Minutes of the August 13, 1990 Planning Commission Meeting Commissioner Shaheen moved, Le Jeune seconded to approve the consent calendar as submitted. Motion carried 3-1, Commissioner Kasparian abstained. PUBLIC HEARINGS: 2. General Plan Amendment 90-02 - Zone Change 90-03 Recommendation - It is recommended that the Planning Commission continue this matter to September 10, 1990. Presentation: Susan K. Tebo, Senior Planner Commissioner Shaheen moved, Kasalek seconded to continue General Plan Amendment 90-02, Zone Change 90-03 to September 10, 1990 Planning Commission meeting. Motion carried 4-0. 3. INCLUDE AUTO PARTS MACHINING TO SCOPE OF AUTHORIZED AUTO SERVICES Planning Commission Minutes August 27, 1990 Page 2 Recommendation - It is recommended that the Planning Commission approve amendment to Conditional Use Permit 89-28 by adoption of Resolution No. 2818, as submitted or revised. Presentation: Daniel Fox, Senior Planner Commissioner Kasparian asked if the applicant intended to utilize welding equipment. The Public Hearing was opened at 7:08 p.m. Tim Jaarsma, representative of applicant, replied that the machining process will not require acetylene arc or gas welding. The Public Hearing was closed at 7:10 p.m. Commissioner Kasparian noted that he was concerned with welding equipment near the windows that might be viewed by outside observers. Commissioner Kasparian moved, Shaheen seconded to approve amendment to Conditional Use Permit 89-28 by adoption of Resolution No. 2818 as submitted. Motion carried 4-0. 4o Conditional Use Permit 90-18 APPLICANT/ OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: ALDERSGATE UNITED METHODIST CHURCH 1201 S. E. IRVINE BOULEVARD TUSTIN, CALIFORNIA 92680 1201 S. E. IRVINE BOULEVARD PUBLIC AND INSTITUTIONAL THE PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 5) PURSUANT TO THE PROVISIONS OF SECTION 15305 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. AUTHORIZATION TO ESTABLISH A DAY CARE FACILITY WITH A MAXIMUM OF FORTY EIGHT (48) CHILDREN AT AN EXISTING CHURCH SITE. Recommendation - It is recommended that the Planning Commission approve Conditional Use Permit 90-18 by adopting Resolution No. 2821, as submitted or revised. Presentation: Anne Bonner, Assistant Planner Commissioner Shaheen asked if the church has applied for state permits, and if they had been approved. Staff replied that the permits were pending this evening's approval. Commissioner Kasparian asked if this type of facility could be identified under Zoning Code 9245.B, Schools Public, or if they should be referencing a different zoning section. The Public Hearing was opened at 7:12 p.m. Dorothy Zurcher, 12931 Charloma, noted that ten years ago St. Paul's Church applied for a similar program and was denied use permits since a commercial use was not allowed; that Aldersgate is Planning Commission Minutes August 27, 1990 Page 3 proposing a commercial use; that the accesses to the property should be considered; that Irvine Blvd. is to be a 6-lane road; that access to and from would be limited and not ideal; that participants in the program would be utilizing the neighborhood streets to gain entry to the facility; that the neighborhood already has increased traffic due to people avoiding Irvine Blvd. and Newport Avenue; that there is child care available in the Baptist Church on Newport and Red Hill Lutheran; that a large proportion would be coming from outside areas; that the center intends to increase from 48 children to 98; and that she does not feel that Aldersgate Church is the best place for this facility. Brad Hendricks, 12921 Charloma, noted that his property abuts the school; that they purchased their property prior to the fire department's placement; that they have to tolerate evening games; and asked that the Commission not burden the neighborhood with the increased noise and traffic this would cause. Scott Erickson, 12911 Charloma, noted that his property abuts the church; that the children cross the street to play and is afraid that the added traffic will increase the chances of an accident; that there is currently fast, irresponsible traffic, and he does not want it to increase further. John Moseley, 12888 Elizabeth Way, was concerned that when he moved in there were 1 or 2 meetings at the church, and it was quiet; now there are buses, and all-night parties; that he will now have to endure people arriving every day before 7:00 a.m.; that there is not a 6 foot fence, but a 3 foot fence on the church side of the property line; that he would not like to live with more noise and deterioration; and that the church should feel a responsibility to maintain a neighborliness, as the neighbors do for the church. Craiq Stevens, 12852 Charloma, noted that he moved in after the churches were opened; that he is concerned with the safety of his small children; that he wrote a letter to the City Traffic Department asking permission to install and pay for two (2) stop signs at Charloma and Kenneth and Charloma and Wass; that he supports the application; that he is not concerned with the traffic to and from the church; and that the people creating the dangers are those bypassing Newport Avenue and Irvine Blvd., not the people utilizing the church or the day-care center. pavid Miller, 12741 Charloma, noted that he was in favor of the day-care center; that the stop signs suggested by Mr. Stevens would be an excellent solution; that the traffic is due to commuters bypassing the congestion; that there may be openings in day-care facilities, but it is difficult to find quality programs as is being proposed; the church is proposing a structured plan with some instruction and day-care, which and will be well-monitored by teachers; that Aldersgate wishes to be a good neighbor and will adhere to the conditions; that he has never heard the late-night parties; that there are no other Methodist churches for at least a lO-mile radius; and that he would like the Commission to set conditions that would require Aldersgate to be a good neighbor, but to also allow it to be a good neighbor by allowing the day-care facility that is desperately needed. Ms. Zurcher noted that St. Paul's has an outstanding nursery school, but is not an extended day-care; and that the Methodist church does not allow its churches to be built within a certain district; and that the Fire Department was let in without being totally aboveboard, without consideration for the residents. Planning Commission Minutes August 27, 1990 Page 4 Jack Miller, 17352 Parker Drive, noted that he has been an Aldersgate member since 1963, and on the administrative board; that the number of people in opposition surprised him; that they have never had a complaint from the neighbors regarding the activities at the church; that the church wants to help the community and feels that the day-care facility would be a step forward; and that they would be willing to work anything out with the neighbors. Sheila Jones, proposed day-care facility director, noted that she was dismayed by the concern of traffic; that they are providing a service to the parents who will not be spending time at the center since they need to get to work or get home; that the arrival and departure times will be staggered; that there are no complaints regarding traffic at the church; that there will be a structured, well-supervised program; that there will be a good child/teacher ratio; and that if there is a demonstrated need in the future, they will address it then. Commissioner Le Jeune asked if the applicant intended to increase the facility to 96 children. Ms. Jones affirmed that they have plans to increase to 96 children if the need arises, and that they will go through the proper channels at that time. Commissioner Kasparian asked if the day-care center will be parochial or open to the public; asked if there will be a queue of cars at 7:00 a.m.; and asked how they would force the parents to pick up their children by 6:00 p.m. Ms. Jones replied that it will be open to the public, but church members would have priority; that there may be 2-3 cars at 7:00, but that the majority will be between 8:00 and 8:30 and at 4:30 p.m.; and that they cannot force them to come by 6:00. Allan Waterson, Senior Pastor at Aldersgate, replied that the program will have a Christian emphasis with chapel service weekly or monthly; that it is built for the community; that there is traffic and noise with the use of the buildings by the community; that there is a need for day and infant care; that they encourage the parents to arrive by 6:00 p.m. by charging fines of $1.00 per minute when children are picked up after 6:00. Commissioner Le Jeune asked if there were any programs in session in the early morning hours. Pastor Waterson replied that anything occurring at the church at those hours was not affiliated with the church. Commissioner Le Jeune noted that any occurrences at that time would be unauthorized by the church; and asked what time the meetings usually adjourn. Pastor Waterson affirmed that they would be unauthorized; and that the meetings adjourn around 9:00 or 9:30. Jim Pederson, 13165 Ranchwood, asked what the acceptance criteria would be for the children; and asked where they drew their decision for need from. Commissioner Le Jeune replied that those questions were not relevant to the discussion. Planning Commission Minutes August 27, 1990 Page 5 Mr. Pederson replied that the pastor noted that the program was open to everyone; and noted that he felt it was relevant to ask where they determined the need to be from. Claire Bell, 17371 Village Drive, noted that she was the chair- person of the child task force studying this program; that they performed studies throughout the community and utilized the existing professional survey of the AAUW which determined there to be a dire need for day-care services; that they have attempted to meet this need; and that the number of children relates speci- fically to the State requirement of square feet per child. craiq stevens asked if the traffic meters at the intersections of Charloma and Wass and Charloma and Kenneth were the result of his request for stop signs or of traffic studies for this application; that it is not the volume but the speed of the traffic which is of concern to him. The Assistant Director replied that they would have been installed by the Public Works Department and might have been due to his or some other request. Mr. Erickson noted that there has been more than one incident of cars "doing do-nuts" in the parking lot; that some measures need to be taken to limit the access to the parking lot, possibly by closing off the rear access and requiring the parents to use the Irvine Blvd. entrance. Commiss$oner Le Jeune asked if he called the police when the there was a problem. Mr. Erickson replied that they are usually just kids and are gone too quickly; that the issue is not just congestion on the street, but the amount of cars throughout the day; and was concerned that his and the neighboring children would be in jeopardy. Ms. Jones replied that their operating hours are from 7:00 a.m. to 6:00 p.m, but that it is an extended day program which requires restrictive times that the children can be delivered and picked up. The Public Hearing was closed at 7:50 p.m. Lois Jeffrey responded to Commissioner Kasparian regarding whether the use would be allowed; noted that the property has a zoning classification of Public and Institutional and that the use required a Conditional Use Permit. Ms. Jeffrey then read through the Code for clarification; noted that the Planning Commission may determine that another kind of is similar and determined a day-care use to be similar to a playground, a public school, or a public recreation center, and is allowed within the Public and Institutional District. Commissioner Shaheen asked how many homes abut the church property; and asked if a traffic study had been initiated to determine if there was a problem. Staff replied that there are 3-4 on the west side and 7-8 on the east side; and that the Public Works Department evaluated the site but did not see a traffic problem. Commissioner Kasalek asked for a clarification of the wall height. Staff replied that it was 6 feet 8 inches on the residents' side. Planning Commission Minutes August 27, 1990 Page 6 Commissioner Kasparian felt that the traffic problems and noise were not germane to the day-care center; that the problems should have been identified to the City or the police; that the monitors may have been installed due to a complaint regarding the traffic; and that he has found nothing that the opponents offered to alter his opinion on the establishment of the day-care center. Commissioner Le Jeune concurred; restrictions should be imposed. and asked if any other Commissioner Shaheen noted that the matter should be continued until a traffic study was conducted. Commissioner Le Jeune commented that the Public Works Department determined that a traffic study was unnecessary. Staff recommended that the Public Works Department prepare a report relating to the request for traffic signs and provide it to the Planning Commission. Commissioner Le Jeune agreed and suggested that Mr. Stevens be informed of the results. Commissioner Kasparian moved, Kasalek seconded to approve Conditional Use Permit 90-18 by adoption of Resolution No. 2821 as submitted. Motion carried 4-0. OLD BUSINESS NEW BUSINESS 5. Status Reports Presentation: Daniel Fox, Senior Planner Commissioner Kasparian asked if the reports were issued monthly; and asked for clarification of the report. Staff affirmed and replied that the current information was correct as of August 1; and reviewed the report with the Commission. Commissioner Kasparian asked if the park acreage was tracked in the report; what total acreage had been dedicated to date; and if any of the developers had paid money in lieu of dedicating park space. Staff replied that the park acreage was monitored by the Community Services Department; that sector level maps indicate the amount dedicated; that he was unaware of the amount dedicated; and that no developers had paid money in lieu of dedication, as yet. Received and filed. STAFF CONCERNS Report on Actions taken at August 20, 1990 City Council Meeting. Presentation: Rita Westfield, Assistant Director of Community Development COMMISSION CONCERNS Commissioner Shaheen noted the numerous signs on Newport Avenue and asked if they were legal. Planning Commission Minutes August 27, 1990 Page 7 Commiss$oner Kasparian -Advised that on his trip North, the lack of signs was very appealing and wanted to know if we could get a copy of the Sign Code from Victoria, British Columbia for the Planning Commission and Sign Code Committee to review. -Recommended reading of the LA Times article on parklands. He suggested that allocation and availability of useable parkland was a problem and that it should be monitored. He questioned how many acres are allotted for parklands in Tustin. Staff advised that they will investigate and advise the Commission. -He thought the Fire Safety brochure was very good and would like to see a larger distribution, possibly the Tustin Today. Staff advised they had considered this but the cost was prohibitive. Commissioner Kasalek suggested making it available to the schools and they could reproduce and distribute. Commissioner Le Jeune suggested that it be made available to the Library. Commissioner Le Jeune -voiced his complaint, again, about the appearance of the Water Works facility. He suggested some type of screening for fence on Main Street and near adjacent vacant lot. Staff advised they are in the process of screening equipment and they will monitor the situation. ~O'OU~E~ At 8:15 p.m. Commissioner Shaheen moved, Le Jeune seconded to adjourn meeting to the next regularly scheduled Planning Commission meeting on September 10, 1990 at 7:00 p.m. in the City Council Chambers, 300 Centennial Way, Tustin.
