RECOMMENDATION - It is recommended that the Planning

RECOMMENDATION - It is recommended that the Planning
Commission adopt Resolution No. 2734 approving modifications
to the previously approved leasing/recreation area design
originally approved by Design Review 88-44, subject to the
conditions contained therein, as submitted or revised.

THE PROJECT IS EXEMPT FROM THE REQUIREMENTS OF THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO
SECTION 13501 (CLASS 1)
RECOMMENDATION - It is recommended that the Planning
Commission adopt Resolution No. 2735 approving the requested
modifications to the project originally approved by Design
Review 88-45 subject to the conditions contained therein as
submitted or revised.
Commissioner Baker asked if the Commission had specifically
indicated the request referred to in the recent letter from the
applicant; if the request to continue the variance was due to no
location being found; and if a six (6) month extension would be
adequate.
Staff read Conditions 5.1 and 5.2 of Resolution No. 2558 to clarify
the Commissioner's questions; that the applicant is asking for the
extension due to no suitable site being found as yet; and that the
six (6) month extension was to allow the developers to demonstrate
a good faith effort to continue. As yet there are no reports or
communications towards securing permits; in six (6) months if the
applicant shows progress another extension could be considered.
The Director noted that there are not documents to date; this
extension also allows the builder to identify any infeasibility of
moving; and with conditions changing in the Community, it may
require re-evaluation of conditions if there is no continuous
progress being made.
Staff noted that if the Commission would not approve the extension,
the application would be deemed expired and the applicant would
have to go through the variance process again. The six (6) month

extension would allow the application to expire with the Design
Review.
Commissioner Kasparian asked if Mr. Yates had been notified; and
if there would be any limit on the amount of extensions.
The Director noted that he requested the extension; and that there
is no limit to the number of extensions allowed.
Commissioner Le Jeune moved, Kasparian seconded to approve the
Consent Calendar as submitted. Motion carried 5-0.

5. December Status Report
Presentation: Daniel Fox, Senior Planner
Commissioner Le Jeune asked about the code status of the recycling
center at the Alpha Beta shopping center.
Staff replied that this is a code enforcement item; and they
require a Design Review submittal.

REQUEST:

RECOMMENDATION - It is recommended that the Planning
Commission take the following actions: 1. Approve the
Environmental Determination for the project by adoption of
Resolution No. 2745; 2. Approve Design Review 89-83 by
adopting Resolution No. 2746, as submitted or revised.

Commissioner Kasparian noted that he would like to discuss Item 6.3
with staff at a later time for further clarification.
The Director replied that there are other issues laid out in the
Noise Ordinance that authorize the exceptions. Rather than laying
out all of the criteria of the Noise Ordinance, they redrafted to
reflect the consensus of the Noise Ordinance.
Commissioner Shaheen asked what the roof composition would be; and
noted that he felt that the architecture was not in conformance
with the rest of East Tustin.
Staff replied that it would have tile roofs.
Commissioner Baker asked if Browning would not have an over/under
pass.
Staff replied that a traffic report is being prepared to determine
if the Browning overpass would be necessary; if it is necessary,
they have reserved a parcel for it.
The Director noted that the underpass is impossible, but that the
overpass requires further environmental study.

Page 1, 1.1: remove "also" from line 8, and "to be" from line
10.

Paqe 3 is a duplicate and should be removed and the remainder
subsequently renumbered.
Paqe 5, 6.1: remove "is required" from line 7 of paragraph 2.

meeting.

CONCERNS
Commissioner Baker asked if Carl's Jr. appealed the decision of the
last meeting regarding their pole sign request.
The Director replied that they had appealed. However, the new
request was substantially revised and should come before the
Commission again before going on to the City Council.
Commissioner Shaheen expressed his concern about the
development of the City, especially the downtown area.

The Director replied that as part of a program over the next 12
months, the Cultural Resources Advisory Committee will be looking
at developing to maximize opportunities in Old Town. One
alternative is mixed-use, but there is a high degree of sensitivity
to retain the R-1 district.

Commissioner Le Jeune asked about the expansion of the Health Care
Medical Center at Newport and Sycamore.
Staff replied that with the Conditional Use Permit that was
granted, they have one (1) year to make progress, but nothing has
occurred to date.
The Director noted that they may be having financial problems, and
that they may be making a decision in the next thirty (30) days to
sell the property.
Commissioner Le Jeune asked if there was an enforceable dish
ordinance, and if under were under code enforcement; noted that he
felt that the staff should review the blinking lights issue around
the City at night; asked if the center at Newport and Walnut would
be authorized to have different colored curb striping; that there
seems to be a significant lack of enforcement of the two-hour
parking requirement along B Street.
The Director replied that there are some dish violations under code
enforcement at present, and that the court found the City's
requirements to be valid; that seasonal-style blinking lights and
small neon signs inside the building were permitted as long as they
do not exceed the approved square footage; that the parking code
does not specify that all striping be the same at one center; and
that they would look into the parking problem along B Street.
Commissioner Kasparian noted a sign that was in disrepair at the
corner of Newport and Irvine Blvd; reiterated that he felt that
the red-lining of the curb in front of San Remo's Market should be
done independently of the construction; and asked about the status
of the Sign Code.
The Director replied that it would be referred to code enforcement;
that the contractor had to have the curb red-lined before the City
would issue a Certificate of Occupancy, but after the determination
of intersection obstruction. She noted that she would draft a memo
to Public Works for an update; and that there would be a status
update at the next meeting regarding the Sign Code.
Commissioner Baker asked if the construction site at Newport and
Bryan has ceased; and asked if there was any problem with toxic
leakage at the site.
Staff replied that it is finishing the Plan Check process and has
to wait for construction plans to be approved before it can
continue with the precise grading; and discussed the status of the
Newport/Bryan site and the Newport/E1 Camino site.

to the next regular scheduled meeting of the Tustin Planning
Commission on February 12, 1990 at 7:00 p.m. in the City Council
Chambers, 300 Centennial Way, Tustin, California. Motion carried
