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: WILLIAM DAY 650 BUTTONBUSH TRAIL ORANGE, CALIFORNIA 92669 BRUCE JOHNSONBAUGH 13871 RED HILL AVENUE TUSTIN, CALIFORNIA 92680 13871 RED HILL AVENUE, TUSTIN C-2 (CENTRAL COMMERCIAL DISTRICT) THIS PROJECT HAS BEEN CATEGORICALLY EXEMPT (CLASS PROVISIONS OF SECTION 15311 ENVIRONMENTAL QUALITY ACT AUTHORIZATION TO VARY FROM 9408(F) (1) (a) WHICH REQUIRES DETERMINED TO BE 11) PURSUANT TO OF THE CALIFORNIA SIGN CODE SECTION A MINIMUM OF 150- LINEAL FEET OF STREET FRONTAGE TO ALLOW CONSTRUCTION OF A MONUMENT SIGN ON A PROPERTY WHICH HAS 105-LINEAL FEET OF STREET FRONTAGE LOCATED AT 13871 RED HILL AVENUE Recommendation - It is recommended that the Planning Commission approve Sign Code Exception 92-001 by adopting Resolution No. 3045, as submitted or revised. Presentation: Becky Stone, Assistant Planner Commissioner Weil asked if there was a precedent being set with the short frontage; and if it was similar to the Car Wash/Auto Center on First Street. Staff replied negatively, that there was only one (1) property. The Director stated that the First Street business signs were allowed prior to new sign code; that this is a different, unusual circumstance; and that they would prefer to replace the non- conforming sign. Motion carried 5-0. STAFF CONCERNS: 7. Report on actions taken at June 1, 1992 City Council meetinq Staff reported ion the subject agenda. Commissioner Le Jeune asked if property rights were protected under the Granny House Provision regarding rooster location. The Director stated that a Granny House would take precedence; and that it was enforced by complaint. COMMISSION CONCERNS: Commissioner Le Jeune -Commented on Chili cook-off. Good turn-out next year. Consider emphasis on beer signs. Commissioner Kasalek -Thanked staff on undergrounding information. Asked what criteria staff uses for prioritizing. -Petition to close La Colina before Tustin Ranch. Asked if County goes to Tustin with a potential problem. Staff responded has only heard rumors regarding petition. -Peppertree Homeowners Association won awards at Chili Cook- off. Commissioner Baker -Thanked and complimented staff regarding K-Mart project. ADJOURNMENT: Commissioner Le Jeune moved, Weil seconded to adjourn the meeting at 9:47 p.m. Motion carried 5-0.
