Minutes of May 12, 1986 Planning Commission Meeting. 2. A.T. & S. F. Bridge at Peters Canyon (FO6 Channel). Commissioner Puckett moved, Baker seconded to approve the Consent Calendar. carried 4-0. PUBLIC HEARINGS 3. SUBDIVISION MAP ACT AMENDMENT Applicant: City of Tusttn Request: Adopt Resolution No. 2337 amending Subdivision Map Act. Motion Presentation: Mary Ann Chamberlain, Associate Planner The following changes were presented to Resolution No. 2337: Page two, Section 9335.5 Page two, Section 9335.5 a.) Page three, Section 3.) Page three, Section 9.) Eliminate reference to # g340. Change # 9340 to 9330. Should read: Specific and detailed preliminary grading. Should read: An environmental assessment statement and/or imput for a draft environmental impact report pursuant to the California Public Resources Code as determined by the Director of Community Development. Page four, Section 9335.8, b.) Should read: The rights referred to herein shall expire if a final map is not approved pursuant to Section 9340 of the Tustin City Code, prior to the expiration of the vesting tentative map as provided in Section 9361 {d) of the Subdivision Ordinance. If the final map is approved, these rights shall last for the following periods of time: .... May 27, 1986 Page two The public hearing was opened at 7:43 p.m., seeing ahd hearing no one, the public hearing was closed at 7:44 p.m. Commissioner Puckett moved, Mc Carth¥ seconded to approve the Subdivision Map Act Amendments by the adoption of Resolution No. 2337. Motion carried 4-0. 4. AMENDMENT NO. i TO USE PERMITS 76-25 AND 77-23 Applicant: Location: Property Management: 500 E. First Street Larwin Square, Ltd. 275 Centennial Way Tustin, Ca. 92680 Request: 1. Amend Use Permit 76-25 to authorize the enclosure of a garden shop area adjacent to the space currently occupied by Designer Depot; and Amend Use Permit 77-23 authorizing conversion of a free-standing key shop into an automated bank teller. Presentation: Jeffrey S. Davis, Associate Planner The public hearing was opened at 7:47 p.m., seeing and hearing no one the public hearing was closed at 7:48 p.m. Commissioner Mc Carth¥ questioned whether a specific bank would be using the automated teller. Staff responded that there was none at this point in time. Commissioner Mc Carthy also questioned whether these two items could be split and voted on separately. Staff responded that a separate resolution could be written for each amendment. Commissioner Baker moved, Puckett seconded to approve Amendment No. 1 to Use Permits 76-25 and 77-23 by the adoption of Resolution No. 2336. Motion carried 3-1 (Mc Carthy). 5. TENTATIVE TRACT MAP 12759 Applicant: Location: Request: J. P. Kapp & Associates on behalf of the Irvine Company North of the Santa Ana Freeway, West of Jamboree, East of E1Camino Real Authorization to subdivide eight (8) (three [3] numbered and five [5] lettered) lots into five (5) numbered lots. Presentation: Mary Ann Chamberlain, Associate Planner Staff reported that the applicant, J. P. Kapp, has requested that Tentative Tract Map 12759 and Site Design Review 86-6 be continued until the next Planning Commission meeting (June g, 1986). Commissioner Puckett moved, Mc Carth¥ seconded to continue the public hearing on Tentative Tract Map 12759 and Site Design Review 86-6 to the next meeting. Motion carried 4-0. Planning Commission Minutes May 27, 1986 Page three 6. AMENDMENT NO. i TO USE PERMIT 85-14 Applicant: Mark D. Cernich Location: 730 E1Camino Way Request: Authorization to amend Use Permit 85-14 as follows: 1. To reduce the height and square footage of the approved project; and 2. To construct a revised project on a smaller parcel as the result of a state proposed freeway widening project. Presentation: Jeffrey S. Davis, Associate Planner The public hearing was opened at 7:79 p.m., seeing and hearing no one the public hearing was closed at 8:00 p.m. Commissioner Mc Carth¥ moved, Puckett seconded to approve Amendment No. I to Use Permit 85-14 by the adoption of Resolution No. 2335. Commissioner Well asked the maker of the motion if the motion could be amended to include the following: B. That the structure approved by Amendment No. i to Use Permit 85-14 shall not exceed (2) two stories or 40 feet above existing grade. C. That the maximum square footage of gross floor space of the modified office structure shall not exceed 7,450 square feet. D. That compact sized parking spaces on the modified site shall be limited to a maximum of 30% of total spaces required. Motion carried 4-0. The maker and second agreed to amendments. Old Business 7. TUSTIN AUTO CENTER LOUDSPEAKER CRITERIA Presentation: Edward M. Knight, Senior Planner Staff presented the following changes in Exhibit "A" Resolution No. 2334: 3. 5. 10. (Sound System Standards) of Change of Hours; 7:00 p.m. Shall read: All loudspeakers shall be directed toward the interior of each lot. Each speaker layout system shall be subject to review and approval by the Community Development Department. Prior to the actual use of any loudspeaker system, an inspection shall be made by the City of Tustin to ensure that the system is operating according to all sound system criteria, both on and off-site. Maximum Sound levels: a. 35 dB(A) b. 50 dB(A) c. 60 dB(A) David Dubbtnk, of David Dubbtnk Associates began a computer analysis presentation illustrating noise levels at 8:10 p.m. His presentation ended at 8:50 p.m. The public hearing was opened at 8:52 p.m. Bonnie Holmes, representing The Irvine Company, gave an explanation of the process of the loudspeaker study. Hubert Huber, 13882 Dall Lane, Santa Ana, Ca., spoke in opposition of the use of loudspeakers in the Auto Center. His concerns were quality of life in the area and the possibility of a high noise level in the immediate residential area. Hubert Clark, 1942 San Juan, Tusttn, Ca., representative of San Juan Homeowner's Association questioned who will enforce the noise levels coming from the Auto Center. Staff responded that there will be periodic random inspections to ensure requirements are adhered to, any complaints are to be directed to the Code Enforcement Officer. Jim Hughes, 1752 Lance Drive, Tusttn, Ca., questioned the calculations used for sound acoustics. He stated that he felt the issue was psychological acoustics, their effects on human beings and how they are perceived. Odette Schindler, 13881 Browning Avenue, Tusttn, Ca., questioned the fairness of the necessity for residents of the area to be responsible for "Watchdoggtng" the area. She stated she does not want to have to continue to attend public hearings everytime another issue comes up. Joseph Gorrie, 13881 Browning Avenue, Tusttn, Ca., spoke in opposition, questioning the studies done by The Irvine Company. Carol Taylor, 13532 Farmtngton Rd., Tusttn, Ca., stated that if there are 12 dealers and each dealer is able to have their loudspeaker in use 5 minutes per hour, there would be no time when there would not be loudspeaker noise. A discussion between Commission, Staff, Mr. Gorrie, Mr. Hughes, Mr. Mc Lean, representing Mc Lean Cadillac, Mr. Huber and Ms. Holmes ensued concerning paging systems, the criteria used for the sound system study, the number of dealerships and whether or not it was necessary for Commission to decide this matter at this point in time. Mr. Bruce Mc Lean, representing Mc Lean Cadillac, spoke in favor of using the Loudspeaker System in conjunction with hand held pagers. Mr. Stanley Taylor, 13532 Farmington Road, Tustin, Ca., stated that the problem with deciding this tonight is that there is no recourse. The public hearing was closed at 9:40 p.m. Planning Commission Minutes May 27, 1986 Page fi ve Chairman Well confirmed that the proposal is a mixture of hand held paging systems for the sales people and loudspeakers for the lot and customer areas. Commissioner Mc Carth¥ asked what recourse residents have if there is a problem. Staff responded that there could be enforcement of the public nuisance ordinance if there is a problem. Commissioner Well questioned the placement of speakers. Staff responded that the plans, including specific speaker placement, must be approved by the Planning Department and that permits must be issued before installation. Commissioner Puckett moved, to approve the Tusttn Auto Center Loudspeaker Criteria by the adoption of Resolution No. 2334. Motion failed due to lack of second. Commissioner Wetl moved, Puckett seconded to approve the Tustln Auto Center Loudspeaker Criteria by the adoption of Resolution No. 2334 including the changes introduced by staff with the change of Item No. 3.) to: Change of Hours; 6:00 p.m. Motion carries 2-1-1. Vote: Ayes, Well, Puckett; No, Mc Carthy; Abstention, Baker. ~ Bustness 8. SITE DESIGN REVIEW 86-6 Applicant: Location: Request: Irvlne Pacific Company Area 3, East Tusttn Phase I Residential Project bounded on the east by Jamboree Road, on the south by the Santa Aha Freeway, on the west and north by E1Camino Real. Approve the Design Review by the adoption of Resolution No. 233g. Presentation: Mary Ann Chamberlain, Associate Planner Site Design Review 86-6 was continued until the next meeting by Commission action taken in conjunction with Tentative Tract Map 12759 Item No. 5. STAFF CONCERNS 9. Report on Council Actions, May 20, 1986. Presentation: Donald D. Lamm, Director of Community Development The appeal of Sign Variance 86-3 was noticed for public hearing for June 2, 1986. There will be the following road name changes: Jamboree between Moulton Parkway and Bryan Avenue is now Tustin Ranch Road; Moulton Parkway between Red Hill and Harvard will become Edinger Avenue; Myford Road from Harvard to the northerly boundaries of the City will become Jamboree. Planning Commission Minutes May 27, 1986 Page st x Council will pick Planning Commissioners on a one on one basis, with each choice being ratified by 3 out of 5 Council members. The results will be known by July 1. All Commission actions of May 12, 1986 were ratified by the Council at their May 19, 1986 meeting. Commissioner Wetl will not be present at the June 9, 1986 meeting and Commisstner Baker will be absent on the June 23, 1986 meeting. Donald Lamm officially notified the Commission that he has resigned from the City of Tusttn to accept the position of Director of Development Services for the City of Costa Mesa as of June 10, 1986. COI&qISSION CONCERNS Commissioner Mc Carthy asked about the Bryan Avenue striping. There will be a status report on the June 9th agenda.
