STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AWARD OF CONTRACT FOR THE INFORMATION TECHNOLOGY /FINANCE RECONFIGURATION (CIP 10032) SUMMARY Staff is requesting that the City Council reject the apparent low bid as non-responsive and award the construction contract for the Information Technology/Finance Reconfiguration CIP No. 10032 to the lowest responsive/responsible bidder. RECOMMENDATION It is recommended that the City Council find the bid submitted by the apparent low bidder, The Richardson Group, to be nonresponsive and award the construction contract for the Information Technology/Finance Reconfiguration (CIP No. 10032) to the second lowest responsive/responsible bidder, TBC Contractors Corporation, in the amount of $177,800 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. FISCAL IMPACT Sufficient funds have been budgeted and appropriated in the Fiscal Year 2010-2011 Capital Improvement Program. BACKGROUND This project includes the relocation of IT functions/equipment to the second floor of the Civic Center and the reconfiguration of the vacated Finance Department work spaces. Formal bids were publicly opened August 12, 2010 and reviewed by Public Works. Seven (7) bids were received and are summarized below by order of least dollar amount: • The Richardson Group -Orange ................................................ $160,999 • TBC Contractors Corporation -Anaheim .................................... $177,800 • Korston Construction, Inc. -Anaheim ......................................... $191,300 • Signature Contractors -Laguna Niguel ....................................... $203,500 • Interlog Hym Engineering -Brea ................................................. $230,311 • AVI-CON, Inc. -Riverside ........................................................... $237,000 • CJPRON, Inc. -Santa Fe Springs .............................................. $260,000 The apparent low bid was submitted by The Richardson Group. After a staff review of The Richardson Group's bid and consultation with the City Attorney's office, the apparent low bid was rejected as nonresponsive to the bid specifications. The Richardson Group's bid was found nonresponsive because their bid proposal excluded the list of subcontractors intended to be utilized for the project. IT/Finance Reconfiguration October 5, 2010 Page 2 The Subcontractor's Fair Practice Act, requires a bidder to submit at a minimum the name and location of every subcontractor that will perform work in excess of %2 of 1 percent of the total bid amount. Pursuant to the Act, the City requires the contractor to submit .all subcontractor information at the time of the bid. In this instance the apparent low bidder failed to submit any information regarding their subcontractors at the time of bid. That information was submitted later after the closing of the bid time. As a result, their bid must be found non-responsive. Staff has reviewed the references and the State Contractor's License for the next lowest responsive/responsible bidder, TBC Contractors Corporation, and has determined that they are appropriate for the subject project.
