STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: APPROVE AMENDMENT NO. 1 TO COOPERATIVE AGREEMENT NO. C-9-0426 BETWEEN THE ORANGE COUNTY TRANSPORTATION AUTHORITY AND THE CITY OF TUSTIN FOR GO LOCAL BUS/SHUTTLE SERVICE PLANNING SUMMARY The City and the Orange County Transportation Authority (OCTA) are currently developing studies for adding shuttle service between the Tustin Metrolink Station, Tustin Legacy and the Tustin Civic Center/Downtown as part of the Go Local Step 2 Program. Amendment No. 1 to Cooperative Agreement No. C-9-0426 authorizes an expansion of the studies to include new options to further expand transit services within the City under the Renewed Measure M Project V. RECOMMENDATION It is recommended the City Council: Approve Amendment No. 1 to Cooperative Agreement No. C-9-0426 between the Orange County Transportation Authority and the City of Tustin for Go Local Bus/Shuttle Service Planning; and 2. Authorize the Mayor and City Clerk to execute the document on behalf of the City. FISCAL IMPACT The City is responsible for 10% or $4,722 of the cost of the required studies. Sufficient funds have been budgeted and appropriated in this Fiscal Year 2010-2011 Capital Improvement Program for Go Local-Step 2 Project CIP 10063. DISCUSSION On September 1, 2009 the City Council approved Cooperative Agreement No. C-9-0426 under which the City and OCTA were to jointly develop more detailed studies under Go Local Step 2 for adding shuttle service from the Tustin Metrolink Station to the Tustin Civic Center/ Downtown and the Tustin Legacy. On October 26, 2009 the OCTA Board of Directors approved the advancement of additional concepts under Renewed Measure M Project V, which is a competitive program for local jurisdictions to develop local bus transit community based circulators, shuttles and bus trolleys that complement regional bus and rail services. Studies could include an Old Town Trolley and expanded shuttle services for senior citizens. Amendment No. 1 to the cooperative agreement authorizes study of additional transit concepts under Project V for the City of Tustin. C-9-0426 ' BETWEEN ORANGE COUNTY TRANSPORTATION AUTHORITY AND CITY OF TUSTIN FOR GO LOCAL BUS/SHUTTLE SERVICE PLANNING THIS AMENDMENT NO. 1 is made and entered into this day of , 2010, by and between the Orange County Transportation Authority ("AUTHORITY") and the City of Tustin, ("CITY"). RECITALS: WHEREAS, by Agreement No. C-9-0426 dated September 24, 2009, AUTHORITY and CITY entered into a cooperative agreement for Go Local buslshuttle service planning; and WHEREAS, the AUTHORITY'S Board of Directors, on October 26, 2009, approved the advancement of additional concepts for project V into Step Two for further study; NOW, THEREFORE, it is mutually understood and agreed to by AUTHORITY and CITY that Agreement No. C-9-0426 is hereby amended in the following areas: Amend Page 2 of 7, line 6, to insert the following; "WHEREAS, the AUTHORITY's Renewed Measure M Project V establishes a competitive program for local jurisdictions to develop local bus transit comriunity based circulators, shuttles and bus trolleys that complement regional bus and rail services to meet the needs in areas not adequately served by regional transit; and WHEREAS, the CITY desires and the AUTHORITY agrees to add additional bus/shuttle proposals submitted under Project V be included in Step Two detailed service planning; and" L:1Camm\CLERICAL\WORDPROCWGREEWMENDb4Mt 90426.doc Page 1 of 2 AMENDMENT N0.1 AGREEMENT NO.
