AUTHORIZATION OF A PINK COLORED AWNING TO REPLACE A PREVIOUSLY EXISTING TURQUOISE COLORED AWNING. Recommendation - It is recommended that the Planning Commission adopt Resolution No. 2858 authorizing an existing installation of a pink-colored awning at 1571 E1 Camino Real replacing a previously existing turquoise colored awning. Presentation: Anne E. Bonner, Assistant Planner Commissioner Baker moved, Le Jeune seconded to approve consent calendar as submitted. Motion carried 4-0. PUBLIC HEARINGS: 3. Temporary Use Permit 90-4 APPLICANT: CHEVRON U.S.A., INC. 1300 BEACH BOULEVARD LA HABRA, CA 90632 Planning Commission Minutes December 10, 1990 Page 2 OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: MARY J. WILDE 1943 E. 17TH STREET SANTA ANA, CA 92701 17241 17TH STREET C-1 - RETAIL COMMERCIAL DISTRICT CATEGORICALLY EXEMPT (CLASS 8) EXTENSION OF TEMPORARY USE PERMIT FOR AN ADDITIONAL SIX (6) MONTHS. Recommendation - It is recommended that the Planning Commission approve by Minute Order, a six (6) month extension of the subject Temporary Use Permit. Presentation: Becky Stone, Assistant Planner The Public Hearing was opened at 7:09 p.m. The Public Hearing was closed at 7:10 p.m. Commissioner Baker commented that he was unaware of the oil recovery program and that he thought it was terrific; he also asked what type of advertising Chevron was using. The Director replied that the Oranqe County Reqister, the Orange County section of The Los Anqeles Times, and the local newspapers had run stories regarding the program. Commissioner Baker moved, Kasparian seconded to approve by minute order, a six month extension of the subject Temporary Use Permit. Motion carried 4-0. OLD BUSINESS: 4. Pacific Center East Environmental Impact Report APPLICANT: CITY OF TUSTIN Recommendation - It is recommended that the Planning Commission adopt Resolution No. 2859 recommending that the City Council and Redevelopment Agency certify the final Environmental Impact Report for the Pacific Center East project as adequate and complete. Presentation: Christine Shingleton, Development Director of Community Commissioner Kasparian asked the Director to paraphrase Item H of Resolution 2859 for clarification of the double negative. The Director clarified it by stating that the City shall not approve a project unless the City can lessen or avoid the impacts; that this is one segment of the law; and that this section was drafted by the City Attorney's office. Lois Jeffrey, City Attorney, stated that the City has a responsi- bility to mitigate the impacts; that the City does not go forward with a project unless it has done its best; and if there are unavoidable significant impacts, the City finds other reasons, social or economic, to balance against the impacts and to go ahead. Commissioner Kasparian moved, Kasalek seconded to adopt amended Resolution No. 2859 recommending that the City Council and Redevelopment Agency certify the final Environmental Impact Report for the Pacific Center East project as adequate and complete. Resolution No. 2859 amended by adding an "Errata Sheet". Planning Commission Minutes December 10, 1990 Page 3 Motion carried 4-0. NEW BUSINESS: STAFF CONCERNS: 5. Report on actions taken at December 3, meeting. Received and filed. 1990 City Council Commissioner Le Jeune -In response to the Council's action on the red curbing in front of the San Remo Market, he felt drivers should not be able to make a left turn out of Andrews onto Newport going south. -Asked if Mr. Grienke, the owner of the property at the northeast corner of Newport and E1 Camino Real was aware that the buildings he purchased from the City contained asbestos. The Director advised that they are currently reviewing the documents. COMMISSION CONCERNS: Commissioner Kasparian -Inquired as to the actions being taken by Jerry Crabill in regard to the junction box at Main and Newport; that he had checked with other cities to see how they handle the problem; for example, Irvine requires that they be located in the land- scape areas and enforce this through the design review process. He feels that this should be part of our design review process. Commissioner Kasparian moved, Le Jeune seconded to direct the Community Development Department to draft a memo to the Public Works Department on behalf of the Planning Commission request- ing a resolution for standards to be established for review of utility box locations that can be consistently applied against all development projects, even those that do not come before the Commission, so that City Council can review for concurrence. Motion carried 4-0. Commissioner Baker -Asked if the resolution could include Federal Express mailbox locations. Commissioner Le Jeune -Advised that there are several Federal Express mailboxes in the Irvine Business Center that create a traffic problem, particularly around 4:00 p.m. Commissioner Kasalek -Advised that recently a 13-year-old boy was electrically shocked and burned when he touched a light post in Magnolia Tree Park; and wanted to know if the City equips these light posts with circuit breaker interrupters to prevent this from occurring. The City Attorney's office advised that this issue should not be discussed because of a potential claim, but that the Public Works Department is looking into the matter.
