1. Minutes from Planning Commission meeting October 8, 1984.
2. Resolution No. 2174, approving Variance 84-1, Lindsey
3. Resolution No. 2183, approving Variance 84-2, Drug Emporium
4. Resolution No. 2191, Use Permit 84-25, Tustin Pre-school
Commissioner Sharp moved, Well second to approve all items on the Consent Calendar.
Motion carried 5-0.
CONTINUED PUBLIC HEARINGS
5. USE PERMIT 84-23

Request:
Larwin Square Limited on behalf of Home Savings and Loan
Corner of Newport Avenue and First Street.
Authorization to construct and operate a 2,418 square
foot savings and loan in the Larwin Square shopping center.
Presentation:

Chair~n White opened the public hearing at 7:44 p.m. The following people spoke in
favor of Use Permit 84-23: Doug Danielson, architect, and Morrey Friedman, Manager
of Larwin Square, supported Alternative 2.
Seeing no one further wishing to speak Chairman White closed the public hearing at
7:55 p.m.
Commission discussion ensued concerning the two Alternatives. Commissioner Weil
moved, Sharp second to approve Alternative 1 as recommended by staff. Motion carried
3-2 (McCarthy/Puckett opposed).

6. ZONE CHANGE 84-6

17432 & 17442 Mitchell Avenue.
Authorization to change the zone from multiple family residential
(R-3, 2000) to Planned Community Senior Residential
Presentation:
Mary Ann Chamberlain, Associate Planner
Chairman White opened the public hearing at 8:00 p.m. The following person spoke in
favor of Zone Change 84-6: Mark Ferguson, applicant, questioned the necessity for
two exits and requested the City donate water and sewage fees since it is a public
service project.
Seeing no one further wishing to speak, Chairman White closed the hearing at 8:14
p.m. Commission discussion ensued concerning the Uniform Building Code requirements
for two exits and they advised Mr. Ferguson to present his request to the City
Council for waiver of fees for water and sewage. Further discussion ensued
concerning staff's recommendation for a roof parapet, outside parking area and age
restrictions for tenants.
Commissioner Weil moved, Sharp second to recommend approval to the City Council by
the adoption of Resolution 2188 with the conditions contained in Exhibit "A". Motion
carried 5-0.
7. REVOCATION HEARING FOR USE PERMIT 80-21

Consideration of revoking use permit thereby terminating the
conversion from apartments to condominiums.

Chairman White opened the public hearing at 8:25 p.m. The following people spoke in
favor of revoking Use Permit 80-21: Mark Rafter, tenant, explained in detail the
the existing living conditions at the complex. Michael Daly, property owner on two
stdes of complex, felt this project was a disgrace to the community due to the
numerous police reports, fire hazards, health hazards, trees and fences collapsing
onto his properties.
Seeing no one further wishing to speak, Chairman White closed the hearing at 8:50
p.m. Commission discussion ensued over the developer's desire to complete the
project and what incentive the City could provide.
Commissioner Sharp moved, McCarthy second to recommend to the City Council revocation
of Use Permit 80-21. Motion carried 5-0.

PUBLIC HEARINGS
8. USE PERMIT 84-24 AND TENTATIVE PARCEL MAP 84-1031
Applicant: Albert Auer on behalf of Tustin Corporate Park
Location: Southwesterly corner of Walnut Avenue and Franklin Avenue
Request: Authorization to develop a mixed use project consisting of
104,300 square feet of Research and Development, 39,800 square
feet of commercial office and 10,000 square feet of retail
commercial.

Chairman White opened the public hearing at 9:05 p.m. The following person spoke in
favor of Use Permit 84-24: David Netsh, Tustin Corporate Park Ltd., concurred with
staff's recommendation.
Seeing no one further wishing to speak, Chairman White closed the hearing at 9:07
p.m.
Commissioner Puckett moved, Well second to approve Use Permit 84-24 and recommend to
City Council approval of Tentative Parcel Map 84-1031. Motion carried 5-0.
9. ZONING ORDINANCE AMENDMENT 84-3
Applicant: City of Tusttn.
Request: To amend City Zoning Ordinance to require a conditional use permit
for any business to sell alcoholic beverages.
Presentation: Jeff Davis, Assistant Planner
Chairman White opened the public hearing at 9:11 p.m. Seeing no one wishing to
speak, he closed the hearing at 9:12 p.m.
Commissioner Sharp moved, Well second to approve Resolution 2187. Motion carried
5-0.

CO~I~ISSION CONCERNS
Commissioner Sharp expressed concern and wondered if the City can prohibit any
further Windsor Garden type projects.
Commissioner Weil thanked Jeff Davis for the letter to Redhill Shopping Center.
Commissioner White requested a letter to Alan Warren. He further commented that he
didn't feel zone changes should be contingent upon development plans, but development
plans should require conditional use permits .
