Motion carried 4-0. PUBLIC HEARI'NGS 5. Use Permtt 88-19 APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: ORANGE COUNTY BUILDERS 1260 HANCOCK ANAHEIM, CA 92807 ART AND ZENY REMIGIO 65 EMERALD IRVINE, CA 92715 14752 HOLT AVENUE TUSTIN, CA 92680 R-3 3000: MULTIPLE FAMILY RESIDENTIAL NEGATIVE DECLARATION REQUEST: AUTHORIZATION TO CONSTRUCT A 3,215 SQUARE FOOT, 8 BEDROOM, ONE-STORY ADDITION TO AN EXISTING SENIOR CITIZEN'S HOME ON A 12,220 SQUARE FOOT LOT. Recommendation: It is recommended that the Planning Commission approve Use Permit 88-19 by the adoption of Resolution No. 2532, as submitted or revised. Resolution No. 2532: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA APPROVING USE PERMIT 88-19 FOR A 3,215 SQUARE FOOT ADDITION TO AN EXISTING SENIOR CITIZEN'S HOME AT 14752 HOLT AVENUE. Presentation: Eric Haaland, Assistant Planner Commissioner Well asked for clarification of Item 3.4(c) of Exhibit A of Resolution No. 2532. Staff responded with a correction to the item {listed in the motion below). Commissioner Baker inquired about the 42 foot long driveway asking if the resolution is compatible. Staff responded that there was no landscaping along the driveway, only on the easterly side of the parcel. The public hearing was opened at 7:16 p.m. Alfred George, 14768 Holt, representing the management at 14762 Holt, brought pictures to show the red curb parking. Staff noted that there are five to ten foot red curbs to provide visibility upon exiting the driveways. Planning Commission Mtnutes October 10, 1988 Page four Commissioner Weil asked how much parking was on the apartment property. Mr. George responded that there are six parking spots and a two car garage. Elizabeth (Pinkerton) Kline, 25400 Cart Road, Wildomar, owner of the property to the south of the proposed project, stated that she felt that a block wall should be installed and it would be detrimental if any other type of fencing were used. Barbara Plnkerton, 14762 Holt, noted concern regarding the safety of the children in the area. Joe Sargeant, representing Orange County Builders, noted that as the contractor he would automatically put up a construction fence while the project was in progress. He also noted that a double faced wood fence would provide a sound barrier. He stated that he had no objection to the block wall but felt the wood fence would be better aesthetically. Commissioner Le Jeune asked for more perspective on the parking and if staff felt comfortable with the parking as planned. Staff responded the turning radius and backup space was adequate. Barbara Pinkerton noted that there was kitchen noise at times as early as 5:30 a.m. and as late as 11:00 p.m. Commissioner Baker asked the height of the old fence and if a 6'8" fence would solve the potential noise problems. Joe Sargeant noted that there was a ten foot setback and that the kitchen facilities will be in a location toward the back of the parcel and not in the current location. Alfred George noted that if the kitchen in the back of the parcel is used there would be no noise problem as it would be adjacent to a carport. Richard Crulckshank, 11352 Murray Lane, Santa Ana, Ca. 92705, spoke in favor of the wooden fence. Zen¥ Remtgto, the applicant, safety of the children as a would be cold and impersonal. stated she would prefer the wood fence, citing the factor. She also stated that she felt the block wall Commissioner Le Jeune asked Ms. Kltne if the wood fence would be to her satisfaction. Ms. Kline stated that it would be satisfactory as long as it is maintained properly. Commissioner Le Jeune asked who would be responsible for the maintenance of the wood fence. Staff stated that the responsibility of maintenance would be equally shared by both property owners. Commissioner Le Jeune asked who would repair the fence if it was damaged. Planning Commission Minutes October 10, 1988 Page five Staff responded that whomever damaged the fence would be responsible for the repairs. The Director noted that ultimately to remain within the parameters of the Use Permit, the applicant would need to assume the responsibility of the maintenance of the fence in the event that the adjacent property owner did not. The public hearing was closed at 7:44 p.m. Commissioner Shaheen asked what type of wall or fence is recommended by staff. Staff responded that the recommended fence would be a two sided, framed, wood fence that is capped at the top. Commissioner Well stated that a I X 4 double faced wood fence, properly installed would be quite adequate and would be better to absorb the noise. Commissioner Baker noted that a 6" high curb (for drainage) with a fence on top would be better. The Director noted that the fence height was measured from the existing finished grade on site. Commissioner Le Jeune thanked the applicants for their flexibility in removing the second story. Commissioner Le Jeune moved, Well seconded to approve Use Permit 88-19 by the adoption of Resolution No. 2532 with the following correction: Exhibit A, Page four, Item 3.4 (c) should read "Provide a minimum of one 15 gallon size tree for every 30 feet of property line on the easterly property perimeter and shrubs where landscaping is provided shall be a minimum five (5) gallon size." Motion carried 4-0. OLD BUSINESS 6. Abandoned Railroad Right-of-Way Presentation: Christine Shingleton, Director of Community Development Commissioner Baker asked if the fuel line located in that right-of-way is actively used in relation to the line along Bryan Avenue. The Director responded that the fuel line is used but is not related to the one along Bryan. Planning Commission Minutes October 10, 1988 Page six NEW BUSINESS STAFF CONCERNS 7. Report on City Council Actions - October 3, 1988 Presentation: Christine Shtngleton, Director of Community Development COMHISSION CONCERNS Commissioner Wetl thanked staff for the follow-up memos on the issues that were brought up at the last meeting. Commissioner Baker noted that he was not excited about the color of the Market Place but noted that the scheduled date for the opening of the STOR and Home Express was October 19, 1988.
