The meeting was called to order at 7'30 p.m. by Chairman Glenn. PLPDGE OF ALLEGIANCE was led by Commissioner McHarris. INVOCATION was given by Commissioner Lathrop. Carried 3-0, Glenn and Lathro? abstaining. PUBLIC HEARINGS Continued 1 ~!ENDMENT TO USE PE~!IT ~ = · ~-~ (Maurice Lebanoff ~()r Swensens) To authorize deviation in approved master sign plan for Tustin Village located at the Main-Bryan-Newport triangle. After the presentation of the staff report by Alan Warren, .Mr. McHarris informed the Commission that he did meet with the appli- cant and reviewed the problem and discussed alternative si~rxing. The public hearing was opened at 7' 38 p.m. by Chairma. n C--le~_~n. Maurice Lebanof£, applicant, requested a continuance as he has solicited help from Swensens and also has not received a legal opinion back ~rom his attorney. The public hearing was closed at 7'53 p.m. After some discussion, it was m__9oved by McHarris~ seconded by Lathrop, to continue this item as an open public hearing until. the next regular meeting and allow Swensens to retain the use o£ the banner. Carried 5-0. Chairman Glenn commented that the anti-business charge made by Mr. Lebano£r cou].d be made in any city when a developer's plans conflicted with the city's established standards. I{e said that the staff only follows tne instructions given them by the Con]- mission and City Council. Planning Commission Minutes 5/9/77 Page two PUBLIC HEARINGS Initial VARIANCE 77-4 (Paul Waterman on behalf of Mr. and Mrs. Molnar) To vary with the zoning ordinance to permit construction of a room addition which would exceed the 40% allowed coverage by 166 square feet. Location: 17441 Norwood Park Place After presentation of the staff report by Mr. Warren, the public portion of the hearing was opened at 8:05 p.m. Mr. Paul Waterman, applicant, related to the Commission that the 40% coverage does include a covered breezeway and covered porch at the rear of the home. The owner now requests an extra bed- room because of the size of the fami].y, and this area would only equal the area that is covered by the entrance way. Dr. Fleagle commented that the total exception is on].y 3% more than the 40% allowed lot coverage, and others could be granted the same exception due to the design of the floorplan on the lot. The pub]ic portion of the hearing was closed at 8:15 p.m. Moved by McHarris~ seconded by Lathrop~ that the applicant be allowed to add on to the existing home with the following justi- fication: the entry porch area is a connection of two open areas and not a livable area, and the design as submitted should be approved. Carried 5-0. o ~iEA~MENT TO SIGN ORDINANCE as adopted by Ordinance No. 684, to add Section 7 to Article II. After presentation of the staff report by Dr. Fleagle, the pub- lic portion of the hearing was opened at 8:38 p.m. ~r. Jay Braccini, Manager of the Chamber of Commerce, stated that he feels the City should take legal action against the sign companies rather than requiring them to post bonds. The hearing was closed at 8:30 p.m. After some discussion among the Commissioners, it was moved by Hill, seconded by Lathrop, to recommend approval to the City Council of the addition of Section 7 to Article II of the Sign Code, by the adoption of Resolution No. 1625, with the initial sentence of No. 2 corrected to read: "Section 7 - Assurance Bond - When a sign con- tractor has been put on written notice .... " Carried 5-0. 3. AMENDMENT TO ZONING ORDINANCE - PARKING REQUIREMENTS Dr. Fleagle presented the following amendments to the Zoning Ordinance: a. Establish a minimum parking requirement of 2 spaces per dwelling unit. b. Provide for the determination of parking accommoda- tions for senior citizen housing projects by the Planning Commission at the time of a use permit hear- ing. c. Specify the parking spaces both covered and enclosed shall be not less than 10' x 20' in inside dimensions for each parking space. Planning Commission Minutes 5/9/77 Page three The public hearing was opened at 8:49 p.m. There being no com- ments or objections, the hearing was closed at 8:50 p.m. Commissioners Lathrop and Hill contended that requiring every developer to provide two parking spaces per unit in the multi- family districts would have an adverse economic impact on the economically disadvantaged. After some discussion among the Commissioners pertainin~ to p~rk- ing standards for apartments and senior citizen projects, it was moved by Robbins, seconded by Mcltarris~ to recommend approval to the City Council of the parking requirements by the adoption of Resolution No. 1626. Carried by roll call. .Ayes: Glenn, MciIarris, Robbins. Noes: !{ill, Lathrop. Absent: none. PUBLIC CONCERNS - NONE. OLD BUSINESS 1. POLE SIGN - 100 West First Street Moved by Lathrop~ seconded by Hill, to..approve the sign plan as submitted~ subjept to the consent of the property owner for the Redevelopment A~ency to install a directional sign at subject location~ without cost to ~he property owner. Carried 5--0. Mr. Gerald Stanfield, Imperial Thrift, requested that he be able to use his blue and white colors on his signing. The Com- mission found no objection to the colors and directed sta.ff to coordinate the colors as to be compatibl, e with the remainder of the signing for the center. 2. NEWPORT ~OULEVARD ~NVIilON:,!ENTAL IMPACT REPOKT 1S1 Location: St. John Place to Greenbrier Road. Commissioner McHarris presented the three different alternatives that were discussea in the report. The Commission .~ound the draft EIR adequately addressed the related environmental con-. cerns. There was less than total satisfaction with the project; however, alternative 2 would have the least advezse impact upon the area and the environment. Movea by McItarris~._seconded by Robbins~ to recommend that the City Council authorize the Mayor to send correspondence to the Orange County Plan~ing Commission recommendin$ the certification of EIR 121 and the endorsement o£ alternative 2 alignment. Carried 5-0. NEW BUSINESS 1. ORANGE COUNTY DRAFT E.~?VIRONMENTAL IMPACT REPORT 301 Location: Newport Avenue from Wass to l?th Street. After some discussion, it was moved'by Hil~ seconded by Lathrop to recommend to the City Council that the Mayor be authorized to recommend certification of the EiR for the street improvement project? subject to further consideration of the parcels that will be created with noncon£ormin$ front yard setback areas and the accommodation o£ bicycle traffic within the public right-of-way. Carried 5-0. AUDIENCE PARTICIPATION - NONE. Planning Commission Minutes 5/9/77 Page four STAFF CONCERNS 1. PREZONE 77-3 Area easterly o'£ Newport Avenue, bounded by Orange, Bonita, and San Juan. l)r. Fleag].e advised the Commission that the City Council had approved a 4-lot depth of commercial development along Newport Avenue rather than the 3-lot depth that the Commission had approved. Dr. Fleagl. e requested that the Commission authorize the Chairman to send a report to the City Council concurring in the amended district boundary and authorize staff to advertise a prezone amendment for the Newport Avenue frontage to the Com- mercial General District for a 4-lot depth. Moved by Lathrop, seconded by McHarr~s~ to approve the draft report as attached and authorize a public hearing for the pre- zoning of the commercial frontage on Newport Avenue. Carried 5-0. 2. ORANGE COUNTY FLOOD PLAIN MAP Dr. Fleagle informed the Commission that correspondence had been received from the Orange County EMA stating that the area in the Annexation 81 area would be eliminated l'rom the Orange County Flood Plain Map upon certification of that annexation. 3. PUBLIC NOTICE FROM CITY OF IRVINE Dr. Fleagle reported that the City had received a public hearing notice from the City el' Irvine announcing that the Ranch Market would be expanding into the model home site at 14002 My~ord Road. Notice was received and filed and no action was taken. 4. PRELIMINARY BUDGET FOR 1977-78 Dr. Fleagle presented a copy of the preliminary budget to the Commissioners £or their review. COMMISSION CONCERNS 1. Commissioner Itill expressed his concerns regarding the Housing and Community Development Act or 1974 and how the money will be spent in Tustin. Mr. Hill stated that there is a lot o~ concern regarding housing for the elderly in Tustin. Dr. Fleagle advised there would be a public hearing regarding this matter on May 16, 1977, be£ore the City Council. 2. Chairman Glenn commen~ed that he fel~ it is time for the Commissioners and Councilmen to go to bat l'or the staff. Some of the citizens criticize stafr, while sta~ is only carry- ing out the wishes of the Commission and Council.
