REQUEST: A REQUEST FOR A USE DETERMINATION TO ESTABLISH A
HYDROPONICS, INDOOR GARDENING SUPPPLY STORE AS AN
OUTRIGHT PERMITTED USE IN THE CENTRAL COMMERCIAL
ZONING DISTRICT.
RECOMMENDATION
That the Planning Commission adopt Resolution No. 4159 approving Use Determination 10-003
to establish a hydroponics and indoor gardening supply store as a conditionally permitted use in
the Central Commercial (C-2), Heavy Commercial (C-3) and Commercial General (CG)
Districts, subject to approval by the Planning Commission.
BACKGROUND
A request has been received to establish a hydroponics and indoor gardening supply store at 365
EI Camino Real. The proposed hydroponics and indoor gardening supply store is located within
the Central Commercial (C-2) and Cultural Resources Districts in Old Town Tustin. Tustin City
Code (TCC) Section 9233 related to the C-2 District does not list a hydroponics and indoor
gardening supply store as a permitted, conditionally permitted, or prohibited use. TCC Sections
9233a and 9233c related to the C-2 District allow the Planning Commission to determine
whether an unlisted use is similar to other listed uses and should be permitted, conditionally

permitted, or prohibited through a Use Determination, The Planning Commission must consider
whether or not the proposed use is_ a) consistent with the overall intent of the zoning district; and,
b) consistent with other listed permitted or conditionally permitted uses in the zoning district.
Pursuant to Tustin City Code, those uses listed within the lower rank districts as either permitted
or conditionally permitted would be allowed to locate as permitted or conditionally permitted
uses in the higher or more intense districts. For example, a furniture consignment business is
permitted in the C-2 District; therefore, this use is also permitted within the Heavy Commercial
(C-3) and Commercial General (CG) districts. Accordingly, Planning Commission determination
of the proposed use would also impact the C-3 and CG Districts.
Site and Surrounding Properties
The proposed site is bounded by commercial uses to the north, south, and west. The Prospect
Village Planned Community development is to the east of the proposed supply store
(Attachment A -Location Map). The C-2 zoned properties within the City are generally located
south of First Street, north of Newport Avenue, west of Prospect Avenue and east of "C" Street_
Other C-2 zones include the areas adjacent to the intersections of Red Hill Avenue and the north
side of the I-5 Freeway, Walnut and Red Hill Avenues, First Street and west of the 55 Freeway,
Newport Avenue and Main Street, Newport Avenue and Old Irvine Blvd., and Seventeenth Street
and North Yorba Street. Although the Tustin City Code includes C-3 District, the City no longer has
properties zoned C-3. Properties within CG districts are spread out in relatively small clusters. In
general, CG zones are located on the east side of Newport Avenue between EI Camino Real and
San Juan Street, and at the intersections of Seventeenth Street and Carroll Way, Newport and
Mitchell Avenues, Newport and Walnut Avenues, and Red Hill and Walnut Avenues. Figure 1
below only shows the C-2 and CG zones within the City since there are currently no properties
zoned as C-3 within the City.

Proposed Use
Hydroponics is the cultivation of plants by giving the roots liquid nutrient solutions instead of soil.
Indoor gardening is the cultivation of plants inside an enclosed structure by using lights, nutrients,
soils, and other methods of controlling the plant's environment-
The applicant proposes to operate a hydroponics and indoor gardening supply store and has
submitted a business plan and floor plan (Attachment B). As proposed, the store would sell items
such as lights, timers, tubing and fittings, pumps, water filters, seeds, soil, soil pots, nutrients,
growing medium, books, and videos related to hydroponics and indoor gardening. The applicant
does not propose to grow plants for sale. However, the applicant has indicated that approximately
five (5) percent of the retail store would be used to grow plants for the purpose of display and
product demonstration. The applicant indicated that they intend to strictly be a supply store.
Attachment C includes catalog pages from the applicant's product supplier, Sunlight Supply, Inc.
Currently there is no hydroponics and indoor gardening supply business located in the City ofi
Tustin. However, some nurseries and home improvement stores located in Tustin sell a very
limited amount of hydroponics equipments and supplies. As mentioned, C-2 districts typically allow
retail establishments to locate as permitted uses. The C-2 District regulations also require
conditional use permits for more intense retail uses such as convenience stores, wholesale
bakeries, specialty stores, outdoor markets, etc.
Hydroponic businesses in other cities
Staff researched other cities with similar hydroponics and indoor gardening supply businesses
within its jurisdiction. The following table reflects the results of staff's research.

Based upon interviews with other cities, generally this type of business has not created any
problems with the exception of one store. The one particular store has been reported with
problems associated with loitering, people smoking marijuana at adjacent alley, stabbing incident,
and complaints from adjacent businesses. Accordingly, the City in which the store is located is
considering requiring a Conditional Use Permit for this type of use to locate anywhere in the City.
CONDITIONAL USE PERMIT
Should the Planning Commission adopt a resolution to establish a hydroponics and indoor
gardening supply store as a conditionally permitted use in the C-2 zoning district, staff
recommends that City Code Section 9233c be amended in conjunction with the pending zoning
code amendment cleanup for use determinations.
Staff recommends that typical conditions of approval for a hydroponics and indoor gardening
supply store use be established. Typical conditions of approval could be as follows:
1) The use shall be limited to retail sales of supplies and equipment for hydroponics and
indoor gardening.
2) Business hours shall be compatible with the hours of other businesses in the area.
3) Window areas shall not be covered or made opaque in any way except as allowed under
Tustin Code Section 9403e8 regarding window signs.
4) "No Loitering" signs shall be placed near entrances on the outside of the premises or in
other specified locations and in accordance with any applicable local, State and Federal
regulations.
5) The use shall operate in compliance with Tustin City Code Section 9298f regarding uses
being consistent with local, state and federal laws.
6) The use may be reviewed on an annual basis, or more often if necessary, by the
Community Development Director. The Community Development Director shall review the
use to ascertain compliance with conditions of approval. If the use is not operated in
accordance with the conditions of approval, or is found to be a nuisance or negative
impacts are affecting the surrounding tenants or neighborhood, the Community
Development Director shall impose additional conditions to eliminate the nuisance or
negative impacts or may initiate proceedings to revoke the Conditional Use Permit.
FINDINGS
An approval of the use determination for a hydroponics and indoor gardening supply store within
C-2, C-3, and CG Districts, with a conditional use permit, could be supported by the following
findings:
1) The proposed use is consistent with the intent of commercially designated districts.
2) The proposed use is similar to other specialty retail stores which are conditionally
permitted uses within the C-2, C-3, CG Districts.
3) The proposed use is subject to TCC Section 9298f regarding uses being consistent with
local, state and federal laws

4) The proposed use would not have a detrimental effect on the public health, safety, and
general welfare of the community in that the proposed use would be appropriately
conditioned as follows:
• The use shall be limited to retail sales of supplies and equipment for hydroponics.
• Business hours shall be compatible with the hours of other businesses in the area.
• Window areas shall not be covered or made opaque in any way except as allowed

ENVIRONMENTAL ANALYSIS
Proposed Use Determination 10-003 is exempt from environmental review under CEQA
pursuant to Section 15061(b)(3) of the State CEQA Guidelines. This section provides that a
project is exempt from environmental review where it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment. If
approved, the proposed use determination would allow the establishment of a hydroponic and
indoor gardening supply store as a conditionally permitted use in the C-2, C-3, and CG Districts
and would not have an effect on the environment.

Who we are, location;
Go Green Hydroponics & Organics is owned equally by Nicholas Seid and Chris Hodge. Go Green will lease 365 EI Camino
Real from property owner Arnold Surfas for $31,680 per year. Go Green Hydroponics & Organics will generate
ecommerce with a website, Ebay and Amazon accounts.
Currently Chris Hodge owns "High Country Hydroponics" a successful startup and functioning indoor gardening retail
store in Montrose Colorado.
What we seil:
Go Green Hydroponics & Organics is an indoor gardening retail store. Go Green Hydroponics & Organics will offer its
customers lighting, timers, pumps, water filtration, plumbing, tubing & fittings, nutrients, organic nutrients, soil pots,
trays, water pumps, soil, hand tools, books & videos, water testing equipment, temperature & humidity gauges, self
contained growing kits, growing medium.
Where we get our product:
The major distributors of hydroponic & organic supplies include BWGS, HydroFarm, Sunlight Supply. It is typical for a
store to be directly linked to only one of the distributors. Due to local competition and established business relations we
have chosen Sunlight Supply. Sunlight Supply has a minimum six mile radius territory requirement; Sunlight Supply has
acknowledged and accepted our proposal for a location in the Tustin area. Sunlight Supply also has a very strict policy
that marijuana is not to be discussed in the store otherwise they will abruptly cut off supply to any store doing so. As
well it is Sunlight Supply's policy that each store they sell to display a sign stating that marijuana is not to be discussed or
the customer will be asked to leave the premises.
Target market:
Target market includes male and female ages 25 to 80 years of age. Of this group our customers will include the
enthusiast green thumb and the ever growing population concerned with the origin and cost of their produce.
Supermarkets now sell produce which has been grown using hydroponic & organic methods due to the expanding
demand for better quality. People whom enjoy gardening is not a new concept, however the hydroponics & organics
market is an emerging and growing market. People are learning that growing with hydroponic & organic methods can
reduce costs, reduce ecological and environmental stress, and yield better quality plants.
Startup Cost:
Go Green Hydroponics & Organics is startup using cash from both Nicholas Seid and Chris Hodge. First and last month's
rent with be required by lessor Arnold Surfas, which shall total $5,280. Approximately $5,000 will be spent on building
renovation costs. Our supplier Sunlight Supply requires that any new store must purchase a minimum of $35,000 for the
first order, we plan to purchase a total of $45,ODD of initial inventory.
Projected Financials:
Due to the successful startup and operation of High Country Hydroponics in Colorado we have based the following
financial assumptions for revenue from the actual stores financials taking into consideration the difference in population
in Montrose, Colorado versus the population in the city of Tustin and surrounding cities whose population will
contribute to revenues. As well we have included the estimated revenues that may come from the ecommerce we plan
to generate using a website, eBay and Amazon.
Operating Procedures:
Go Green Hydroponics & Organics will be open seven days a week however closed during major holidays. Hours of
operation will include 10am to 7pm Monday through Sunday. Opening and closing of doors may be the responsibility of

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, APPROVING USE DETERMINATION 10-003 TO ALLOW A
HYDROPONICS AND INDOOR GARDENING SUPPLY STORE AS A
CONDITIONALLY PERMITTED USE IN THE CENTRAL COMMERCIAL,
HEAVY COMMERCIAL, AND COMMERCIAL GENERAL ZONING
DISTRICTS.
The Planning Commission does hereby resolve as follows:
The Planning Commission finds and determines as follows:
A. That a proper application for Use Determination 10-003 was filed by Nic
Seid to request a use determination from the Planning Commission for the
establishment of a hydroponics and indoor gardening supply store use at
365 EI Camino Real.
B. According to Tustin City Code (TCC) Section 9233, hydroponics and indoor
gardening supply store is not a listed use in the Central Commercial (C-2),
Heavy Commercial (C-3) and Commercial General (CG) zoning districts
and requires a use determination by the Planning Commission as stated in
TCC Sections 9233a, 9233c, 9234a, 9234c, 9235a and 9235c.
C. The Planning Commission finds that approval of a use determination to
allow a hydroponics and indoor gardening supply store as a conditionally
permitted use in the C-2, C-3 and CG zoning designations can be
supported by the following findings:
1) The proposed use is consistent with the intent of commercially
designated districts.
2) The proposed use is similar to other specialty retail stores which are
conditionally permitted uses within the C-2, C-3 and CG Districts.
3) The proposed use is subject to TCC Section 9298f regarding uses
being consistent with local, state and federal laws.
4) The proposed use would not have a detrimental effect on the public
health, safety, and general welfare of the community in that the
proposed use would be appropriately conditioned as follows:
a. The use shall be limited to retail sales of supplies and
equipment for hydroponics and indoor gardening.
b. Business hours shall be compatible with the hours of other
businesses in the area.

c. Window areas shall not be covered or made opaque in any way
except as allowed under Tustin Code Section 9403e8 regarding
window signs.
d. "No Loitering" signs shall be placed near the entrance on the
outside of the premises or in other specified locations and in
accordance with any applicable local, State and Federal
regulations,
e. The use shall operate in compliance with Tustin City Code
Section 9298f regarding uses being consistent with local, state
and federal laws.
f. The use may be reviewed on an annual basis, or more often if
necessary, by the Community Development Director. The
Community Development Director shall review the use to
ascertain compliance with conditions of approval. If the use is not
operated in accordance with the conditions of approval, or is
found to be a nuisance or negative impacts are affecting the
surrounding tenants or neighborhood, the Community
Development Director shall impose additional conditions to
eliminate the nuisance or negative impacts or may initiate
proceedings to revoke the Conditional Use Permit.
5) A Conditional Use Permit would allow a proposed hydroponics and
indoor gardening supply store to be considered on a case-by-case
basis.
D. That this project is exempt pursuant to Section 15061(b)(3) of the California
Environmental Quality Act.
II. The Planning Commission hereby approves Use Determination 10-003 to allow a
hydroponics and indoor gardening supply store use in C-2, C-3, and CG Districts,
with a conditional use permit subject to approval by the Planning Commission.
