HomeMy WebLinkAboutPC Minutes 07-26-76 MINUTES OF A REGULAR MEETING OF THE CITY OF TUSTIN PLANNING COMMISSION July 26, 1976 The regular meeting of the City of Tustin Planning Commission was held on the twenty sixth day of July, 1976, at the hour of 7:30 p.m., of said day in the Council Chambers, City }/all, Centennial at Main, Tustin, California. The meeting was called to order at 7:30 p.m. by Chairman Hill. PLEDGE OF ALLEGIANCE was led by Commissioner McHarris. INVOCATION was given by Commissioner Robbins. ROLL CALL Present: Commissioners: Hill, Lathrop, McHarris, Robbins Absent: Commissioners: Glenn Others Present: Dr. R. Kenneth Fleagle, Assistant City Administrator for Community Development Scott Nichols, City Attorney's Office Daniel Van Dorpe, Ass't Planning and Building Official APPROVAL OF MINUTES Moved by Robbins, seconded by Lathrop that the Minutes of July 12, 1976 meeting be approved. MOTION CARRIED: 4-0 PUBLIC HEARINGS 1. Use Permit 76-15 - Akins Development Company - to authorize the construction of a professional office building in the (CG) Commercial General District. Location: 120 South "B" Street. Dr. Flea~le presented a synopsis of the staff report, indicating the concerns related to the parking lot and traffic circulation. Chairman Hill opened the public hearing. Mr. Ed Akins, applicant, 310 West First Street, spoke in behalf of the project. IIe stated that the building is for a single pur- pose for a single tenant and would not have vehicle problems. He acknowledged that the design does not meet parking lot and cir- culation standards; however, there was no alternative for a lot 50' x 100' The comments of the staff departments were addressed by Mr. Akins. There being no one else to speak for or against the project, Chairman Hill closed the public hearing at 8:15 p.m. Commissioner McHarris concurred that enhancement of the area was more important than strict compliance with traffic design. Chairman Hill stated that the configuration of "B" Street at the site of the proposed building would not cause a traffic problem, and with the desire to retain the trees, the proposed solution was compatible to the site. PC Minutes 7-26-76, Page 2 Commissioner Lathro~ suggested that traffic circulation could be enhanced by interconnecting the adjoining parking lots. Commissioner Robbins stated that he could see no logic in solving one problem only to create another problem related to parking and traffic circulation. He was not convinced ~hat the proposed use and design was the best and only solution for the development of the property. It was moved by Lathro~, seconded by McHarris that Use Permit No. 76-15 be approved in concept'~ to include permissive drive-thru access between the adjoining parking lots, with staff directed to prepare a resolution of approval for adoption at the next regular meeting. AYES: NOES: ABSENT: McHarris, Lathrop, Hill Robbins Glenn Use Permit 76-16 - Roderick Fraser, to authorize the placement of an 8' x 16' ice vending machine in the parking lot of Don Jose Restaurant at 14882 Holt Avenue. Dr. Flea~le presented a synopsis of the staff report. The public hearing was opened and closed with no one to speak for or against the proposal. Commissioner La%hrop felt that there was no basis of compatibility since there were no adjacent commercial structures. After some discussion, it was moved by Robbins for the approval of Use Permit 76-16 by the adoption of Resolution No. 1526. The motion died for lack of a second. After further discussion, it was moved by Robbins, seconded by Hill to continue this hearing to the next regular meeting. MOTION CARRIED: 4-0 Absent: Glenn Staff was directed to notify the applicant of an interest by the Commission to deny this permit. Use Permit 76-17 - Garden Resources, Inc., to authorize a permanent pole sign of 12 feet in height and 32 square feet in area. Location: 700 West First Street. The public hearing was opened by Chairman Hill. Carol Hammond, applicant, made the following comments in favor of a pole sign: e A monument sign would create a hazard. The above property has a considerable set-back while the adjoining property fronts on the property line. The above property does not have any commercial attraction and the additional lighting would be beneficial to the neighborhood. A reader board is requested which would be a supplemental sign of 10 square feet. Mr. Jim Kyrsten commented that he feels the site needs identifi- Cation because only after the greenhouse was placed on the site did he realize that there was a greenhouse business located at that site. The public hearing was closed at 9:05 p.m. PC MINUTES 7-26-76, Page 3 Commissioner McHarris commented that he felt this was a good pro- posal and warrant~d'~ithin the limits of a supplemental sign. After some discussion, it was moved by McHarris, seconded b~. Robbins for the approval of Use Permit 76-17 by the adoption of Resolution No. 1526, with reader board to be 10 square feet maxi- mum as a supplemental sign with no restriction of content. MOTION CARRIED: 4-0 Absent: Glenn PUBLIC CONCERNS - None OLD BUSINESS 1. Resolution of Approval for Use Permit 76-14 (Mervyn's) Location: Holt Avenue, Newport Avenue, First Street, and Irvine Blvd. It was moved b~ McHarris, seconded by Lathro~ to approve Use Permit 76-14 by the adoption of Resolution No. 1528. MOTION CARRIED: 4-0 Absent: Glenn NEW BUSINESS 1. Entrance to Sycamore Avenue for Tustin Meadows It was moved b~ Lathrop, seconded by Hill to approve the entrance to Sycamore Avenue for the Tustin Meadows Homeowners Association as presented. MOTION CARRIED: AYES: Hill, Lathrop McHarris ABSTAINED: Robbins ABSENT: Glenn 2. Park Plan for Tract 8912 (Tennis Courts) Dr. Fleagle advised the Commission that the tentative plan is still under review by staff. AUDIENCE PARTICIPATION Mrs. Agnes Bacon complained to the Commissioners that the meetings are too long and involved and appears that the Commissioners have not looked at the site involved. Commissioner Lathrop stated that he asks questions in order to get the applicant's response. At least one day a week is spent in re- viewing plans only to sometimes see Council override a Commission decision. CORRESPONDENCE The correspondence items were received and filed. STAFF CONCERNS - None COMMISSION CONCERNS Commissioner McHarris responded to Mrs. Bacon's complaint that in regards to the Mervyn's plans, the Commission usually receives better and more involved plans than what had been presented. His concerns revolved around traffic, circulation and landscape design. Commissioner McHarris informed the Commission that he would be on vacation for the two meetings in August. PC Minutes 7-26-76, Page 4 Mr. Bill Moses, editor of the Tustin News inquired if his property is in the E1 Camino Real Redevelopment Agency area, and if so, he strongly objects to the inclusion.
