The Pledge of Allegiance was led by Commissioner Weil and the Invocation was given by Commissioner Puckett. ROLL CALL Commissioners Present: Commissioners Absent: Also present: James B. Motion carried, 5-0. PUBLIC CONCERNS None. CONSENT CALENDAR None. CONTINUED PUBLIC HEARINGS 1. TENTATIVE TRACT NO. 12018 Applicant: Location: Request: Richard Pierce Properties at the southeasterly corner of Warren Avenue and Holt Avenue (Annexation No. 133 area) Authorize subdivision of the property for townhome purposes After presentation of the staff report and staff's recommendation to continue the hearing to the next regular meeting, Chairman Sharp opened the public hearing at 7:40 p.m. It was moved by Well, seconded by Puckett, to continue the public hearing to the next regular meeting on December 12, 1983. Motion carried, 5-0. 2. USE PERMIT 83-23 Applicant: Location: Request: Systems Engineering and Construction Co. on behalf of Walter Fredriksen 545 South "B" Street Authorization to develop a five-unit, two story apartment complex and vary from the minimum lot frontage of the Multiple-Family Residential (R-3) District After presentation of the staff report, Chairman Sharp opened the public hearing at 7:44 p.m. The following person spoke in opposition to the matter: Planning Commission Minutes November 28, 1983 Page 2 Theresa Arndt, 535 South "B" Street, expressed opposition to the density of the project and its situation on the lot. She stated she felt if the project were to be approved for fewer units and "flipped", she would retain more privacy and air circulation. Seeing no one else wishing to speak, Chairman Sharp closed the public hearing at 7:46 p.m. It was moved by Puckett, seconded by Weil, to approve Use Permit 83-23. Commissioner White requested an amendment, the maker of the motion and the second agreed, that Commission concerns regarding trash enclosure location and recreational area access be resolved. After further discussion regarding the trash enclosure location and density, the motion failed, 4-1, Puckett in favor. It was moved by White, seconded by Weil, to approve Use Permit 83-23 with a density of four (4) units, that the project be "flipped" on the lot, and that the problems regarding trash enclosure location and recreational area access be resolved. Motion carried, 4-1, Puckett opposed. PUBLIC HEARINGS 1. REVOCATION OF VARIANCE 81-8 Applicant: Owner: Location: Action: Initited by the City of Tustin Cai-State Associates, Inc. 14882-14942 Newport Avenue, Californian Apartments A hearing initiated by the City of Tustin to receive public input and to consider the possible revocation of Variance 81-8 thereby terminating the conversion of the Californina Apartments at 14882-14942 Newport Avenue into condominiums Director Lamm presented a letter from Cai-State Associates, Inc. dated November 11, 1983 requesting the City accept Cai-State's voluntary relinquishment of Variance 81-8. After determination that the public hearing should still be held, Chairman Sharp opened the public hearing at 7:58 p.m. Seeing no one wishing to speak, Chairman Sharp closed the public hearing at 7:59 p.m. After discussion with the City Attorney as to proper procedure, it was moved by Puckett, seconded by Well, to recommend to the City Council, by Minute Order, acknowledgement of Cai-State's request to relinquish Variance 81-8. Motion carried, 5-0. 2. AMENDMENT NO. I TO USE PERMIT 80-3 Applicant: Location: Request: Burnett-Ehline Company Southwest corner of Irvine Boulevard and Newport Avenue (18352-18376 Irvine Boulevard) Authorization to develop a 17,739 square foot retail commercial and office building in conjunction with a previously approved office structure. Director Lamm presented staff's report and in response to questions from Commissioner Ainslie, stated that access to the project was not provided from Newport Avenue because of the bike trail. Chairman Sharp opened the public hearing at 8:09 p.m. The following person spoke in favor of the Amendment: Mr. Phillip Schwartze, representative of the applicant, stated that all conditions contained in the staff report dated November 28, 1983 were acceptable. Planning Commission Minutes November 28, 1983 Page 3 Seeing no one else wishing to speak, Chairman Sharp closed the public hearing at 8:11 p.m. In response to questions from Chairman Sharp and Commissioner Ainslie, Director Lamm explained Condition #17 {requirement for State Board of Equalization resale tax number) and #18 (reciprocal parking and access agreement) of Exhibit "A". After further discussion regarding an entrance to the project from Newport Avenue, it was moved by Ainslie, seconded by Well, to approve Amendment No. I to Use Permit 80-3, in concept with a recommendation to the City Council that an entrance be provided from Newport Avenue in addition to access already provided. Commissioner White requested an amendment to the motion, the maker of the motion and the second agreed, that Condition #18 of Exhibit "A" be changed to read that the reciprocal access and parking agreements be recorded prior to issuance of building permits. Motion carried, 5-0. 3. USE PERMIT 83-22 Applicant: Location: Request: Robert Bender 6th Street and E1Camino Real, E1Camino Plaza Shopping Center Authorization to develop an additional 4,000 square feet of retail building area to the E1Camino Plaza Shopping Center Director Lamm presented staff's report stating that the applicant had attempted to respond to concerns regarding the appearance of the rear elevation. He also stated that a proposed driveway entrance conflicted with newly installed street furniture and input from the City Engineer should be sought. Commissioner Weil asked if the building could be moved to another location on the site. Mr. Lamm responsed that staff did not make such a recommendation as the main concern was only a more attractive appearance for the northern elevation. Chairman Sharp opened the public hearing at 8:38 p.m. The following person spoke in favor of Use Permit 83-22: Robert Bender, applicant, stated the owner had instructed him to use a previously approved use permit as a guideline for developing the proposal. Staff determined that the original use permit referred to was approved in 1980, prior to enactment of the beautification program for the downtown area. Seeing no one else wishing to speak, Chairman Sharp closed the public hearing at 8:44 p.m. It was moved by Puckett, seconded by Ainslie, to continue consideration to the next regular meeting to allow staff to work with the applicant and make revisions to the proposal. Motion carried, 5-0. 4. VARIANCE 83-9 Applicant: Location: Request: Lewis Properties, Inc. 14472 Plaza Drive Authorization to vary from the front and side yard setbacks required by Specific Plan No. 4 in conjunction with the construction of an office building After presentation of the staff report, Chairman Sharp opened the public hearing at 8:50 p.m. Seeing no one wishing to speak, Chairman Sharp closed the public hearing at 8:51 p.m. It was moved by Ainslie, seconded by Weil, to approve Variance 83-9. AMENDMENT TO SPECIFIC PLAN NO. 6: HOLT NEIGHBORHOOD PLAN Applicant: Location: Action: City of Tustin Area located on the easterly side of Holt Avenue, westerly of the E1 Modena Flood Control Channel, southerly of Warren Avenue and northerly of the North Tustin Channel Amend the Specific Plan for residential uses, specifically addressing residential limit density and circulation After presentation of the staff report, Chairman Sharp opened the public hearing at 8:58 p.m. Seeing no one wishing to speak, Chairman Sharp closed the public hearing at 8:59 p.m. It was moved by Ainslie, seconded by Puckett, that the Planning Commission recommend to the City Council the amendments as described in the staff report dated November 28, 1983 to the City Council. Motion carried, 5-0. ADNI#ISTRATIVE NATT£RS A. Old Business 1. Extension of Tentative Tract Map No. 10300 14882-14942 Newport Avenue, Californian Apartments Director Lamm presented staff's report recommending approval of the extension request with two stipulations: 1. In six months a status report be presented informing the Commission if a new property owner would be proceeding with the project or whether Cai-State would be proceeding with a new use permit; and 2. That the final subdivision map for Tentative Tract 10300 may not be recorded until the property owner obtains use permit approval by the Planning Commission to convert the Californian Apartments into condominiums. Commissioner Ainslie asked if in granting an extension, would the City be committed to a proposal similar to that offered by Cai-State Associates. Mr. Lamm replied it would not. Commissioner White suggested a 30-60 day extension to encourage the developer to proceed quickly with improvements. Steve Price, representative of Cai-State Associates, expressed opposition to the idea stating it could hurt the marketability of the project. He stated Cai-State was making an attempt to improve the property and had completely re-roofed two or three buildings. In response to questions from Chairman Sharp, Mr. Price stated that they did not intend to sell the property without making certain improvements. It was moved by Ainslie, seconded by White, to approve a one-year extension, with a review in six months, subject to the following conditions: 1. In six months a status report be presented informing the Commission if a new property owner would be proceeding with the project or whether Cai-State would be proceeding with a new use permit; and 2. That the final subdivision map for Tentative Tract 10300 may not be recorded until the property owner obtains use permit approval by the Planning Commission to convert the Californian Apartments into condominiums. Design Review for Proposed Commercial Center at the Northeast Corner of Newport Avenue and Walnut Avenue Chairman Sharp questioned how deliveries could be made to the rear doors with only ten feet between the building and the property line wall. Mr. Lamm responded that most deliveries were probably made through the front doors during off-peak hours and the rear doors were most likely a requirement of the Fire Department. It was moved by Puckett, seconded by White to approve by Minute Order, the site plans and elevations for the proposed commercial center at the northeast corner of Newport Avenue and Walnut Avenue.
