AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
AMENDING ARTICLE 8, BUILDINC REGULATIONS, OF THE
TUSTIN CITY CODE AND AMENDING ORDINANCE NO. 755
The City Council of the City of mustin, California, does
ordain that Ordinance No. ~'~'~' and Article ~, Building Regu-
lations, Tustin City Code is hereby amended as follows:
1. Building Code, ChaDter l'is .hereby amended to read
as follows: '-
ARTICLE 8101 - AMENDMENT OF THE 1976 UNIFORM CODE
The 1976 edition of the Uniform Building Code, is hereby
amended as follows:
Section 303(b)
Add an additional paragraph to read as follows:
"Buildings and structures requiring noise isolation and
insulation and/or energy conservation as enforced bv the Building
Official as required by Article 24, State Administrative Code,
shall be plan checked bv the Buildin~ Official. In addition to
the above plan check fee, a plan check fee in the amount of fifty
percent of the Building Permit fee shall be charged for plan
checking these State mandated acts."
2. Plumbing Code, Cha~ter 3, is hereby amended to read
as follows:
ARTICLE 8301 - AMENDMENTS
The 1976 Uniform Plumbing Code is hereby amended as follows
Section 315
Section 315 is amended by adding a new subsection to read
as follows:
" 315(g). All earth within the City of Tustin is corrosive
unless the permittee proves to the satisfaction of the Building
Official the sDecific earth is not corrosive to the plUmbinG
piping, fittings, fixtures and/or equipment for installation in
contact with or buried in the ground. Steel or galvanized steel
shall be protected by at least double, spiral Wr~DDing half over-
lapping with 10 mil plastic tape (total 40 mils cover) or aDoroved
equal.
ARTICLE 8303 - .~ENDMEMTS
The 1976 Uniform Solar Energy Code is herebV amended as
follows:
Section 305
Section 305 is amended by adding a new subsection to read
as follows:
305(g). All earth within the City of Tustin is corrosive
unless the Dermittee ~roves to the satisfaction of the Building
Official the specific earth is not corrosive to the Dlumbin~
piping, fittings, fixtures and/or equipment for installation in

3. Electrical Code, ChaDter 4, is herebV amended to read

ARTICLE 8401 - A~ENDMENTS
~ The 1978 Edition, National Electric Code is hereby amended
as foIlows:

(a) Section 110-5

Section 110-5 is hereby deleted and the following
· 0 substituted to read:
~ "conductors normally used to carry current shall be
of copper."

(b) Section 250-91(a)
Section 250-9(a) is hereby deleted and the following
substituted to read:
"(a) Grounding Electrode Cbnductor. The grounding
electrode conductor shall be of cooper. The material selecte~
shall be resistant to any corrosive condition existina at th~
installation or shall be suitably protected against corrosion.
The conductor shall be solid or stranded, insulated, covered,
or bare and shall be installed in one continuous length without
a splice or joint.
Exception No. 1: Splices in busbars shall be Dermitted.
Exception ~]o. 2: Where a service consists of more than a
single enclosure as permitted in Section 230-~5, it shall be
missib!e to connect taos to the groundin~ electrode conductor.
Each such tap conductor shall extend to the inside of each such
enclosure. The grounding electrode conductor shall be sized in
accordance with Table 250-94, but the tad conductors shall be
permitted to be sized in accordance with the grounding electrode
conductors specified in Table 250-94 for the largest conductor
serving the respective enclosures."
(c) Section 300-6(b)
Section 300-6(b) is amended bv adding the followina
paragraph:
"All earth within the City of Tustin is corrosive
unless the permittee proves to the satisfaction of the Buildin~
Official the specific earth is not corrosive for the installation
of the above noted electrical items in contact with or buried in
the earth. Unless authorized othe~ise bv the Buildin~ official,
50 all such items embedded in the ~round shall b~ protected by at
least double, spiral wrapping half overlaDping with 10 mil plastic

(d) Section 336-3
Section 336-3 is hereby omitted and the following is
substituted to read:
"336.3. Uses Permitted or Not Permitted. Type MM
and NMC cables shall be permitted to be used in Class R-l, R-3
and M-1 occupancies provided the building does not exceed three
floors above grade. For the PUrPOSe of this article, the first
floor of a building shall be that floor designed for human habi-
tation which is level with or above finished grade of the exterior
wall line of 50 percent or more of its perimeter.
(a) Type NM. This type of nonmetallic-sheathed cable
shall be permitted to be installed for both exposed and concealed
work in normally dry locations. It shall be permissible to install
or fish type NM cable in air voids in masonry block or tile walls
where such walls are not exposed or subject to excessive moisture
or dampness.
Type NM cable shall not be installed where exposed
'to corrosive fumes or vapors; nor shall it be imbedded in masonry,
concrete, adobe, fill, or plaster; nor run in a shallow chase in
masonry, concrete or adobe and covered with plaster, adobe or
similar finish.
(b) Type NMC. Type NMC cable shall be permitted for
both exposed and concealed work in dry, moist, damp, or corrosive
locations, and in outside and inside walls of masonry block or tile
(c) Uses Not Permitted for Either Type NM or NMC.
Types NM and NMC cables shall not be used as: (1) service-entrance
cable, (2) in commercial garages, (3) in-theaters and similar
locations, except as provided in Article 51~, Places of Assembly,
(4) in motion-picture studios, (5) in storage batterV rooms,
in hoistways, (7) in any hazardous location (8) embedded in poured
cement, concrete, or aggregate.
Exceotion: See Section 501-4(b) Exception.,,
(e) Section 350-2
Section 350-2 is hereby omitted and the following is
substituted to read:
"350-2. Use. Flexible metal conduit shall n6t be
used: (!) in wet locations, unless conductors are of the lead-
covered type or of other type aDproved for the specific conditions;
(2) in hoistways, other than orovided in Section ~20-21; (3) in
storage-battery rooms; (4) in any hazardous location other than
permitted in Section 501-4(b); (5) where rubber-covered conductors
are exposed to 'oil, gasoline, or other materials having a deteri-
orating effect on rubber; (6) underground or embedded in poured
concreEe or aggregate; nor (7) ~XceDt for Class R-l, R-3 and M-1
occupancies) where subject to physical damage subsequent to in-
stallation including occupancy.
(f) Section 680-20 (a) (1)

Tustin City Code, is herebyomittedand the following is sub-
stituted to read:
"The installation and use of any underwater lighting
fixtures supplied by a branch circuit either directly or by way of
a transformer meeting the requirements of Section 680-5(a) shall be
such that there be no shock hazard with a likely fault-cOndition by
including the installation of a ground-fault circuit-interrupter in
the branch circuit." -'
4. GENERAL PENALTY; CONTINUING VIOLATION
No person shall violate any provision, or fail to comply
with any of the provisions of this Code or of any code adopted
herein by reference. Any person violating any of the provisions
or failing to comply with any of the mandatory requirements of this
Code, or of any code adopted by reference herein, unless otherwise
specified in this Code, shall be punishable by a fine of not more
than $500.00 or by imprisonment in the City or County jail for a
period. of not exceeding six months, or by both such fine and im-
prisonment. Each such person violating such provision or failing
to comply with such requirements shall be guilty of a separate
offense, and each day during any portion of which any violation of
any provision of this Code, or of any code adopted by reference
herein, is comaitted, continued, or permitted by such person, shall
constitute a separate offense, and shall be punishable accordingly.
Provided further that each such person violating a provision which
limits the time an act may be permitted or continued, each such
period or portion thereof of which any violation of such provision
is committed, continued or permitted by such person shall con-.
stitute a separate offense, and shall be punishable accordingly.
In addition to the penalties hereinabove provided, any
condition caused or permitted to exist in violation of any of the
provisions of this Code, or of any code adopted by reference herein
shall be deemed a public nuisance and may be summarily abated as
such ~y this City, and each day such condition continues shall be
regarded as a new and separate nuisance and offense.
5. SEVERABILITY OF PARTS OF CODE
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this Code are severable,'and if any phrase, Clause,
sentence, paragraph or Section of this Code shall be declared
unconstitutional by the valid judgment or decree of a court of com-.
petent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs and
sections of this Code.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin, held on the 21st day of February, 1978. ,
