HomeMy WebLinkAboutPC Minutes 06-13-77MINUTES OF A REGULAR MEETING CITY OF TUSTIN PLANNING COMMISSION JUNE 13, 1977 A regular meeting of the City of Tustin Planning Commission was held on the 13th day of June, 1977, at 7:30 p.m., in the City Council Chambers, Centennial Way at Main Street, Tustin, Calif- ornia. The meeting was called to order at 7:30 p.m. by Chairman Glenn. PLEDGE OF ALLEGIANCE was led by Commissioner Robbins. INVOCATION was given by Commissioner McHarris. ROLL CALL Present: Commissioners: Glenn, McHarris, Hill, Robbins. Absent: Commissioners: Lathrop. Others present: R. Kenneth Fleagle, Assistant City Admininstrator, Community Development Director Daniel Van Dorpe, Assistant Director of Building and Planning Alan Burns, Deputy City Attorney Mary Ann Chamberlain, Planning Commission Recording Secretary APPROVAL OF MINUTES Moved by Hill, seconded by Robbins, to approve the minutes of May 23, 1977 as submitted. Carried 4-0. PUBLIC HEARINGS Initial 1. ENVIRONMENTAL IMPACT REPORT 77-2 For the purpose of evaluating the impact of a proposed planned commercial development located at McFadden Ave- nue, Tustin Village Way and the Newport Freeway on-off ramp. After the presentation of the staff report by Dr. Fleaqle, the public portion of the hearing was opened at 7:35 p.m. Jerry Buck, Hon Development Company, requested that since an additional dedication is necessary, they would like to build the skate palace building within one foot of the property line up to the freeway with no windows or openings, just one solid block wall. The public hearing was closed at 7:38 p.m. Commissioner Hill stated that the traffic was a great concern especially along Tustin Village Way and McFadden. After some discussion among the Commissioners pertaining to internal and external circulation and traffic patterns it was moved by McHarris, seconded by Robbins to recommend certification of EIR 77-2 by the adoption of Resolution No. 1630. Carried 4-0. 2. USE PERMIT 77-8 To permit the construction and operation of a Wendy's eat in and drive-thru restaurant, located at the south easterly corner of Tustin Village Way and the Newport Freeway on-ramp. After the presentation of the staff report by Dr. Flea~le, the public hearing was opened at 7:48 p.m. PC Minutes 6/13/77 Page 2 Ken Bates, 1310 N. McClain Drive, Santa Ana, presented a brief history of the Wendy's operation and spoke in favor of the use permit. Jerry Buck, Hon Development, addressed some of the problems and informed the Commission that they have prepared a new site plan for Wendy's along with the rest of the center and would be pleased to work out the problems with staff. The public hearing was closed at 8:05 p.m. Moved by Robbins, seconded by McHarris to approve Use Permit 77-8 by adoption of Resolution No. 1631. Carried 4-0. 3. USE PERMIT 77-9 To permit the construction and operation of an eat in and drive-thru restaurant known as Taco de Carlos, lo- cated southerly of Wendy's. After the presentation of the staff report by Dr. Fleagle, the public hearing was opened at 8:10 p.m. Seeing and hearing no one the hearing was closed at 8:11 p.m. After some discussion among the Commissioners pertaining to stacking of cars for this drive-thru restaurant it was moved by Hill, sec- onded by Robbins to approve Use Permit 77-9 by the adoption of Resolution No. 1631 with 2.b. to be amended as follows: 2/b. Modification of the plot plan to meet City of Tustin parking lot standards, with double stack- ing lanes authorized for drive-thru facilities. Carried 4-0. 4. USE PERMIT 77-10 To permit the construction and operation of a roller- skating rink known as Tustin Skate Palace to be located off McFadden, westerly of Newport Freeway. Dr. Flea~le reported that one free standing sign would be allowed for the total complex for all tenants for this center. Dr. Fleagle informed the Commission that the Hon Development Company had vol- unteered both inside and exterior security for the Skate Palace in order to assure that his new center would not be a liability to both the City and the developer. The public hearing was opened at 8:20 p.m. Jerry Buck, Hon Development Company, informed the Commission that they had conducted an extensive research program in Orange County which showed that four (4) stalls per thousand square feet gross floor area was adequate parking for skating rinks. Jerry Buck requested that staff be given the flexibility of relating parking spaces to the circulation and parking requirements on this site. The public hearing was closed at 8:38 p.m. After some discussion pertaining to the site plan, it was moved by McHarris, seconded by Hill to approve Use Permit 77-10 by the adoption of Resolution No. 1633 with the following changes: 2/b. Parking spaces may be reduced to resolve circu- lation patterns without decreasing building area. 2/i. Change in use will require a new Use Permit. Carried 4-0. PC Minutes 6/13/77 Page 3 5. AMENDMENT TO USE PERMIT 74-9 To amend the permit to authorize outdoor eating facilities for restaurants located in the Enderle Center at 17th and Yorba. After presentation of the staff report by Dr. Fleagle, the public was opened at 8:45 p.m. A1 Enderle, owner of Enderle Center, 3662 Carmel, Irvine, stated that he would be available to answer any questions. Hearing no one, the hearing was closed at 8:46 p.m. After a brief discussion it was moved by Robbins, seconded by Hill to approve the amendment to Use Permit 74-9 by the adoption of Resolution No. 1634. Carried 4-0. 6. USE PERMIT 77-11 To authorize the remodeling of an existing "Jack- in-the-Box" located at 17401 17th Street. After the presentation of the staff report by Dr. Fleagle, the public hearing was opened at 8:50 p.m. William Pope, 4833 Fruitman Avenue, Vernon, CA, informed the Commission that they would revise the sign to remove the top and would be willing to work with staff on the parking problem. Dr. Fleagle stated that there would not be parking problem but they would have to revise and add some landscaping to the existing site. The public hearing was closed at 8:57 p.m. William Pope, stated that he had no problems with the staff report but questioned the three wall signs. Dr. Fleagle informed that since they already had a pole sign they would be limited to three 25 square foot wall signs. Dr. Flea$1e also explained that they would be limited to 66 seats since they need one parking space for each three seats in the restaurant. Frank Greinke, 510 West Second Street, complained that the overflow parking from the Jack-in-the-Box is a problem to his business which is located directly across the street. Frank Greinke stated that the employees were parking in the street in front of his establishment instead of in their own parking lot. The public hearing was closed at 9:07 p.m. After some discussion pertaining to the parking William Pope stated that he had never heard of this employee parking problem and informed the Commission that he would get in touch with Frank Greinke on this problem. Dr. Fleagle suggested that William Pope look into the possibility of a drive-thru easement with the Sizzler Restaurant next door in order to provide good circulation for that area. William Pope said he would look into it. Commissioner Harris questioned if a three to one parking ratio is a legitimate number to work with for drive-thru restaurants in comparison with sit-down restaurants. Moved by McHarris, seconded by Hill to approve Use Permit 77-12 by the adoption of Resolution No. 1636. Carried 3-1. Robbins voting no. PUBLIC CONCERNS - None. OLD BUSINESS - None. PC Minutes 6/13/77 Page 4 NEW BUSINESS A short recess was taken and the meeting reconviened at 9:40 p.m. 1. TENTATIVE PARCEL MAP 77-95 Norman Pulliam for Larwin Square located at the south- westerly corner of First Street and Newport Avenue. Moved by Robbins, seconded by Hill to recommend approval to the City Council of Tentative Parcel Map 77-95 by the adoption of Resolution No. 1637. Carried 4-0. 2. TENTATIVE PARCEL MAP 77-96 Hon Development for Skate Palace Development loca- ted at McFadden, Tustin Village Way and Newport Freeway on-off ramp. Moved by McHarris, seconded by tlill to recommend approval to the City Council of Tentative Parcel Map 77-96 by the adoption of Resolution No. 1639. Carried 4-0. 3. TENTATIVE PARCEL MAP 77-97 Hamer, Carpenter for professional office development on Yorba between Vandenberg Lane and Jacaranda. Moved by Hill, seconded by McHarris to recommend approval to the City Council of Tentative Parcel Map 77-97 by the adoption of Resolution No. 1639. Carried 4-0. AUDIENCE PARTICIPATION - None. CORRESPONDENCE - None. STAFF CONCERNS - Dr. Fleagle announced an Energy Standards conference on June 22 in Long Beach. COMMISSION CONCERNS Commissioner Robbins commented that he would still like to see a skate board rink built in Tustin. Dr. Fleagle informed that they are still looking at the Utt Park site on Nisson Road that is presently State property. Commissioner McHarris commented that he would like to see a study compiled for restaurants and parking standards. Sit-down restaur- ants vs. take-out restaurants. Mr. McHarris also commented on the Sign Ordinance amendment for open house sign provisions. Dr. Flea~le stated that he feels we have the attention of the agencies since we are not getting repeating offenders. Commissioner Glenn stated that he felt that all Commissioners would gladly volunteer to serve without pay and that they would be willing to serve the City in any capacity that they could continue to serve in the future.
