C)UR FUTURE 1~11)N<)RIN(: (7lIR PAST The following is a list of projects and activities since the Summary of Projects report provided at the June 22, 2010, Planning Commission meeting. The list focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificate of Appropriateness; Code Enforcement activities; and, other items of interest. Community Development Web Page: The Community Development Department and the City's IT staff worked to improve its web page to share enhanced and expanded planning and building related information and resources. The following are items among others that are available on the Community Development web page: o Planning and Building office hours are identified. o Direct linkages are provided to customers seeking Planning and Zoning information including full color electronic copies of the Tustin General Plan, the Historic Resources Survey, the Zoning Code, various specific plans including those developed for East Tustin and MCAS Tustin, the Tustin Zoning Map, Tustin Sign Code, Housing Element update, and other important documents. o Information pertaining to the City's Community Development Block Grant program. o Recently adopted Codes and Ordinances, such as the Parking Ordinance, Shopping Cart Ordinance, Water Efficient Landscape Ordinance, Old Town Restaurant and Outdoor Seating Ordinance, etc. o Electronic copies of various planning and building division flyers, handouts, and forms (applications, etc.). o Direct linkages to the Building Division, permit forms, information about the plan check procedure, a building inspection request link (usually accomplished in 24 hours), electronic copies of codes, alerts, handouts, and general information regarding issues such as earthquake preparedness. o Direct linkages to the Code Enforcement Division, allowing online filing of complaints and reporting of graffiti, providing answers and phone numbers, and allowing online payment of administrative citations. Planning Commission Summary of Projects October 12, 2010 Page 2 o A link has been provided to the Planning Commission web page where general information about the Commission can be found, and specific information about the next Planning Commission agenda can be obtained or downloaded. o The Community Development Department has recently enhanced its web page with a "Projects in Progress" page. The new page link provides interested parties the opportunity to find and view information about any current planning project by selecting either its map location or by locating it on a table located below the map. • First Street Specific Plan: On September 14, 2010, the Planning Commission approved a Use Determination to establish a dental office as a conditionally permitted use in the "Commercial as Primary Use" District of the First Street Specific Plan (FSSP). This approval applies to several properties within the FSSP area, but will specifically enable a dentist who is interested in the suite at 631 E. First Street within the Tustin Courtyard Shopping Center to request the approval of a conditional use permit to establish the business at that location. • Hydroponics & Indoor Gardening Supply Store: The Planning Commission approved the Hydroponics & Indoor Gardening Supply Store uses in C-2, C-3 and CG zoning districts as conditionally permitted uses. Any establishment of this use will require approval of a Conditional Use Permit and would be considered on a case by case basis. • 14611 Prospect Avenue: On September 21, 2010, the City Council approved Tentative Parcel Map 2008-138, Design Review 08-011, and Conditional Use Permit Planning Commission Summary of Projects October 12, 2010 Page 3 08-017 to subdivide a 1.075 gross acre parcel into two (2) new parcels which will each accommodate a single family residence; construct a new single family dwelling on newly created parcel fronting Iverness Way; construct an addition to an existing historic residence fronting Prospect Avenue; and construct a 460 square foot guest house above a garage on the property with the historic residence. • General Plan Gonformity for the "Old" Del Amo Avenue vacation: The Newport Avenue Extension/SR-55 Ramp Reconfiguration Project (CIP No. 7130) included reconstruction of Newport Avenue between Edinger Avenue and Valencia Avenue, relocation of the northbound on/off ramp to SR-55, and realignment of Del Amo Avenue (Figure 1 and Attachment A). As this project is now complete, the "old" Del Amo Avenue is no longer necessary and needs to be vacated and conveyed. In July, 2010, the Planning Commission adopted a resolution determining that the vacation of the "Old" Del Amo Avenue is consistent with the City's General Plan. • Nunos Brothers Retail Building (15761 Tustin Village Way): The project involves reconstruction of a 15,000 square foot retail center to replace a former retail center that was destroyed by fire. The project is substantially under construction. • CUP 09-036 & DR 09-042 (550 W 6t" Street): The project includes modifying an existing monopalm wireless facility by adding antennas and upgrading the monopalm design. The project is in plan check. Nunos Brothers • Express Carwash (3017 Edinger Avenue): Code Amendment 09-003 and Design Review 09-004 were approved by the City Council authorizing the construction and operation of an express carwash in conjunction with an existing service station and mini-mart. The applicant is currently working on construction documents. TPM 2008-13fi & CUP 09-021 (2492 Walnut Ave.): The project is a subdivision map to create a condominium office building for eleven (11) suites at an existing office building located at 2492 Walnut Avenue. The Conditional Use Permit to increase the approved square footage allowed for medical use from 7,500 square feet to 16,534 square feet and establish joint-use parking between properties located at 2492 and 2472 Walnut Avenue was also approved by the Planning Commission and the City Council. The Final Parcel Map and the draft Covenants, Conditions, and Restrictions (CC&Rs) are currently under review. Planning Commission Summary of Projects October 12, 2010 Page 4 • Surfas Furrier (145 W. 1St Street): On August 10, 2010, the Planning Commission approved Design Review 10-015, a request to install stucco to the unfinished west wall of an existing commercial building. A building permit to install the stucco and modify an existing patio cover was issued on September 30, 2010. Construction is to be completed by October 9, 2010. • The Cottages/Nevis Homes (1361 EI Camino Real): The project includes construction of 93 condominium units. Phase 1 and 2 (63 units) are now complete and Phase 3 is approaching final status in the next two to three weeks. • Massage Ordinance: On September 27, 2008, the Governor signed Senate Bill {SB) 731 into law relating to massage therapy. On June 15, 2010, the City Council adopted Ordinance No. 1380 (effective on July 15, 2010) to achieve consistency with State law and codify new massage regulations and protect the public health safety and welfare as follows: 1) Requires all massage therapists and practitioners in Tustin to be certified by the California Massage Therapy Council {CAMTC). 2) Provides a grace period to existing massage technicians and operators holding valid City of Tustin permits. 3) Requires all massage owners and operators to obtain new establishment permits from the City. 4) Amends the Zoning Code to allow massage establishments as an outright permitted use in the Retail Commercial (C-1 ), Central Commercial (C-2), and Commercial General (C-G) zoning districts. Planning Commission Summary of Projects October 12, 2090 Page 5 • Jalapenos Restaurant (450 E. 1St Street): On January 26, 2010, the Planning Commission approved a Conditional Use Permit to allow a restaurant expansion, increased seating, new outdoor dining area, and modified business hours for Jalapenos restaurant located at 450 E. First Street. Building permits for the expansion have been issued. • Old Town Mixed-Use Building (170 EI Camino Real): Conditional Use Permit 07- 014 and Design Review 07-015 were approved for the construction of a 7,650 square foot mixed use building on March 4, 2008. Permits have been issued and the applicant has indicated that a construction loan is being secured. • TTM 17342 (17772-17862 17t" Street): The project is a subdivision, for condominium purposes, of an existing 9.62-acre property into five (5) numbered lots and one (1) lettered lot, for a maximum of 115 office units. The resulting map will create one parcel for each of the five (5) existing buildings (numbered lots), condominium units within each building, and a sixth lot (lettered lot) for the existing common access, parking, and landscaping areas. The Planning Commission and the City Council adopted resolutions approving the project. The Final Tract Map is currently under review and upon approval by the City Council the Final Tract Map will be recorded. 170 EI Camino Real Planning Commission Summary of Projects October 12, 2010 Page 6 • Larwin Square (530 E. 1St St.): Plans for minor facade improvements to include the removal and replacement of wooden posts and painting of the center facade have been issued and construction is currently under way, The center also recently completed parking lot improvements throughout the center. • 195 EI Camino Real (former Riteway Cleaners): A demolition permit has been issued for the existing commercial building and residential structure to accommodate a new commercial use consistent with underlying zoning district. Larwin Square • New dental office building (740 EI Camino Real): A conditional use permit to establish a medicalldental office at 740 EI Camino Real was approved by the City Council on March 4, 2008. A Design Review application for demolition of the existing building and construction of a two-story dental office building with ground floor retail was approved by the Planning Commission on June 9, 2009. Permits have been issued and the project is under construction. Planning Commission Summary of Projects October 12, 2010 Page 7 • Tustin Freeway Center (14111 Newport Avenue): A new 2,565 square foot retail building approved as part of the Phase II Tustin Freeway Center has completed construction. Individual tenant improvements are in process. • Former Econo Lube Building (155 W. First St.): Design Review for construction of a new retail building was approved in November 2008. The demolition of the dilapidated building was completed, and the Code Enforcement division monitors the site to ensure the site is maintained in goad condition. The applicant requested and was granted two extensions until November 2010 to construct the new building. If permits are not obtained, the Design Review will expire. Zoning Administrator Actions • Concept Plan 10-001: On July 26, 2010, the Zoning Administrator approved the South Orange County Community College District Phase 3A Concept Plan for the Advance Technology Education Park (ATEP) campus. The Phase 3A Concept Plan supports the future development of the proposed Phase 3A area of the ATEP campus. The campus would have a focus on six academic areas, such as Entertainment Arts and Technology, Nursing, Design Model Making and Rapid Prototyping, Optics and Photonics, Biotechnology, and Workforce Development. Free Soul Cafe (191 East Main Street, Suite B): The Prospect Village project is now complete. All twelve (12) live/work units have been sold and offices on the second floor of the Main Street commercial building are 100 percent occupied. Free Soul Cafe completed its tenant improvement and is now open for business. Planning Commission Summary of Projects October 12, 2010 Page 8 • Design Review 10-016 (Fire Station No. 37): Fire Station No. 37 will replace the existing fire station located at 14901 Red Hill Avenue. The proposed fire station will feature three apparatus bays, eight dormitories and four bathrooms for fire service personnel, a kitchen with dining area, a day room, offices, an exercise room, a public lobby and restroom, and ether rooms to support fire service operations. The project is currently in plan check. • Conditional Use Permit 10-007 (14244 Newport Avenue): The Zoning Administrator approved a convenience store in conjunction with the existing service station. The convenience store will occupy approximately 159 square foot of cashier area and items to be sold would include bottled and canned drinks, bottled water, request to operate a convenience store in conjunction with an existing service station. • Design Review 09-033 (Cedar Grove Park): On October 20, 2010, the Zoning Administrator will be hearing a request by T-Mobile West Corporation to install and operate an unmanned wireless telecommunications facility consisting of a sixty-five (65) foot tall mono-cedar faux tree, nine (9) panel antennas, one (1) parabolic antenna and associated equipment located within a block wall enclosure near existing trees in the northern portion of Cedar Grove Park. Tustin Legacy • Master Developer: The City and Tustin Legacy Community Partners, LLC. mutually agreed to terminate the Disposition and Developer Agreement (DDA). The City Manager's Office is currently working on a strategy to proceed. This plan will be presented to the City Council within the next few months. • Columbus Grove: With the exception of Ainsley Park, all residential products within the Columbus Grove community have been completed and units have been released for occupancy. Ainsley Park: The project was previously approved with the master design review for Columbus Grove. Since construction never commenced on the project, the entitlement has expired. A Design Review application for 84 duplex-cluster homes was approved on October 27, 2009. The models are currently under construction and plans for the first phase are currently in for plan check review. • Columbus Square: There are three (3) remaining undeveloped sites located within Columbus Square (Coventry Court, Astoria, and Mirabella). Coventry Court: On July 7, 2010, the City Council approved Lennar's application to resume construction of the 240-unit senior housing complex at Columbus Square. Since then the property has been acquired by Tustin Planning Commission Summary of Projects October 12, 2010 Page 9 Coventry Seniors, LP and Meta Housing has hired Project Manager and solicited bids for a builder to undertake the project. Mirabella: Design Review 10-014 was approved by the Planning Commission on September 28, 2010, for the development of 60 attached townhomes at the Mirabella site. The property owner, ORA Mirabella 60 LLC, has submitted plans for plan check and review is currently underway. Augusta (formerly Astoria: Design Review 10-013 was approved by the Planning Commission on September 14, 2010, for the construction of 64 detached single family homes (previously approved as part of the Astoria site). The property owner, ORA Astoria 60 LLC, has submitted plans for plan check review and comments have been provided by City staff. • Fire Station 37 (Relocation): On August 2, 2010, the Zoning Administrator approved the design review for Fire Station 37. The City is continuing with the design development process for Fire Station 37 with the Design Consultant and the Orange County Fire Authority. • The District at Tustin Legacy: The District at Tustin Legacy is built out. Since the built out, tenant improvements have been processed for the following: Target: The Target store recently underwent a major remodel to accommodate groceries and produce areas within the store as part of their new national concept. The store was closed for five (5) days to accommodate the remodel. The Loft: Conditional Use Permit 09-017 was approved by the Planning Commission on October 13, 2009, authorizing live entertainment and a Type Planning Commission Summary of Projects October 12, 2010 Page 10 48 ABC License for a nightclub entertainment venue at the District shopping center. Tenant improvement plans are currently being reviewed for building plan check. Pablo Cantina: A tenant improvement is being proposed at the former Bistro West building to accommodate a new restaurant. The plans are currently in plan check. Certified Farmer's Market: On October 12, 2010, the Planning Commission will consider a Conditional Use Permit 10-008 to authorize the operation a Certified Farmers' Market on Sundays between 9:00 a.m. to 1:00 p.m. within the parking lot of the District shopping center. • South Orange County Community College District: On July 26, 2010, the Zoning Administrator approved Phase 3A Concept Plan (see Zoning Administrator Action section for more details). Planning Commission Summary of Projects October 12, 2010 Page 11 Code Enforcement Graffiti: There were 892 incidents from July 1, 2010 thru September 30, 2010. Overall, graffiti is down when compared to 2007 through 2009; but is approximately the same as the first quarter of last fiscal year. Water Quality: Existing Development Inspections (NPDES lnspections): The new permit cycle (five year cycle which may be extended to seven year) began July 1, 2010. There are currently 112 commercial and 85 industria- for a total of 197 inspections to be completed. Water Quality Management Plans (WQMPs): There are currently 84 WQMP's on file. Prior to the rainy season in October, 25% of the WQMP's on file must be inspected every year (21 inspections this year). Regular quarterly updates will be provided to the Planning Commission on the progress of inspections. • Administrative Citations: 59 cites issued {1/1/10 - 10/1/10) 34 of the cites issued are still open and 25 cites have been closed. Public Improvements -Public Works Department Update Newport Avenue Extension (CIP No. 70131): The 100% design was submitted on July 21, 2010 and is being reviewed by the City, Southern California Rail Road Authority, Burlington North Santa Fe, and Orange County Sanitation District. The City has obtained a PUC permit for this project. San Juan Sidewalk west of Browning Avenue (CIP No. 70198): Construction is complete and landscaping is in the plant establishment period. Red Hill Avenue Parking Bay at Pine Tree Park (CIP NO. 20063): Construction is complete and landscaping is in the plant establishment period. Red Hill Avenue Grade Separation: Preliminary design engineering is continuing for the Red Hill Grade Separation at the OCTA/SCRRA railway crossing (CIP No. 70175). At Pine Tree Park Red Hfll Avenue Parking Bay Planning Commission Summary of Projects October 12, 2010 Page 12 Traffic Signals: The traffic signal installation on Prospect Avenue at Beneta Way/Amaganset Way {CIP No. 40077) is expected to be completed by the end of October 2010. Jamboree Road Rehabilitation near northerly City boundary (CIP No. 70194): Construction is now complete. The project was partially funded with federal Stimulus money. Red Hill Avenue Quiet Zone at railroad crossing (CIP No. 40069): The Notice of Intent to establish a Quiet Zone has been filed with the Federal Rail Authority (FRA) and other affected agencies. Work is expected to be completed in early fall. However, extensive testing will be required before a Quiet Zone can be established which is currently scheduled for March 2011. Pedestrian Path between Dow Avenue and Metrolink Station: The pedestrian path design and construction was administered by the Orange County Transportation Authority (OCTA). Construction of the concrete path is complete and the path is now open to commuters working within the adjacent industrial park. The path features new LED street lighting. Street Maintenance: The FY 2009-2010 Annual Major Pavement Maintenance and Sidewalk Repair projects are complete. Design for the FY 2010-2011 projects has begun. • Mitchell Avenue/Utt Drive Pedestrian Enhancements (CIP No. 40073): Second submittal plans and specifications are being reviewed. A State Safe Routes to Schools (SR2S) Funding Allocation Letter and fully executed Program Supplement Agreement was received from Caltrans. The project is scheduled to go out to bid in March 2011. Mitchell Avenue Storm Drain (CIP No. 50035): Second submittal plans and specifications are being reviewed. The project is scheduled to go out to bid in March 2011. Rawlings Reservoir Replacement Project (CIP No. 60136): Plans and specifications prepared by Tetra Tech are 100% complete. The contract for the Planning Commission Summary of Projects October 12, 2010 Page 13 Construction Management Services has been awarded to Butier Engineering, Inc. and the in-depth constructability review of the project is currently underway. The construction is scheduled to begin in FY 2011-12 and would be completed in approximately 2 years. Tustin Metrolink Parking Structure (CIP No. 10062): The City Council approved a revised Cooperative Agreement with OCTA for Expansion of Parking Capacity at the Tustin Metrolink Station for design and construction of an 825 space parking structure. Under the revised agreement, operation and maintenance of the structure will be the responsibility of the City. The OCTA Board of Directors awarded a contract to Bomel Construction on August 23, 2010. Construction is scheduled to begin in early October 2010 and be completed within one year. Tustin Ranch Road Rehabilitation between Bryan Avenue and Jamboree Road (CIP No.70195): Plans are 70% complete, with approval of plans and specifications and authorization to advertise for bids tentatively scheduled for one of the November 2010 City Council meetings. Tustin Avenue Well (CIP No. 60150): Design engineering (95% complete) is continuing for the Drilling of the Tustin Avenue Well at 1822 N. Tustin Avenue. The drilling of the well (Phase I of the project) is scheduled to begin in FY 2011-12. Attachments: A. Tustin Legacy Monitoring Report B.
