HomeMy WebLinkAboutPC Minutes 05-10-76 MINUTES OF A REGULAR MEETING OF THE CITY OF TUSTIN PLANNING COMMISSION May 10, 1976 The regular meeting of the City of Tustin Planning Commission was held on the tenth day of May, 1976, at the hour of 7:30 p.m., of said day in the Council Chambers, City Hall, Centennial Way at Main, Tustin, California. PLEDGE OF ALLEGIANCE was led by Commissioner Glenn. INVOCATION was given by Commissioner Robbins. ROLL CALL Present: Commissioners: Hill, Glenn, Lathrop, McHarris, Robbins Absent: Commissioners: None Others Present: Alan Warren, Planning Technician Mary Ann Chamberlain, Planning Commission Recording Secretary Scott Nichols, City Attorney's Office APPROVAL OF MINUTES Moved by McHarris, seconded by Lathro~ that the minutes of the April 26, 1976 meeting be approved. MOTION CARRIED: 5-0 PUBLIC HEARINGS Use Permit 76-9 - Tustin Water Works, to authorize the drillinq of a new domestic water well for additional supply of domestic water to serve the Tustin area. Location of Well: Livingston. Prospect-Beneta Park Site on Beneta Way, west of After a summary of the staff report, the public hearing was opened at 7:35 p.m. Mr. Earl Rowenhorst, 245 Main Street, Tustin Water Works, informed the Commission that there are eleven different such sites in the City at present. Commissioner Robbins questioned the location near the Flood Control Channel and if the water company had been given approval from the Flood Control District. Mr. Rowenhorst replied that they would apply to the Flood Control after the City would hopefully give permission. Mr. Ed Ed~ecomb, 17982 Lucero Way, Tustin, stated that he wanted to be certain, that if the well would be a noise hazard to the surround- ing residents, the City would take precautions to alleviate the problem. The public hearing was closed at 7:45 p.m. After a brief discussion among the Commissioners, it was moved bv Lathrop, seconded by Robbins that Use Permit 76-9 be approved by the adoption of Resolution No. 1510 as drafted. MOTION CARRIED: 5-0 PC MINUTES 5-10-76 - PaGe 2 Use Permit 76-10 - A. J. Tustin Corporation (Manny's Coffee Shops) to authorize the addition of a patio to the existing restaurant for the purpose of outdoor dining facilities, located at 17231 17th Street. After a summary of the staff report by Mr. Warren, Commissioner McHarris questioned staff if this would be an o~en patio area. Mr. Warren stated that the plans showed this would be an open patio for outside dining facilities. The public hearing was opened at 7:50 p.m. Mr. J. P. Taylor, manager of Manny's, stated that they originally were trying to accommodate 38 in the patio area but they would cut down to 30 seats to comply with the Fire Department regulations. As to the parking, they were originally required to have 55 stalls and as of now there are 87 existing stalls. Commissioner McHarris questioned the 10 foot dedication requirement. Mr. Taylor explained that he had reviewed this requirement with the property owner who had stated that he was not willing to dedicate the 10 feet at this time. However, Mr. Taylor stated that he would com- ply to all of the other conditions of the Use Permit. Commissioner Lathrop questioned if this patio dining would be in the evening also. Mr. Taylor informed that it would be mainly during the daylight hours and only in warm weather. The public hearing was closed at 8:00 p.m. After some discussion, it was moved by McHarris, seconded by LathroD to approve Use Permit 76-10 with conditions as listed with the ex- ception of the right-of-way dedication and directed staff to prepare a resolution of approval for the next regular meeting. MOTION CARRIED: 5-0 Use Permit 76-11 - George Metsovas - to authorize the construction of a commercial building on the southwest corner of E1 Camino Real and First Street. Commissioner Lathrop stated that he would abstain from voting on this project because he is the adjoining property owner but inferred that he is in favor of the plan. After a summary of the staff report by Mr. Alan Warren, the public hearing was opened at 8:08 p.m. Commissioner McHarris questioned the pedestrian traffic and if a sidewalk would be required. Staff informed the Commission that a sidewalk exists and was not clearly shown on the plot plan. Commissioner Lathrop questioned the drainage of the building and the rest of the property. George Metsovas, applicant, stated that the front of the Dropert¥ would drain onto First Street and the easterly side and building would drain onto E1 Camino Real. The public hearing was closed at 8:15 p.m. After some discussion, it was moved by McHarris, seconded by Robbins to approve Use Permit 76-11 by the adoption of Resolution No. 1511 with the addition of 2 (f) The tile mansard shall cover the entire eastern elevation. MOTION CARRIED: 4-0 Commissioner LathroD abstained. PC MINUTES 5-10-76, Page 3 Moved by McHarris, seconded by Robbins to advance the Old Business Items out of order and consider the fourth public hearing (Sign Code) after Old Business. MOTION CARRIED: 5-0 4. Sign Code Revisions - The proposed revisions are for the purpose of specifying the permitted heights, sizes and number of signs authorized for residential, professional, commercial and indus- trial developments. (See Appendix to the Minutes) PUBLIC CONCERNS - None OLD BUSINESS 1. Use Permit 76-7 - OCR building for Thiokol/Dynachem Moved by Robbins, seconded by Lathrop to adopt Resolution No. 1507 approving Use Permit 76-7. MOTION CARRIED: 5-0 2. Use Permit 76-8 - Fotomat, Tustin Square Shopping Center Moved by Lath~op, seconded by McHarris to adopt Resolution No. 1505, approving Use Permit 76-8. MOTION CARRIED: 5-0 3. Tentative Tract 9345 - Sand Dollar Development Corporation, 17th Street, west of Laurinda Way Commissioner Robbins questioned Mr. Wallace if all of the homes will have three car garages. Mr. Wallace answered in the affirmative. Commissioner Robbins stated that he does not like the configuration of the first lot and recommended putting in a recreation area and swimming pool with a community association. Mr. Wallace explained that they had moved the street 15 feet to the west to give deeper lots on the easterly side of the tract. After some discussion among the Commissioners, it was moved by Lathrop, seconded by McHarris to adopt Resolution No. 1508, approving Tentative Tract No. 9345 with the following additions: 1. The homes be moved back an additional 10' on lots 1 and 2. 2. Design of the screen wall to the satisfaction and approval of the staff. MOTION CARRIED: 4-1, Mr. Robbins opposed. NEW BUSINESS - None AUDIENCE PARTICIPATION - None CORRESPONDENCE 1. Memo from City Attorney regarding handicapped persons' facilities in residential zones. Moved by Hill, seconded by Lathrop that a public hearing be adver- tised to amend the Zoning Ordinance to permit handicapped persons' facilities in residential homes upon issuance of a conditional Use Permit. PLANNIN.C~COMMISSION I~ECORDING SECRETARY APPENDIX TO THE MINUTES SIGN CODE HEARING May 10, 1976 Chairman Hill gave a resume on the sign code and the steps that have been taken thus far by the Planning Commission. Chairman Hill suggested that after the public hearing is closed, the Commissioners review and vote on the changes included in their packets in order to finalize their position to the City Council. The public hearing was opened at 8:40 p.m. Mr. Rubin Kvidt, 13372 Epping Way, Tustin, requested on behalf of the Orange County Board of Realtors that they be permitted open house signs on a restricted basis with the real estate industry policing them. Mr. Kvidt also commented that he felt some build- ings in Tustin need larger signs. Commissioner McHarris questioned Mr. Kvidt if he realized the Commission was suggesting only one open house sign per subject property. Mr. Kvidt stated that he thought they should only be allowed one per corner but would need more than one sign to find homes in large subdivisions. Mr. Kvidt also stated that there would be no advertising on the open house signs,only the name of the firm in one inch letters. Commissioner Glenn questioned how the Board would police the pri- vate parties that were also selling homes and displaying open house signs. Mr. Kvidt suggested that everyone displaying open house signs should be required to post a bond and if the signs were not removed at the specified time, the bond would be forfeited to the City. Commissioner Robbins questioned Mr. Kvidt if there would be any public benefit of the fair market value of a home if it had better exposure from an open house, etc. Mr. Kvidt replied in the affir- mative. Ms. Helen Crider, Vice President of Coast Federal Savings and Loan Association, stated that both City and business representatives had reviewed this Sign Code and in the public hearings two years ago, 23 of their 27 suggested amendments were changed by the City Council. The Committee has again met and substantially submitted the same changes again. Ms. Crider commented that the Committee has given considerable thought for the City of Tustin and the businessmen of the City. The Chamber would like to see a beautiful city and a viable business community. The public hearing was closed at 9:12 p.m. The following suggested amendments were discussed and then voted on by the Planning Commission. After the voting was completed, it was moved by Hill, seconded by Lathrop that these approved amendments be submitted to the City Council as the Commission's recommendations. MOTION CARRIED: 5-0 Other possible changes were discussed but tabled for further action.
