HomeMy WebLinkAboutPC Minutes 08-25-75 MINUTES OF A REGULAR MEETING OF THE CITY OF TUSTIN PLANNING COMMISSION August 25, 1975 The regular meeting of the City of Tustin Planning Commission was held on the twenty-fifth day of August, 1975, at the hour of 7:30 p.m., of said day, in the Council Chambers, City Hall, Centennial at Main, Tus tin, CAlifornia. PLEDGE OF ALLEGIANCE was led by Commissioner Shambeck. INVOCATION was given by Commissioner Kennedy. ROLL CALL: Present: Commissioners: McHarris, Hill, Kennedy, Sucher, Shambeck Absent: Commissioners: None Others Present: R. Kenneth Fleagle, Assistant City Administrator- Community Development Director James Rourke, City Attorney Brunce Lenorovitz, Assistant Planning Director Moved by Shambeck, seconded by Kennedy that the minutes of August 11, 1975 be approved. MOTION CARRIED: 5-0 PUBLIC HEARINGS Sign Code Amendment (ZC 75-1) (Continued) An application initiated on the motion of the City Council to authorize real estate "open house directional signs" to be placed on public property (to include the parkway between the sidewalk and curb in residential areas) for the purpose of advertising and providing direction to "open house" for sale, during limited hours. Opened public hearing at 7:50 p.m. Reuben Kvidt, Westland REalty, spoke in explanation of the activities of the legislative committee of the East Orange County Board of REaltors in preparing a draft ordinance. Closed public hearing 7:55 p.m. The Commission expressed desire to individually and collectively work with the real estate association in finding an alternate solution to the problems of directional information. Moved by Kennedy, seconded by Hill that the proposed amendment be tabled on the basis of City Attorney's finding of lack of authority to authorize signs in public right of way. MOTION CARRIED: 5-0 2. Z_one Change (ZC 75-2) and Use Permit (UP 75-18) Application of St. Cecilia Catholic Church, for the purpose of changing the zoning from R-4 (Residential) to the P&I (Public and Institutional), and Use Permit authorizing the construction of a new parish hall in conjunction with an existing church and church school. Opened public hearing at 8:10 p.m. Mrs. Thomas Kelley, spoke in support of the application. Closed public hearing 8:15 p.m. PC Minutes 8/25/75 Page 2 The Commission determined this to be an acceptable and desirable community improvement. The parish was requested to give consideration to the Commission's desire for additional site landscaping. Moved by Sucher, seconded by Shambeck to adopt Resolution No. 1461 recommending zone change, and Resolution No. 1462 approving use permit. MOTION CARRIED: 3-0 Commissioners McHarris and Kennedy abstained on basis of parish membership. PUBLIC CONCERNS Mrs. Margaret Byrd, 158 "B" Street, Tustin, expressed her feelings that she does not think she will like the new format of Commission minutes. OLD BUSINESS - NONE NEW BUSINESS - None AUDIENCE PARTICIPATION - None CORRESPONDENCE The Commission noted course offerings of UCI for Planning Commissioners. STAFF CONCERNS Mr. Flea,l? stated a public hearing has been advertised for September 22, 1975 covering an EIR for the purpose of evaluating the impact of an amend- ment to the Land Use and Open Space Elements of the Tustin Area General Plan to authorize a 46 unit subdivision to be constructed on an 8 acre parcel formerly designated as open-space and school site in the Peppertree Subdivision. Said site is located southerly of Walnut Avenue and northerly of the mainline AT&SF railroad, east of Browning Avenue. COMMISSION CONCERNS 1. The City Attorney advised, at the request of Commissioner Shambeck, that the Commissioner's contractural relationships with the Irvine Company would preclude his participation and discussion of the Peppertree EIR. Commissioner Sucher's eligibility to participate in the EIR discussion was taken under advisement by the City Attorney. 2. Moved by Kennedy, seconded by McHarris that traffic circulation, parking problems, and rear service entrance problems of Chuck's Steak House and Vicheck's Bakery in the Stater Brothers Shopping Center be referred to the Traffic Commission for their consideration. MOTION CARRIED: 5-0 Moved by Sucher, seconded by McIIarris to adjourn at 8:55 p.m. to the next regular meeting of the Planning Commission.
