HomeMy WebLinkAboutPC Minutes 08-06-79TUSTIN PLANNING AGENCY Minutes of Regular Meeting August 6, 1979 The Planning Agency held a regular meeting Monday, August 6, 1979 in the Council Chambers of the Tustin City Hall, 300 Centennial Way, Tustin, California. The meeting was called to order at 3:02 by Vice-chairman Saltarelli, in the absence of the Chairman, 5~r. Schuster. The Pledge of Allegiance to the Flag was led by Mr. Sharp and the invocation was given by Mrs. Kennedy. Mr. Saltarelli said to let the record show that Chairman Schuster was out of the country on vacation, and that all other members of the Agency were present. PRESENT: Sharp, Saltarelli, Kennedy, and Welsh ABSENT: Schuster Also Present: 5~ike Brotemarkle, Community Development Director Alan Warren, Senior Planner Dan Blankenship, City Administrator Tom Woodruff, Deputy City Attorney (3:40 p.m.) Midge 5~hl, Recording Secretary MINUTES After receipt of an inadvertently omitted page, the minutes of the regular and adjourned meeting held July 16, 1979 were approved as written, with the waiving of reading same. Mrs. Kennedy, however, stated she did not feel there was enough testimony given in the July 2 minutes which reflected the concern of thc op- position to Radiation Sterilizer. She, therefore, requested that the taped recording of that meetinq be held on file until ten (10) years from the date of that meeting. With no objection from the Agency, the Vice-chairman so ordered. PUBLIC HEARINGS Use Permit 79-22 Applicant: Location: Rmquest: Genge Consultants Northeasterly corner of Walnut Avenue and Jamboree Boulevard To develop a commercial office condominium project consisting of three 2- story structures with a total of 41,000 square feet. Vice-chairman Saltarell~ declared the public hearing open and asked if there was anyone to speak in favor or opposition to Use Permit 79-22. There being no one to speak, Mr. Saltarelli declared the public hearing closed ~d asked the pleasure of the Agency. Discussion was held concerning setback from residential areas and staff pro- cedures to ensure adequate parking once suites commenced to be occupied. At the request of Mr. Sharp conditions regarding a master sign plan were amended to include such in the CC&Rs. MOTION by Welsh, SECONDED by Sharp, to approve Use Permit 79-22 by the adoption of R~solution No. 1834, subject to modification as noted. Mr. Brotemarkle stated that although this was in conjunction with the Use Permit just approved, it had been advertised, therefore, had to be considered at a public hearing. This is advised due to recent court decJsions concerning tentative tract maps. Vice-chairman Saltarelli declared the public hearing open and asked if there was anyone who wished to speak in favor or in opposition to Tentative Tract ~p No. 10815. There b~ing no response he declared the public hearing closed and asked the pleasure of the Agency. MOTION by Sharp, SECOND]~D by Welsh, to recommend approval of Tentative Tract Map No. 10815 to the City Council by adoption of Resolution No. 1835. AYES: NOES: ABSENT: Sharp, Kennedy, Welsh, and Saltarelli None Schuster PUBLIC CONCERNS None OLD BUSINESS Use Permit 79-13 Applicant: Location: Request: Hon Development Newport Freeway and Tustin Village Way A drive-through photo kiosk 5~. Saltarelli said the Agency approved Use Permit 79-13 on June 4, 1979 and a drive-through kiosk was approved for the Center, with the stipulation that the final site plan be submitted for approval. Staff has reviewed the re- vised site pl~ and reco~cnends approval. There followed a discussion regarding the parking requirement. Mr. Brotemarkle said the applicant had ~omplied with the parking requirements and any use modification would be cause for reconsideration and possible revocation of the use permit on the grounds of inadequate parking. ~)TION by Sharp, SECONDED by Kennedy, to approve the revised site plan for Use Permit 79-13. AYq:: S: NOES: ABSENT: Sharp, Kennedy, Welsh, and Saltarelli Non e Schuster NEW BUSINESS Final Parcel Map 79-1031 Applicant: Locat ion: Iton Development Northeasterly corner of Tustin Village Way and McFadden Mrs. Kennedy asked if the applicant was aware of the proposed realignment of the 1-55 Freeway and the possibility that a portion of the Center could be affected. Mr. Brotemarkle stated yes, the applicant was aware of the proposed re- alignment. There followed a discussion as to whether or not any future applications for this area should be notified of the proposed 1-55 realignment. It was the consensus of the Agency that any future applications for development in this Planning Agency Minutes August 6, 1979 page 3. area should be made aware of the proposed future realignment of the 1-55 Free- way, how it might affect their development, and such should be part of the public record. MOTION by Welsh, SECONDED by Sharp, to recommend approval of Final Parcel Map 79-1031 to the City Council by adoption of Resolution No. 1~36. AYES: NOES: ABSENT: Sharp, Kennedy, Welsh, and Saltarelli None Schuster Use Permit 78-20 Applicant: Location: Request: Willis and Akins 130 South "B" Street Extension of time. Mr. Brotemarkle said Use Permit 78-20 was approved by the Agency on August 7, 1978 and since the Use Permit will be null and void after August 6, 1979, it would be an appropriate action to extend the Use Permit for a period of one year in order to allow thc developer time to finish the plan checking process and obtain financing. Ile indicated that a twelve month time limit on applications was insufficient in light of the ever increasing complexities of financing, environmental procedures, legal actions, necessary approvals from other agencies, new requirements and other actions being imposed on the development process. Staff would be communicating with the Agency in this regard in the near future. MOTION by Kennedy, SECONDED by Welsh, to extend the time period to August 6, 1980 for Use Permit 78-20. AYES: NOES: ABSENT: Sharp, Kennedy, Welsh, and Saltarelli None Schuster Ordinance No. 510 - E1 Camino Real Specific Plan No. 1 Mr. Brotemarkle said that Ordinance No. 510 should be a~ended and further he was requesting authorization from the Agency for the staff to prepare a study concerning establishment of a Parking District for the old town E1 Camino Real area. Discussion was held concerning parking needs of new and existing uses, the possible parameters and scope of a parking assessment district, inadequacy of the current code to provide funds for public parking facilities, and the need to correct such deficiencies. MOTION~y Kennedy, SECONDED by Sharp, to authorize the amendment of Ordinance No. 510 and that the staff prepare a Parking District Study, to be presented to the Agency in approximately ninety (90) days. Santa Fe Drive Mr. Brotemarkle stated that a minor concern to the staff regarding this plot plan is the minimum parking accommodation provided for the building. He said as a result, no further office expansion can be authorized for this development without additional parking being provided. Planning Agency Minutes August 6, 1979 page 4. MOTION by Kennedy, SF. CONDED by Saltarelli, to approve the site plan and that the office expansion limitation be noted on the final building plans.
