Home My WebLink AboutORD 737 (1977)338 ' I ORDINANCE NO. 737 ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF ~ CERTAIN UNINHABITED TERRITORY, DESIGNATED "RED HILL- MELVIN ANNEXATION NO. 100" TO THE CITY OF TUSTIN, 4 CALIFORNIA 5 The City Counci~ of the City of Tustin, California, _ 6 does ordain as follows: 7 ~qHEREAS, pursuant to the provisions of the Government Code of the State of California, application was made to the 8 Local Agency Formation Commission to annex to the City of Tustin all that territory situate in the County of Orange, State of 9 C~lifornia, hereby designated as "Red Hill-Melvin Annexation No. 100", and described in Exhibit "A" attached hereto and incor- ~0 -porated herein by this reference as though set forth herein in full; and WHEREAS, the Local Agency Formation Commission, in session duly assembled, on June 22, 1977, did adopt the negative declaration and approve said proposed annexation; and WHEREAS, the City Council hereby finds and determines ~4 that all of the territozy is uninhabited within the meaning of Government Code Section 35303, and that said territory is con- ~5 tiguous to the City of Tustin; and 16 WHEREAS, on the 5th day of J,uly, 1977, the Council of the City of Tustin did pass and adopt Resolution No. 77-69 17 giving notice of the proposal to annex certain uninhabited territory to the City of Tusitn, said territory being therein 18 designated as "Red Hill-Melvin Annexation No. I00", said resolut~ describing the boundari'es of the territory proposed to be annexe~ -19 and WHEREAS, said Resolution contained a notice of the day, hour and place when and where the Council of th~ Cit',' of Tustin would hear protests made by any person owning real ~r.~ropert,. within the territory proposed tc be annexed, the time of said hearing being prescribed by law; 'and ~HEREAS~ on the 15th day of August, 1977, at the hour of 7:30 o'clock, P.M., in the Council Chambers, Centennial at Main in the City of Tustin, County of Orange, State of California said time and place being the day, hour and place fixed in said Resolution for hearing protests to the said annexation~ the said City Council did hear and pass upon any and all protests made to the proposed annexation and did determine that insuf- ficient protests had been made by the owners of the privately and publicly owned territory proposed to be annexed as deter- mined by said legislative body; and ~8 WHEREAS, said territory is uontiguous to the City of Tustin, and is uninhabited territory in the County of Orange; and 50 WHEREAS, the property within the annexed territory shall ' be taxed to Day the indebtedness and liability of the City con- ~1 tracted to or existing at the time of annexation. 1' 2~ I 3 4 5 6 I 7~i 8 9! i I 101 11' 12 13~ I 14~ 15 16 17 18'~ 19 20~~ i 21'~ 22 II 23~' 24' 25 26 27 28 29 30 31 NOW, THEREFORE, the said Council of the City of Tustin, does hereby approve the annexation of the territory hereinafter described to the City of Tustin, and does hereby further ordain that said territory be and it is hereby annexed to the City of Tustin. That said territory, the annexation of which to the City of Tustin is hereby approved, is all the territory situated in the County of Orange, State of California, i;~ore particularly described in Exhibit "A" attached hereto and made a part hereof by this reference. That the property within the annexed territory shall be taxed to pay the indebtedness and liability of the City contracted to or existing at the time of annexation. PASSED AND ADOPTED at a regutar meeting of the City Council of the City of Tustin, California, held on the 6th day of September 1977.
