HomeMy WebLinkAboutPC Minutes 02-23-76 MINUTES OF A REGULAR MEETING OF THE CITY OF TUSTIN PLANNING COMMISSION February 23, 1976 The regular meeting of the City of Tustin Planning Commission was held on the 23rd day of February, 1976, at the hour of 7:38 p.m., of said day, in the Council Chambers, City Hall, Centennial at Main, Tustin, California. The meeting was called to order by Chairman McHarris. PLEDGE OF ALLEGIANCE was led by Commissioner Lathrop. INVOCATION was given by Commissioner Shambeck. Kenneth Fleagle, Assistant City Administrator- Community Development Director James Rourke, City Attorney Mary Ann Chamberlain, Planning Commission Recording Secretary APPROVAL OF MINUTES Commissioner Hill commended Dr. Fleagle for his writing of the February 9 Minutes. Moved by Sucher, seconded by Hill that the minutes of February 9, 1976 be approved. MOTION CARRIED: 5-0 PUBLIC HEARINGS 1. Use Permit 76-4 - Econo-Lube, Inc., to authorize the construction of an auto i-ubrication and tune-up facility in the Commercial General (CG) District. Location: Northeast corner of First and "C" Streets. Dr. Fleagle pre~ented the staff report and suggested that the bays be reduded to 3 rather than the 4 that were requested, due to the inadequacy of parking for employees and customers. The Public hearing was opened at 7:48 p.m. Mr. Walt Frederickson, 12912 Dean Street, owner of the property, presented a brief hi~tory of the property. Mr. Robert Overdevest, applicant, explained the nature of the busi- ness an~ that emphasis of the operation is speed and efficiency in lube jobs and minor tune-ups. Mr. Overdevest referred to their five other operations in Orange County regarding the parking situation and speed of their operations and confirmed that three parking spaces have been more than adequate for their other sites. PC Minutes Page 2 2-23-76 In response to Commissioner Lathrop's question regarding mainte- nance and repairs, Mr. Overdevest explained that they are not a repair shop, only lubrication a~d minor tune-ups. Commissioner Shambeck commented that he felt there should be land- scape screening along the property line on "C" Street. The public hearing was closed at 8:10 p.m. After some discussion among the Commission, it was moved by Sucher, seconded b_y S~a_mbeck, to adopt Resolution No. 1497, approving Use Permit 76-~, wfth the following amendments to the draft: (h) The applicant has represented that no major tune-up or repair work will be undertaken on the premises and upon that basis and in reliance on such representation, this use permit has been approved. The Planning Commission hereby grants a use permit as applied for, to allow the construction and operation of an automobile lubrication and tune up facility, to consist of 4 service bays in accordance with revised site plans submitted to the Planning Commission February 20, 1976 with the exception that the side- walk be realigned and perimeter landscaping along parking stalls, with the signing limited to 54 square feet on the southerly face of the southerly building, one sign on the side wall of each building with "C" Street exposure not to exceed 10 square feet, and 10 square foot sign on the southerly side of the northerly building. (a) Northerly exit door to the northerly bays shall be kept closed during any tune up work upon the vehicles to avoid creating a nuisance to the abutting property owners. MOTION CARRIED: 5-0 Variance 76-2 - Robert Dolley, to vary with the sign ordinance for auth6rity to retain leasing sign for not more than one year. Location: 1442 Irvine Blvd., southwesterly corner of Irvine and Red Hill Avenue. Dr. Fl~a~le presented the staff report and informed the Commission that t~h~ time frame for this permit would be one year as requested unless all units were leased and occupied prior to that date. The public hearing was opened at 8:40 p.m. Mr. Robert Dolley, 1612 Windon Court, requested the authorization of h~s "For Lease" sign because of the remoteness of this building from other professional office suites on Irvine Blvd. Commissioner Sucher questioned Mr. Dolley what steps he had taken to try to lease the building. Mr. Dolley responded that he had employed two different leasing agencies to assist him in finding lessees. Commissioner Lathro~ questioned Mr. Dolley if he would be willing to ~ down ~e sign if the building were leased before the year had expired. Mr. Dolley answered that he would be willing to take the sign down when 85% of the building was leased because at that time he would then make plans to proceed with the second phase of his development. Commissioner Sucher questioned if he would be willing to repaint the s~gn--~f ~e~ed. Mr. Dol~ey stated that he would see that the sign is kept in a good state of repair at all times. ~. Dolle~ stated that his comments regarding the amending of the present s~gn code with regard to professional buildings are that the PC Minutes 2-23-76 - Page 3 small sign is dwarfed against any two story office building, unless a particular instance where you have a long front yard and not very much landscaping. Otherwise the sign is behind bushes and trees and is lost. This comment was for both permanent and temporary signs. He further stated that temporary leasing signs should be allowed to remain up longer than 6 months if necessary since 6 months is not a very long period to lease out a large professional building. The public hearing was closed at 8:50 p.m. It was moved by Sucher, seconded by Hill, that Resolution No. 1498, approving Variance 76-2 be adopted, with the following amendments to the draft: The Planning Commission hereby grants a variance as applied for, to permit a 3' x 5' "For Lease" sign, subject to the following conditions: That said sign shall be removed upon full lease of subject building. Subject sign shall be maintained in accordance with Sign Ordinance No. 614, Article 4, Section 1. MOTION CARRIED: 5-0 Variance 76-3 - Cal-Va Dairy to vary with the sign ordinance for ~u~h~r~ty to install a monument sign on a property with less than 150' frontage. Location: 14021 South Yorba Street Dr. Fleagle presented the staff report and explained that due to the nature of the proposed business, being the only commercial activity on the west side of Yorba, the sign is not objectionable either as a monument or as a pole sign. Commissioner Shambeck stated that because of his relationship with this development he would abstain from this hearing. The public portion of the hearing was opened at 9:00 p.m. Mr. A1 Enderle, owner of the property, 3662 Coronado, presented a background-in the development of the Enderle Center and explained that the Cal Va Dairy had to be moved from the 17th Street frontage to Yorba in order for the new development of Enderle Center to commence. In response to Commissioner Sucher's question pertaining to an over- all sign plan for the center, Mr. Enderle explained that there is an overall plan with two pyramid type signs to be situated at the corner of 17th and Yorba, and at the corner of 17th Street and Enderle Center Drive. This particular site is not part of Enderle Center but rather a separate commercial business. Commissioner McHarris commented that he had reviewed the site and felt that it Would not necessarily be a visual problem if the monu- ment sign were moved back a few feet. Commissioner Hill commented that even if they did go to a pole sign, they would have a problem with all the high trees that are located on the site as far as visibility of the sign was concerned. Mr. tIenry Hunt, applicant, informed the Commission that he had been in business in Tustin for over fifteen years with good exposure and now with this new location, he was in need of better exposure via a sign that could be seen from 17th Street. The public hearing was closed at 9:30 p.m. PC Minutes 2-23-76 - Page 4 After some discussion among the Commission pertaining to the con- dition of placing the monument sign 8 feet behind the property line, Dr. ~lea~q~q~ commented that he felt it was not necessary to place the sign that far back from the property line if the sign were moved a few feet to the north. Commissioner Sucher questioned if there was a way the Commission could approve the variance and leave the pending matter of the sign design and location to staff. Drz_F~agle answered that it could be done with the right of appeal to the Commission by the applicant. Moved b~j~ Sucher, seconded by ~athrop, to adopt Resolution No. 1499, approving Variance 76'3, Wft~ the following amendment to the draft: The Planning Commission hereby grants a variance for a free standing sign for property with 116' frontage subject to the following conditions: The design and location of the requested signing shall be subject to the approval of the staff with right of sign review by the Commission upon request of the applicant. MOTION CARRIED: 4-0 Commissioner Shambeck abstaining. Pre-Zone 76-1 - Marine Corps Air Station (H) from the Orange County Industrial (M) District to the Public and Institutional (P&I) District, effective upon annexation to the City of Tustin. Location: Red Hill Avenue, bounded by Moulton Parkway and Barranca Road. Dr. Flea~le presented the staff report and commented that the ~l~n~ ~ommission and City Council, in the adoption of the Tustin Area General Plan on April 16, 1973, had determined that the appro- priate classification for this base would be "Military" and there- fore fall within the Public and Institutional District. The public portion of the hearing was opened at 9:35 p.m. Seeing and hearing no one, the hearing was closed at 9:36 p.m. Moved by Sucher~ seconded by L_a_th.ro_p, to adopt Resolution No. 1500, reco-m~endfng approval of PZ 76-1 to the City Council, effective upon annexation to the City of Tustin. MOTION CARRIED: 5-0 PUBLIC CONCERNS - None OLD BUSINESS - None NEW BUSINESS 1. N_e_w~p_o_rt _Avenue Vehicular Access After some discussion among the Commission pertaining to curb cuts and bicycle paths, it was moved by Lathrop, seconded by Hill that the recommendation of the Planning Commission regarding Newport Avenue curb cuts be that minimum curb cuts be authorized on the Newport Avenue frontage in order to provide safety for bicycle riders and not to impede traffic flow on Newport Avenue. It was moved by Sucher to amend the motion to add that an applicant would have the right to have his curb cut request reviewed by the appropriate governing body. The above motion failed for lack of second. MOTION CARRIED: 4-1 Commissioner Sucher voting no. PC Minutes 2-23-76 - Page 5 AUDIENCE PARTICIPATION - None CORRESPONDENCE - None STAFF CONCERNS Draft Environmental Impact_Re~p_ort for Improvement District 75-1, Irvine Ranch Water DiStrict. Dr. Fleagle reported that this project could be a growth inducing impact as a result of this environmental impact report. Copies of this Draft EIR will be distributed and discussed at the next Planning Commission meeting. In response to questions from the Commissioners, Dr. Fleagle informed that Tustin Meadows, Laurel- wood and Peppertree are served by this water district. 2. Addendum to Environmental Impact Report (EIR 73-1). Dr. Fleagle advised that an addendum to EIR 73-1 had been submitted by the Dynachem Corporation which comprises a description of the proposed addition to Dynachem which will be known as (OCR) Organic Chemical Reaction Unit. This addendum will be distributed and reviewed at a future meeting. COMMISSION CONCERNS 1. Commissioner Hill questioned the status of the E1 Camino Real Study. Dr. Fleagl~ reported that a report would be made to the City by the consultant on Thursday, February 26, 1976. 2. Commissioner Shambeck questioned the status of the alleys north- erly of First Street between "B" and "C" and easterly of "C" Street. After some discussion among the Commissioners, the City Attorney was requested to investigate the matter of the City vacating the alley east of "C" Street behind the "Tustin Parts Store" and "Econo-Lube". 3. Commissioner Sucher questioned the imput received from the ques- tionaire regarding amending the sign ordinance. Dr. Fleagle stated that he had received about 10 responses and expected many more. These responses will be assembled and agendized for the next meeting. 4. Commissioner Sucher questioned the driveway that was recently installed across the railroad tracks at the corner of Newport Avenue and Irvine Boulevard. Mr. Rourke stated that they have been notified to remove that driveway. The Commission also discussed the lack of sidewalks in that same area of the southwest corner of Newport Avenue and Irvine Boulevard and requested the Traffic Commission review the lack of pedestrian safety. Commissioner Sucher also mentioned that he was serving on a committee to help Tustin become a "Green Survival City" and needed to know spe- cific areas that could use more trees and landscaping. 5. Chairman McHarris questioned staff of the possibility of Larwin Square and the Tustin Car Wash sharing a common drive-way on Newport Avenue. Dr. Fleagle responded that with the proposed remodeling for Larwin Square, the traffic patterns may be redesigned and the Market and Car Wash would probably request a common curb cut on Newport Ave. ADJOURNMENT Moved ~ Hill, seconded by Su~urn at 10:20 p.m. MOTION CARRIED: 5-0 f~~'f, ~4~.///~ ///~~~~/~ C~A~O~ THE t~_~ANNiNG COMMISSION
