PUBLIC HE~RINGS: 1. ~aci$ic Center East Specific Plan EIR Recommendation - It is recommended that the Planning Commission open the public hearing; receive a staff report; request testimony from other interested parties; close the hearing at conclusion of all testimony; and instruct staff to respond to all comments. Presentation: Christine Shingleton, Development PBR representatives Director of Community Bill Phillips, PBR, 18012 Sky Park Circle, Irvine introduced his staff; Sid Lindmark, Project Manager; Terry Austin, Austin-Foust Associates, Traffic Consultant. Sid Lindmark, PBR, 18012 Sky Park Circle, Irvine, Project Manager presented a brief summary (attached). Terry Austin, Austin-Foust Associates, Traffic Consultant. Pointed out the traffic highlights of the traffic findings. As each phase is built there will be certain intersection improvements that will enable the level of service to accommodate increased trips by the surrounding roadways. The most significant change in the existing roadway is related to the southwest extension of Newport Avenue. The most significant outcome is the shift of traffic from Red Hill over to Newport. While this project adds traffic to Red Hill at the same time by extending Newport Avenue to Edinger it takes more traffic from Red Hill. It Will generate approximately an additional 40,000 trips per day. Without the Newport extension about 25% of these will go to Red Hill, however, with the Newport extension about 20,000 trips will be diverted to Newport Avenue. There is a very comprehensive set of mitigation measures designed to mitigate these trips. Commissioner LeJeune confirmed that 10,000 trips per day would be added to northbound Newport Avenue and asked how many of these would be going onto the 55 Freeway. ~_A~ advised that few project trips will have to go north on Newport to get to the 55 Freeway due to the Edinger interchange. Planning Commission Minutes October 3, 1990 Page 2 The Public Hearing was opened at 7:18 p.m. Steve Moore, 1001 E. Edinger, owner, Mutual Liquid Gas and Equipment Company, Inc. read letter sent to Christine Shingleton (attached). Commissioner Shaheen asked how much would his property be reduced, how many acres, and what is the value. Mr. Moore advised 1.3 acres would be lost, but that it was not the size but access that they are concerned about, it would make the property useless for their purposes. Stephen Moline, 1581 Kenneth Drive, Santa Ana, asked why project was necessary. Was concerned about adding more trips to Red Hill, an already congested area, and asked why it could not be kept south of Edinger, separate from this area. Believes this project has horrendous impacts to the City of Tustin. Wanted to know who would pay for these studies that will obviously benefit industry in that area but not residents of the City. Commissioner Shaheen asked what Mr. Moline's qualifications were in reference to his objection to the project. Mr. Moline advised although he is not a Tustin resident that because he is in the sphere of influence he will be impacted by the traffic. A1 Hirasuna, Garden Inc., located on the horseshoe of Industrial Woodlawn and Sante Fe north of Pacific Bell. He was interested in the discrepancy of the setback requirements for sidewalks and parkways. The Specific Plan, page 20, states a 25 foot setback, however, Exhibit 9k shows a setback of 20 feet and street width of 40 feet. According to his measurements on the site, if it were 20 feet from existing curb it would come right to curb of their parking lot, if 25 feet it would come into their parking lot and the existing street is actually 50 feet. Would like to know requirement and impacts as related to his parking lot. The Director responded that there are two standards that relate to new construction; 1) The building setback standard which is taken from the property line; and 2) The landscape setback which is from curbface. There are footnotes in the development standards which clarifies this. The right-of-way limit along Woodlawn and those section details are shown in the Specific Plan, Exhibit 7b which follows page 15. Staff will check calculations and make sure they are correct and advise Commission. Public Hearing closed at 7:38 p.m. The Director responded to issues as follows: In response to Commissioner Shaheens question as to property loss. She emphasized that there have been a lot of engineering design alternatives evaluated for the Newport Avenue extension over the 10-year period. Most of the projects are not funded by City taxpayers but by the Tustin Redevelopment Agency. The infrastructure proposed in conjunction with the entire project in the incremental phase will necessitate a certain level of infrastructure improvements. Many of those improvements will be directly financed as a condition of the Specific Plan by the Developer, other main improvements such as the Newport Avenue extension which are regional will be financed by the Redevelopment Agency. The increment generated from the development that occurs Planning Commission Minutes October 3, 1990 Page 3 in this project area will be utilized to get into a long term bond issue, not an obligation of the City of Tustin taxpayers. The actual alignment of Newport Avenue is still relatively conceptual, the Specific Plan defines what the potential impact on adjacent properties would be but it is not final design. The plan sets up a process where the applicant will have to prepare and process the plans through all responsible agencies necessary. At this point the actual value impacts on properties if needed will be determined as to acquisition and depreciated value and we will have obligations under the state redevelopment law and will commit to making whatever is necessary for reimbursement for takings in this project. Most of the other issues are mostly technical and we will respond to them in writing. Commissioner beJ~une asked if anyone came in to get a copy of the EIR and is there a charge. The Director advised that a number of copies were sold at a cost of $45.00 for the three volume set, individual volumes range from approximately $12.00 to $24.00; that there are copies at the Library and at the Community Development Department counter that people can look at free of charge. Commissioner Kasparian clarified that staff would respond to all comments including individual concerns and wanted to know when these responses would be available. The D%rector affirmed his inquiry and stated that comments must be submitted by October 15, 1990 and responses would be available in early November. ComHtssioner Baker moved LeJeune seconded to instruct staff to respond to all comments both oral and written, including all responsible agencies and neighboring cities and come back to the Planning Commission with written response. Motion carried 5-0. OLD BUSINESS: Workshop Discussion on Pacific Center East Specific Plan (As. time permits) Presentation: Christine Shingleton, Development PBR Representatives Director of Community Decision on workshop deferred. NEW BUSINESS: STAFF CONCERNS: COMMISSION CONCERNS: Commissioner Kasparian -Advised he had reported a problem of a directional sign with loose bolts to Public Works. He believes the design of the bolt mountings needs to be changed. Staff will advise Public Works.
