SUBJECT: AMENDING THE CLASSIFICATION AND COMPENSATION PLANS TO
INCLUDE THE PROJECT CLASSIFICATION OF TUSTIN LEGACY
DEVELOPMENT SERVICES MANAGER
SUMMARY
Adoption of the attached Resolution will amend the City's Classification Plan and
Compensation Plan to include a new project classification titled Tustin Legacy
Development Services Manager and authorized funding for the position.
RECOMMENDATION
It is recommended that the City Council:
Adopt Resolution No. 10-90 amending the City's Classification and
Compensation Plans to include the new project classification of Tustin Legacy
Development Services Manager.
2. Authorize the appropriation of $120,000 from unappropriated funds in the MCAS
Tustin Redevelopment Fund (555) for the balance of Fiscal Year 2010-11 which
shall be transferred to MCAS Tustin RDA account 555-35-00-5000 through 5270,
as applicable. In the event of future tax exempt bond financing for infrastructure
construction and management, said bond proceeds shall be utilized, as may be
authorized in the bond measure, for the costs of the Tustin Legacy Development
Services Manager.
FISCAL IMPACT
The anticipated annualized base salary cost of the new position would be approximately
$129,844.97, and approximately $160,000 with benefits.
BACKGROUND AND DISCUSSION
With the City's recent termination of the Disposition and Development Agreement and
reversion of all properties previously owned by Tustin Legacy Community Partners, LLC
(TLCP) within the Master Developer Footprint back to the City, it was expected that the
Redevelopment Agency would incur expenses for activities associated with revision of

the City's disposition and business strategy for the Tustin Legacy Project, including but
not limited to, necessary engineering services and proceeding with design on priority
Tustin Legacy Backbone Infrastructure.
The Agency is now proceeding with completing design of various unfinished plans for
major Tustin Legacy Backbone Infrastructure projects that TLCP started and never
completed as authorized by the City Council in early August, including but not limited to
Tustin Ranch Road. A financing plan for construction of certain Tustin Legacy
Backbone Infrastructure projects will also be forthcoming.
Given the extent of management and oversight necessary on design and construction of
Tustin Legacy Backbone Infrastructure and various transportation and infrastructure
activities and services at Tustin Legacy, the need to obtain additional staff support for
these Tustin Legacy activities has been identified. It is proposed that the classification
of Tustin Legacy Development Services Manager be created to plan, manage, and
direct these activities. Given the highly complex nature of the project, it is expected that
the engagement of a Tustin Legacy Development Services Manager will be needed for
at least three (3) years, with possible extensions as necessary to ensure completion of
the project.
The employee appointed as the Tustin Legacy Development Services Manager would
be classified as a "project employee" as defined in the City's Personnel Rules. A project
employee holds a position which has been authorized by the City Council for a
prescribed period of time or to complete a specified project. A project employee is
employed at-will and does not earn the right to employment beyond the specific period
authorized. As an at-will employee, employment may be terminated at any time by
either the City or the employee.
The Tustin Legacy Development Services Manager would report to the Director of
Public Works and the Assistant City Manager. The employee would be assigned to
complete the envisioned infrastructure projects, supplement and support the activities of
the Public Works Transportation and Development Services Manager, and provide the
necessary expertise for a variety of tasks that are important to keeping things moving
including:
• The management of a variety of various transportation and infrastructure
activities, both in the design phase and the construction phase
• Providing necessary technical engineering advice and coordination with various
city departments, staff, and consultants

• Planning and directing engineering studies including gathering data, preparing
preliminary drawings and specifications and bid documents and construction cost
estimates
• Compliance with state and federal environmental and other regulatory
requirements
• Necessary follow-up and coordination with environmental regulators and
environmental insurance underwriters on open environmental remediation claims
within the former Master Developer footprint
• Oversight over property management/caretaker functions now within the
Agency's responsibility
• Updates to the Tustin Legacy Backbone Infrastructure Program including
definition of construction responsibilities by parcel or land disposition package
The monthly salary range for the Tustin Legacy Development Services Manager would
be $8,861 - $10,820. This salary range is identical to that of the existing Transportation
and Development Services Manager, the most comparable position at the City. In
accordance with the City's Personnel Rules, the City shall provide the Tustin Legacy
Development Services Manager with the same benefits that are provided to employees
in the unrepresented Management unit.
The attached Resolution authorizes the creation of the classification of Tustin Legacy
Development Services Manager and establishes terms and conditions of employment
for an individual hired into this classification as a project employee consistent with the
Personnel Rules.

TUSTIN AMENDING THE CLASSIFICATION AND
COMPENSATION PLANS TO INCLUDE THE
CLASSIFICATION OF TUSTIN LEGACY DEVELOPMENT
SERVICES MANAGER
WHEREAS, the City of Tustin (the "City") has determined the need to establish a
new classification titled Tustin Legacy Development Services Manager; and
WHEREAS, an employee appointed to a position in this classification is a "project
employee" as defined in the City's Personnel Rules; and
WHEREAS, the City Council has consulted with the City Manager and Director of
Human Resources concerning the proposed employment terms contained herein;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin
authorizes staff to implement the provisions of this Resolution and modify the City's
Classification and Compensation Plans to reflect the changes approved in this
Resolution, and that the wages, hours and conditions of employment be adopted and set
forth as follows:
Section 1: Establishment of Classification
The classification of Tustin Legacy Development Services Manager is hereby established
to plan, manage, and direct a variety of public works engineering related redevelopment
activities at Tustin Legacy.
Section 2: Project Appointment
An employee appointed as the Tustin Legacy Development Services Manager is
classified as a "project employee" under the terms and conditions specified in the City's
Personnel Rules. A project employee holds a position which has been authorized by the
City Council for a prescribed period of time or for the duration of a specified project. A
project employee is employed at-will and does not earn the right to employment beyond
the specific period authorized.
Section 3: Effective Dates
The effective date of each section is September 7, 2010, unless otherwise stated herein.

An employee appointed by the City to the position of Tustin Legacy Development

Services Manager shall be employed in this position for three (3) years from the initial
date of employment. Extended terms of employment may be granted by the City Council
as necessary if the duration of the project exceeds three (3) years. The employee
appointed to the position will be employed at-will and employment may be terminated at
any time by either the City or the employee.
Section 5: Salary
The monthly salary range for the Tustin Legacy Development Services Manager is
hereby incorporated and listed in Appendix A.
Section 6: Benefits
The City shall provide the Tustin Legacy Development Services Manager with the same
benefits that are provided to employees in the unrepresented Management unit.
