APPROVAL OF MINUTES - AUGUST 10, 2010, PLANNING COMMISSION MEETING. It was moved by Puckett, seconded by Kasalek, to approve the Consent Calendar. Motion carried 3-1. Thompson abstained. PUBLIC HEARINGS Adopted Resolution 2. THE APPLICANTS ARE MAKING THE FOLLOWING Nos. 4153, 4154, and REQUESTS: 4155, as amended Minutes -Planning Commission August 24, 2010 -Page 1 a. TENTATIVE PARCEL MAP 2008-138 TO SUBDIVIDE AN EXISTING 1.075 GROSS ACRE PARCEL INTO TWO (2) NEW PARCELS TO ACCOMMODATE A SINGLE FAMILY DWELLING ON EACH PARCEL. b. DESIGN REVIEW 08-011 TO CONSTRUCT A NEW 5,008 SQUARE FOOT SINGLE FAMILY DWELLING WITH A 799 SQUARE FOOT GARAGE ON THE NEWLY CREATED PARCEL FRONTING IVERNESS WAY (PARCEL 1) AND TO CONSTRUCT A NEW 4,255 SQUARE FOOT ADDITION TO A HISTORIC RESIDENCE, A 1,008 SQUARE FOOT GARAGE, AND A 460 SQUARE FOOT GUEST HOUSE ON EXISTING PARCEL FRONTING ON PROSPECT AVENUE (PARCEL 2). c. CONDITIONAL USE PERMIT 08-017 TO AUTHORIZE THE USE OF A 460 SQUARE FOOT GUEST HOUSE ABOVE A DETACHED GARAGE ON PARCEL 2. THIS PROPERTY IS LOCATED AT 14611 PROSPECT AVENUE IN THE ESTATE RESIDENTIAL (E-4) ZONING DISTRICT. RECOMMENDATION: a. Adopt Resolution No. 4153 recommending that the City Council find that the Negative Declaration is adequate for Tentative Parcel Map 2008-138, Design Review 08-011 and Conditional Use Permit 08-017 for the proposed project. b. Adopt Resolution No. 4154 recommending that the City Council approve Tentative Parcel Map 2008- 138 to subdivide an existing parcel into two (2) new parcels to accommodate a single family residence on each parcel. c. Adopt Resolution No. 4155 recommending that the City Council approve Design Review 08-011 for the demolition of accessory structures on-site and portions of a single family residence listed in the City's Historical Survey and rated "A" with a National Register Historic Preservation (NRHP) Status Code: 3S. Construction of a new detached single family dwelling on proposed Parcel 1; and an addition to the existing historic residence on proposed Parcel 2. Resolution No. 4155 also recommends approval of Conditional Use Permit 08-017 for a proposed guest house above a new detached garage on Parcel 2. Minutes -Planning Commission August 24, 2010 -Page 2 Swiontek Presented the staff report, noting that staff made minor corrections to the resolutions that were presented at the dais. Brief Planning Commission and staff discussion ensued. The Public Hearing opened at 7:20 p.m. Chair Pro Tem Thompson invited the applicant to the lectern. Todd Schooley, architect, spoke on behalf of the applicants. The following spoke in opposition to the project: Jeff Worthe, 17711 Westbury Lane, Tustin Paul Green, 17712 Amaganset Way, Tustin David Morse, 17737 Amaganset Way, Tustin Jim Grillo, 14681 Iverness Way, Tustin. Further discussion ensued. The Public Hearing closed at 8:16 p.m. The Planning Commissioners shared their comments and concerns. Chair Pro Tem Thompson reviewed the primary concerns and offered suggestions for minor corrections to the conditions of approval for Resolution No. 4155. The Director read the following language into the record: Add Condition 2.3: "Prior to the removal of any mature on-site California oaks, the applicant shall make all reasonable efforts to relocate and/or save on-site California oaks, subject to review and approval by the Community Development Department. Additional landscaping shall be provided to buffer the guest house from the adjacent single family residence, and said landscaping shall be subject to review and approval by the Community Development Department." It was moved by Puckett, seconded by Kasalek, to adopt Resolution No. 1453, 4154, and 4155 (as amended). Motion carried 4-0. Commissioner Kozak asked when this item would be scheduled for the City Council agenda. Minutes -Planning Commission August 24, 2010 -Page 3 Staff indicated the project will be noticed again and property owners notified, approximately 30 days from now. The Director added that staff will provide community outreach when ready to issue permits and the project moves forward. None REGULAR BUSINESS STAFF CONCERNS 3. REPORT OF ACTIONS TAKEN AT THE AUGUST 18, 2010, SPECIAL CITY COUNCIL MEETING. The Director indicated there was nothing specific to report from the above special meeting. COMMISSION CONCERNS Kasalek Indicated she enjoyed the final Concert in the Park and the performance of "Guys and Dolls"; • Attended the Lincoln tree and plaque dedication at the Library hosted by Mayor Amante; • Noted the Tustin Preservation Conservancy will be hosting a picnic this weekend; • Asked that everyone wish her husband well; he will be climbing Mount Whitney this weekend. Kozak Noted he also attended the tree ceremony which also celebrated the 1St anniversary of the new Library; • Indicated there were many wonderful classic cars to enjoy at the Enderle Center on August 22; • Thanked the Redevelopment Agency, Public Works, Community Development, and everyone involved for the workshop report; • Added that he also enjoyed the last concert; and congratulated the Tustin Area Fine Arts Council and Parks and Recreation for these successful summer activities. Puckett Stated that he also attended the tree dedication, noting that last year he mistakenly indicated the Grand Reopening fell on the Pucketts' anniversary, the 19t"; his wife corrected him-their anniversary is the 21St; • Wished his wife Happy 45t" Wedding Anniversary; • Attended Broadway in the Park and the Enderle Car Show; • Thanked staff for tonight's report. Minutes -Planning Commission August 24, 2010 -Page 4 Thompson Indicated he-was glad to be back after his summer vacations; • Stated he was actually inspecting Lake Shasta and was pleased to see how full it was; • Attended the tree dedication, the Tustin Chamber Business and Economic Development forum, and last month's OCTA Advisory Committee meeting; • Offered consolation to the many Tustin students who will be returning to school this month; • Congratulated his daughter Lauren who will be continuing at California State University Fullerton, and son, Michael, who will be entering the Civil Engineering program at California State University Long Beach. 8: 45 p.m. ADJOURNMENT The next regular meeting of the Planning Commission is scheduled for Tuesday, September 14, 2010, at 7:00 p.m. in the City Council Chamber at 300 Centennial Way.
