HomeMy WebLinkAboutPC Minutes 05-19-80 TUSIIN PLAF, NING AGENCY Minutes of Regular and Continued Meetings May 19, 1980 The Planning Agency held a regular meeting Monday, May 19, 1980 in the Council Chambers of the Tusfin City Hall, 300 Centennial Way, Tusfin, California. The meeting was called fo order af 5:05 p.m. by Chairman $altarelli. The Pledge of Allegiance was led by Mr. Sharp and the invocation was given by Mrs. Kennedy. ROLL CAkL Present: Chairman Saltarelli; Agency members: Hoesterey, Edgar, Sharp, and Kennedy. Absent: None Also present: Mike Brotemarkle, Community Development Director Dan Blankenship, City Administrator Alan Warren, Senior Planner James Rourke, City Attorney Midge Mehl, Recording Secretary MINUTES The minutes of the meefin9 held May 5, ]980 were approved as written, with the waiving of reading same and with Mrs. Kennedy absfainin9 from the vote of approval. INITIAL PUBLIC HEARINGS Use Permit 80-12 Applicant: Location: Request: American Displays, Inc. 1382 Valencia Avenue Authorization fo install a helic(:pl¢.r port in the southeasterly corner of their parking lot, Mr. Brotemarkle said staff would recommend a continuance of this matter due fo a determination that a Negative Declaration is needed for the prc.]ecf; responsible agencies need fo be contacted for their comments regarding any potential environmer:tel impa('l{; and the Orange County Airport Land Use Corn- mission needs fo review the application and forward their recommendations on potential impacts fo the City, Marine Base, and the John Wayne Airport. Chairman Saltarelli declared the public hearing open and asked if there was anyone who wished to speak in favor or opposition to Use Permit 80-12. Captain Bill Culler of the Marine Corps Air Station said they were in receipt of a report from the FAA regarding this proposed construction and had answered via the Navy representative in Los Ans(:les that the Marine Corps had no ob- jection, provided definitive air control procedures are worked out between the base, American Display, and air traffic control officials at the John Wayne Airport. The proposed egress and ingress tracks are going fo be un- acceptable. MCAS(H) has requested a meeting of all par'ties concerned fo work out air control procedures and if these are resolved there will be no objections. Mr. Bill Woods, representing American Displays, said their pilot was quite experienced and the use would involve a maximum of cnly 5-10 flights per month. In answer fo Mrs. Kennedy's question about the 30-day continuance, he said they wculd like to expedite this, but a 30-day continuance would be acceptable. MOTION by Kennedy, SECONDED by Edgar, fo continue Use Permit 80-12 until the regular meeting to be held June 1(!, ~9PO in order that all necessary reports and corrrnenfs could be brought before the Agency. AYES: Hoesterey, Edgar, Sharp, Kennedy, and Saltarelli NOES: None Use Permit 80-13 Applicant: Location: Request: Tuneup Masters 695 El Camino Real Authorization for installation of a pole sign of 36 square Fccf (double faced), not fo exceed 15 feet in height. Mr. Brotemarkle said fhaf in December of 1979 a variance application had been submitted, requesting to retain three (3) 30 square foot non-conforming ad- vertising signs af 1his location. The proposal was subsequently denied by the Planning Agency. An appeal of that denial was dropped in favor of this use permit proposal for a pole sign. He further stated that the original use permit for Budget Dyna-Tt. ne required under condition 2a a natural wood appear- ance and file mansard roof fo ensure the building would be consistent with the architectural and design guidelines of El Camino Real Design District. As pcinfec' out in the previous variance staff report, the building has since been painted a bright blue and staff recommends a return fo the original con- cept within one year. Tuneup Masters contends the brighl' blue is their of- ficial building color. Chairman Salfarelli declared the public hearing open and asked if there w?. enyone to speak in favor or opposition fo Use Permit 80-13. Mr. Floyd Wheeler, Marketing Director for Tuneup Masters, stated t,e believed the staff had erred in the dimension of the requested sign. He said the 36 square feet embrat,c.d only the illuminated portion of the sign. The hanging signs were in excess of 36 square feet. He said ho had talked several times with Mr. Brotemarkle and Mr. Warren and at no time did either of them ever indicate to hir if.at they w~re ir. violation of any codes with the color of their building. Ho said they had acquired the building from Budget Dyna-Tune, painted it their official color, and the Planning Department was aware of the pain~ing af the time. He submitted eight photos fo the Agency, showing other signs in the immediate area. There followed a discussion concerning the color of the building and the size of the requested sign. If was determined that the fetal sign area should not exceed 36 square feet and since the main sign was 32 square feet, an additional 4 square feet of accessory sign area would be permitted. Further, since the original approval, copfrol on colors had been de-emphasized and the staff had not objected, correction now because of a sign change, did not appear ap- propriate. Chairman Saltarelli asked if there was anyone else who wished to speak and hearing no response he declared the public hearing closed and asked the pleasure of the Agency. MOTION by Hoesterey, SECONDED by Edgar, to approve Use Permit 80-13 as re- quested. AYES: Hoesferey, Edgar, Sharp, Kenrledy, and Salfarelli NOES: None Mrs. Kennedy suggested, and Mr. Wheeler concurred, to talk to management re- garding possible change of color of the building. Also, he said the height of the chairs make if difficult fo get close enough to the microphones fo be heard. He suggested that either the chair arms be modified or new chairs be pL;rchased. Condo-conversion and parkin9 reauiremenfs Mr. Hoesferey said a~ the Agency 9ets into condominium conversions, it appears that fo meet parkin9 requirements we're 9oin9 fo have more multi-story parkin9 structures. He wondered if that was safisfyin9 the intent of our open space requirement wh,:i'. <'ne of the purposes is fo keep an aesthetic view and a well planned community. There being no other business to come before the Agency af this time Chairman Salfarelli declared I'he meeting adjourned at 5:45 p.m. to reconvene for a continued me(~lin9 at 7:30 p.~. this date fo hear the continued public hearing for Use Permit 80-10. Chairman Salfarelli reconvened the Plannit,9 Agency meeting at 7:30 p.m. and ordered the record fo show that all Agency members were present. US~ Permit 80-10 (continued) Applicant: Location: Tusfin Arms II (Condominium Convert. ion) 15851 Pasadena Avenue Mr. Brotemarkle stated fhaf the developer was out of town and unable fo attend the meeting and had requested that this matter be continued for 30 days. He said this proposal had been introduced at the April 21 meeting as a use permit, and at that time the matter ~las continued with the Agency re- questing the applicant fo investigate a more efficient parking design. He said this revised plan consists of a "U-shaped" parking structure and would require a variance of up fo 4% of open space in order fo provide for +his change in design. He said the applicant's engineers are workin9 with the Fire Department concernin9 alternative means fc affect modification fo the roof system fo prefect against fire. He questioned whe[her if should be continued as a use permit or readverfised as a variance. If a plan were found acceptable fo the Agency, but involved any variance, regardless how minor, it would have fo be readverfised. Mr. Saltarelli asked if the applicant was proposing to remove any units. Mr. Brofemarkle said this particular proposal does not propose Io remove any units. Chairman Saltarolli asked if there was anyone who wished fo speak in favor or oppr,sifion fo this continued use permit and hearing no response he asked the pleasure of the Agency. There followed a discussion about the proposed parking structure and the open space which would remain. MOTION by Kennedy, SECONDED by Edgar, to direct staff fhaf the public hearing on Use Permit 80-10 be readverfised as a variance for the regular' m6efing fo be held June 16, 1980.
