BIGGS, CITY MANAGER & EXECUTIVE DIRECTOR COMMUNITY REDEVELOPMENT AGENCY FROM: PUBLIC WORKS DEPARTMENT AND COMMUNITY REDEVELOPMENT AGENCY SUBJECT: APPROVAL OF AMENDMENT NO. 1 TO CONSULTANT SERVICES AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR TUSTIN LEGACY BACKBONE INFRASTRUCTURE BETWEEN THE CITY AND HUNSAKER & ASSOCIATES SUMMARY Approval is requested of Amendment No.1 to a Consultant Services Agreement for Tustin Legacy backbone infrastructure between the City and Hunsaker & Associates to provide additional engineering services related to preparation of a final tract map for conveyance purposes, and to provide documentation of the existing conditions of the residential properties adjacent to Tustin Ranch Road between Edinger Avenue and Walnut Avenue. RECOMMENDATION It is recommended that the City Council: Approve Amendment No. 1 to a Consultant Services Agreement for Tustin Legacy backbone infrastructure between the City and Hunsaker & Associates, and authorize the City Manager to execute the document on behalf of the City. 2. Appropriate $72,500 from the un-appropriated funds in the MCAS Tustin Community Redevelopment Fund (555) which will be transferred to the MCAS Tustin Community Redevelopment Project Account No. 555-35-00-6010. FISCAL IMPACT The consulting services will be compensated on a time and material basis with a not to exceed budget of $84,550. There are sufficient funds currently budgeted and appropriated in this Fiscal Year 2010-2011 Capital Improvement Program ($12,050) to cover the documentation of the existing conditions of the residential properties adjacent to Tustin Ranch Road between Edinger Avenue and Walnut Avenue. The balance of the amended services contract will need to be appropriated. The task of preparation of a final tract map requires an appropriation from un- appropriated MCAS Tustin Community Redevelopment Agency funds. DISCUSSION/BACKGROUND On September 7, 2010, the City Council approved a Consultant Services Agreement with Hunsaker & Associates to provide engineering services at Tustin Legacy. The Agreement includes tasks to complete the unfinished design of infrastructure facilities at Legacy and support to assist the City in refinement and revision of the City's Disposition Strategy and Business Plan (Strategy and Plan) for the area that was previously the Master Developer Footprint at Tustin Legacy. A component of the Strategy and Plan involves the need to remove Hunsaker & Associates Contract Amendment No. 1 November 2, 2010 Page 2 title encumbrances of portions of the Master Developer footprint that will remain within the public domain (i.e., public right-of-way, park, and open space areas). In order to accomplish this, the City will need to prepare and record final maps for each neighborhood within the Master Developer footprint. Since Hunsaker & Associates prepared the previous subdivision maps for the former Master Developer footprint, they already have boundary, right-of-way, and topographic information. Since this information is readily available it has been determined that there would be atime-saving and cost effective benefit of procuring the services of Hunsaker & Associates in order to finalize the mapping of this area. Subsequently, the City requested and received a proposal for engineering services from Hunsaker & Associates based upon its familiarity and experience with the work required. Due to its vast knowledge of the project and its current working relationship with the City, Hunsaker & Associates was determined to be the most qualified to provide the required services at this time. Stack, P.E. of Public Works/City Engineer S:\City Council Items\2010 Council ItemsWpproval of Amendment No 1 to Legacy Contract with Hunsaker.docx AMENDMENT NO. 1 TO CONSULTANT SERVICES AGREEMENT This AMENDMENT NO. 1 TO CONSULTANT SERVICES AGREEMENT ("Amendment No. 1") is made and entered into by and between the CITY OF TUSTIN, a municipal corporation ("City") and HUNSAKER & ASSOCIATES IRVINE, a California Corporation ("Consultant"), pursuant to Section 1.6 "Additional Services" and Section 2.3 "Changes", of the Consultant Services Agreement. WHEREAS, City and Consultant entered into a Consultant Services Agreement on September 7, 2010, to provide consulting services to the City for engineering services for the Tustin Legacy Disposition Strategy and Business Plan; and WHEREAS, the City requested certain additional engineering services related to preparation of a final tract map for conveyance purposes and providing digital photographic and video documentation of the existing conditions of the 21 homes that back on to Tustin Ranch Road; and WHEREAS, Hunsaker & Associates submitted an authorization request for additional engineering services dated September 29 and October 8, 2010, attached hereto as Exhibit "A"; and THEREFORE, it is agreed that the Original Agreement be amended as follows to reflect the modifications requested by Hunsaker & Associates and authorized by the City of Tustin: 2.0 Modification of Compensation. Section 2 entitled "Compensation" is amended to provide additional engineering services as identified in Exhibit "A" of this Amendment No. 1 up to an additional amount not to exceed $84,550. 3.0 General Requirements.
