NO ADDITIONAL DOCUMENTATION IS REQUIRED. AUTHORIZE MODIFICATIONS TO THE RECREATION FACILITY BUILDING, RETAINING WALLS FOR UNIT ENTRIES AND LOWER LEVEL WINDOWS. RECOMMENDATION It is recommended that the Planning Commission adopt Resolution No. 2744 approving modifications to the previously approved recreation building tower element, retaining walls for unit entries and lower level windows, subject to conditions contained in Exhibit A, as submitted or revised. Presentation: Daniel Fox, Senior Planner Commissioner Baker asked if Item 1 of the Minutes of April 30 should have been approved by Minute Order. The Director affirmed that a temporary use permit is approved by Minute Order, not by Resolution. Commissioner Baker moved, Kasparian seconded to approve the consent calendar. Motion carried 4-0. PUBLIC Conditional Use Permit 90-09 and Design Review 89-20 (Mobile Recycl inq) APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: MOBILE RECYCLING CORPORATION 11292 WESTERN AVENUE P.O. BOX 125 STANTON, CALIFORNIA 90680 C/O MR. SAMUEL S. TOTOR C.C. HUMPHRIES 30001 CROWN VALLEY PARKWAY LAGUNA NIGUEL, CALIFORNIA 92677 14551 RED HILL AVENUE C-2 (CENTRAL COMMERCIAL) THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO SECTION 15303 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. AUTHORIZATION TO ESTABLISH A 170 SQUARE FOOT BULK VENDING RECYCLING FACILITY IN THE PARKING LOT OF THE ALPHA BETA SHOPPING CENTER PURSUANT TO CITY CODE SECTION 9232(b) (v) OF THE TUSTIN CITY CODE. RECOMMENDATION It is recommended that the Planning Commission continue this item to June 11, 1990 to allow the property owner to amend this conditional use permit application to include amendments to original Conditional Use Permit conditions of approval related to parking for the entire center. Presentation: Daniel Fox, Senior Planner Commissioner Le Jeune asked if this item should be continued as received, or should they take testimony on it. The Director replied that the Commission could continue it as received, but recommended that they open the Public Hearing in case someone was present in the audience that wished to provide public Planning Commission Minutes May 14, 1990 Page 3 testimony. The Public Hearing was opened at 7:09 p.m. The Public Hearing was closed at 7:10 p.m. Commissioner Kasparian moved, Le Jeune seconded to continue Conditional Use Permit 90-09 and Design Review 89-20 to the June 11, 1990 Planning Commission meeting. Motion carried 4-0. 5. Conditional Use Permit 90-10 APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: JOSEPH CASASANTA, GENERAL MANAGER CONTINENTAL CABLEVISION 13816 RED HILL AVENUE TUSTIN, CALIFORNIA 92680 HOWARD & ANNA LARNARD AMERICAN CABLE SYSTEMS OF CALIFORNIA, INC. 13816 RED HILL AVENUE TUSTIN, CALIFORNIA 92680 137 SOUTH PROSPECT CENTRAL COMMERCIAL (C-2) A NEGATIVE CONFORMANCE QUALITY ACT. DECLARATION HAS BEEN WITH THE CALIFORNIA PREPARED IN ENVIRONMENTAL REQUEST: TO INSTALL A 30 FOOT TALL HIGH FREQUENCY RADIO RECEPTION TOWER WITH THREE ATTACHED MICROWAVE DISHES AT 137 SOUTH PROSPECT. RECOMMENDATION - It is recommended that the Planning Commission either: 1. Continue this matter until June 25, 1990 to permit renoticing of the project; or 2. Certify the Final Negative Declaration for the project as adequate by adoption of Resolution No. 2772; and approve Conditional Use Permit 90-10 by adoption of Resolution No. 2773, as submitted or revised. Presentation: Christopher Jackson, Associate Planner Staff made a change to the above Recommendation by noting that the item should be continued to June 11, not June 25. Commissioner Le Jeune noted that the 30 foot tower was exhibited showing three (3) microwave dishes and asked if they would also need crossarms. Staff replied that one of the proposals indicated that to relocate the antennae from the building to the tower would require crossarms that extended 20 feet on either side; and that the crossarms extending 20 feet on both sides was not feasible due to being on the property line. Commissioner Le Jeune asked if the 30 foot tower was approved, would the antennae still remain on the roof; and if there was no other alternative. Staff affirmed that the antennae would remain if a 30 foot tower was approved; and that this was the only feasible alternative at this point. Commissioner Le Jeune asked how high the tower on 6th Street was. Staff replied that they believed it was 20-30 feet high; and that Planning Commission Minutes May 14, 1990 Page 4 the buildings were 28-30 feet high. Commissioner Baker noted that before the next hearing staff could provide specifics of the tower on 6th Street for comparison. Commissioner Shaheen asked if the extensions would be two (2) feet out; and asked how they would balance the structure. Staff replied that they would extend 20 feet on either side. Commissioner Kasparian asked staff to clarify whether there would need to be crossarms if the height of the tower was increased to 50 feet; asked if the applicant was aware that a car wash would be built on the next lot; and if the electrical equipment at the car wash would provide interference. Staff replied that at 50 feet there would not be a need to install crossarms, as the antennae would be stacked; but there would need to be crossarms if it remains at 30 feet; and that the applicant was aware of the car wash. The Director replied that the applicant provided the technical information, but that the City also hired an independent consultant, the Rictor Group, who provided an independent consulting evaluation which confirmed the applicant's information. Commissioner Kasparian asked if the tower would be freestanding, or with guy wires; and asked what the area of the base was. Staff replied that it would be freestanding; and that at 30 feet each side of the triangle would be 2 1/2 feet wide. Commissioner Kasparian asked what the width of the base would be for a 50 foot tower. Staff replied that the consultant indicated that there would not need to be significant changes because the satellite dishes would remain at the same height. Commissioner Kasparian noted that the Resolution indicates that everything on the tower should be painted blue; and that it should be made clear that the reflectors should not be painted. Staff replied that the facility on 6th Street allowed for the entire tower, including reflectors to be painted blue; and that it seems to be possible to paint the reflectors without problems. Commissioner Kasparian asked if this tower would be receiving other transmission besides from the facility in Santa Ana; and asked where the antenna was that was receiving from Xerox. Staff replied that the earth stations receive transmissions from orbiting satellites, but that the tower only receives from the Xerox building; and that the other antenna does not yet exist. Commissioner Baker noted that there are satellite dishes on the ground as well as antennae on the roof. Commissioner Le Jeune asked if their objective was to improve the quality of chan~els 2, 4, and 5; and noted that they could not vote on the 50 foot tower this evening due to lack of notification. Commissioner Kasparian asked if they were discussing radio or television waves. Staff replied that they were technically referring to radio Planning Commission Minutes May 14, 1990 Page 5 frequency, and that television is broadcast over radio waves. The Public Hearing was opened at 7:23 p.m. Mr. Joe Casasanta, General Manager Continental Cable Vision, made some comments: 1) if a 50 foot tower is approved, there may be need for guy wires, or for a larger antenna base; 2) they are aware of the car wash, and with the new tower they would not be affected by motors or generators from car wash due to bringing the signals in, but would be if they leave the antennae as they presently are; 3) they can paint the dish blue as long as they don't use non- metallic paint. He also questioned whether the meeting of June 11 would allow adequate notification of the area. Commissioner Le Jeune asked if the applicant had a preference of a 30 or 50 foot tower. Mr. Casasanta replied that due to timing they would prefer the 30 foot tower, but technically the 50 foot tower would allow consolidation; that there is the question of the additional height and visibility of the 50 foot tower; and that one option is not necessarily better than the other. Commissioner Kasparian asked if they would have to cross onto anyone else's property for repair of the dishes. Mr. Casasanta replied that these were all within their own property. Commissioner Le Jeune asked if there were any proposals to screen the antennae on the roof if the 30 foot tower was approved. Mr. Casasanta replied that they could possibly put a screen over the roof line, but that it could potentially interfere with the reception; and that it depends on where the screen would be located. The Public Hearing was closed at 7:28 p.m. Commissioner Kasparian questioned Item 2.2 on Page 2 of Exhibit A of Resolution No. 2773 "All utilities excluding..."-, if that meant that all utilities serving the site should be underground; and if this applied whether they approved a 30 or 50 foot tower. Staff replied that "excluding" should be "exclusively"; and that it would be the same for either height. Commissioner Le Jeune noted that the option before the Commission was to continue the matter to June 11 for a 50 foot tower, or lower. The Director asked if the Commission wanted staff to continue and notice for 50 feet for the next hearing and provide additional information to explore the alternative of screening with the existing 30 foot proposal. Commissioner Le Jeune noted that the was trying to determine a consensus of the Commission. Commissioner Kasparian liked the idea of consolidation; and liked the idea of a 50 foot tower if the applicant was able to accommodate it. Commissioner Kasparian moved, Shaheen seconded to Conditional Use Permit 90-10 to the June 11, 1990 Commission meeting. Motion carried 4-0. continue Planning Planning Commission Minutes May 14, 1990 Page 6 OLD BUSINESS NE~ BUSINESS ST~FF CONCERNS 6. Report on Actions taken at May 7, 1990 City Council Meeting. Presentation: Christine Shingleton, Development Director of Community CONCERNS Commissioner Kasparian -Asked how some cities, such as Villa Park, meet low income housing requirements without including mobile home parks as part of the housing element. The Director advised that it is a function of the zoning requirements. Some cities elect not to zone for mobile home parks. The Commissioner asked how Villa Park addressed the State low cost housing requirements. The Director replied that she did not know how Villa Park addressed the issue, but that each City had an obligation to adopt a Housing Element by July 1989 and as of this year Villa Park was one of the Cities that has not complied, but that the City of Tustin had. Commissioner Baker -Asked why the Noticing Memorandum specified The Tustin News exclusively for publishing the Public Notices. Staff replied that the State law requires publication in a newspaper of general circulation which requires circulation for a minimum of one year. -Asked when the vacant Planning Commission chair would be filled. The Director advised that it is being addressed at the next City Council meeting on May 21, 1990 and that the Commission will be provided with direction after that meeting. Commissioner Shaheen -Suggested that the bus stop on First Street at Larwin Square be moved around the corner on Centennial Way, that people leaving Larwin Square cannot see past the buses therefore causing a dangerous situation. Staff replied that the information will be referred to the Public Works Department for a report. -Asked if there was an Ordinance regarding inoperative vehicles parked on grass in front yards of private property. The Director advised that the Nuisance Ordinance can be used for inoperative vehicles. Commissioner Le Jeune -Asked about the status of the Health Care facility at Newport and Sycamore and voiced concerned about the poor physical state of property. Staff replied that the Conditional Use Permit had expired on the site and that Design Review was due to expire in three months, but staff would contact the owner to address current property conditions. -Inquired about the business tenants at Tustin Plaza painting their parking stalls for 15 minute limits. The Director replied that the small businesses directly adjacent to the restaurant have been experiencing economic problems due to the negative impact of the restaurant to the small business Planning Commission Minutes May 14, 1990 Page 7 tenants. -Asked if the Public Hearing Notices could be put on apartment complex bulletin boards for tenants near affected property. The Director identified legal posting requirements and that the city's procedures are in excess of the minimum legal requirements. ADJOURNMENT At 8:00 p.m. Chairman Le Jeune moved, Kasparian seconded to adjourn to the next regularly scheduled Planning Commission meeting on Tuesday, May 29, 1990 at 7:00 p.m. in the City Council Chambers, 300 Centennial Way, Tustin.
