HomeMy WebLinkAboutPC Minutes 05-09-83TUSTIN PLANNING COMMISSION Minutes of Regular Meeting May 9, 1983 The Planning Commission held a regular meeting Monday, May 9, 1983, at 7:30 p.m. in the Council Chambers of the City Hall, 300 Centennial Way, Tustin, California. The meeting was called to order by Chairman Sharp at 7:35 p.m. The Pledge of Allegiance was led by Mr. White and Mr. Puckett gave the invocation. ROLL CALL Present: Sharp, Ainslie, Puckett, Well, White Absent: None Also present: R.K. Fleagle, D.P.A., Acting Community Dev. Director Alan Warren, Senior Planner James Rourke, City Attorney Janet Hester, Recording Secretary MINUTES The minutes of the regular meeting held April 25, 1983 were approved as submitted with Mr. Puckett abstaining. CONTINUED PUBLIC HEARINGS: 1. USE PERMIT 83-4 Applicant: Location: Request: A.W. Johnson, Jr. on behalf of Thrifty Oil Company 101N. Tustin Avenue Authorization to construct and operate a mini-mart within the area formerly used as lube bays in an existing service station. After presentation of the staff report by Mr. Warren, Chairman Sharp opened the Public Hearing at 7:40 p.m. A.W. Johnson, Jr., applicant spoke in favor of the project and stated all conditions mentioned in the staff report were agreeable. Mrs. Well expressed concern regarding the parking plan. After discussion, it was determined the applicant would work with staff to revise the parking plan to alleviate potential circulation problems. Chairman Sharp closed the Public Hearing at 7:49 p.m. Moved by Mr. White, seconded by Mr. Puckett, adoption of Resolution No. 2091, approving Use Permit 83-4, with the amendment to Item II{4) that parking design and all landscaping be subject to review and approval by staff in accordance with Commission direction. Proposed Amendment of the Zoning Ordinance Relating to Video Games After presentation of the staff report by Dr. Fleagle, Mr. White requested clarification of the wording of the proposed change. After discussion, Mr. White requested that the proposed amendment be advertised to read as follows: Amusement resorts, arcades and private recreation facilities, and ~ideo and vending ~achines and ~uch other contri~nces in excess of five (5) which are incidental to the principle business. Moved by Mr. White, seconded by Mrs. Well, to authorize by Minute Order staff to advertise an amendment to the Zoning Ordinance to require a use permit for video games and similar contrivances. Motion carried: 5-0 AYES: SHARP, AINSLIE, PUCKETT, WEIL, WHITE NOES: None ABSENT: None 2. Conflict of Interest Code After presentation of the staff report by Dr. Fleagle, Mr. White stated he had not received a copy of the document and requested continuance of the item to the next regular meeting. Moved by Mr. White, seconded by Mrs. Well, to continue the item to the next regular meeting. Motion carried: 5-0 AYES: SHARP, AINSLIE, PUCKETT, WEIL, WHITE NOES: None ABSENT: None STAFF CONCERNS: 1. Report on Council Actions - May 2, 1983 Report received and filed. 2. Council/Commission Workshop Dr. Fleagle reminded the Commission of the workshop to be held May 23, 1983 at 6:00 p.m. and mentioned two items of particular concern: A.. The moratorium on professional office development in commercial zones. B. A new law regarding second units in residential districts. COMMISSION CONCERNS: Commissioner Well stated she and Mr. Puckett had attended an Orange County Transportation meeting. She also requested Commission approval to conduct research regarding ridership of the Orange County Transportation buses. Mr. Puckett thanked staff for following up on his request to investigate a possible violation of the ordinance regulating garage sales. Mr. White stated he had noticed flags and banners for the recently approved boat sales business in E1Camino Plaza. Dr. Fleagle replied that temporary banners were allowed, with a permit, and staff would contact the business owner to obtain the necessary permit.
