CONSENT CALENDAR
Approved 1. APPROVAL OF MINUTES - SEPTEMBER 28, 2010,
PLANNING COMMISSION MEETING.
It was moved by Puckett, seconded by Kasalek, to approve the
Consent Calendar. Motion carried 4-0.
PUBLIC HEARINGS
Adopted Resolution 2. CONDITIONAL USE PERMIT 10-008, A REQUEST TO
No. 4160 OPERATE A CERTIFIED FARMERS' MARKET ON
SUNDAYS IN THE PARKING LOT OF THE DISTRICT
SHOPPING CENTER AT TUSTIN LEGACY. THIS
PROJECT IS LOCATED AT 2437 PARK AVENUE IN THE
SP-1 - MCAS TUSTIN SPECIFIC PLAN DISTRICT,
NEIGHBORHOOD F, PLANNING AREA 19 -COMMERCIAL
ZONING DISTRICT.

RECOMMENDATION:
That the Planning Commission adopt Resolution No. 4160
approving Conditional Use Permit 10-008.
Staff answered questions from the Planning Commissioners.
The Public Hearing opened at 7:10 p.m.
Chair Pro Tem Thompson invited the applicant to the lectern.
Michael Garner, representing Vestar, thanked staff for their work and
indicated that he was available for any questions.
The Public Hearing closed at 7:11 p.m.
Further Planning Commission discussion ensued; it was the
consensus of the Commission that this is a excellent use for Tustin
Legacy.
It was moved by Puckett, seconded by Kasalek, to adopt Resolution
No. 4160. Motion carried 4-0.
REGULAR BUSINESS:
Received and filed 3. SUMMARY OF PROJECTS
The summary focuses on the status of projects that the
Planning Commission, Zoning Administrator, or Community
Development Director approved, major improvements
projects, and other items of interest.
RECOMMENDATION:
That the Planning Commission receive and file this report.
The Planning Commissioners commented on various aspects of the
report and noted that it is encouraging to see this much development
in Tustin during these difficult economic times.
STAFF CONCERNS
4. REPORT OF ACTIONS TAKEN AT THE OCTOBER 5, 2010,
CITY COUNCIL MEETING.
The Director reminded the Commissioners that the Planning Officials
Forum will be this Thursday at the Richard Nixon Library.

r The Director indicated she would be happy to answer any questions
the Commissioners may have regarding the City Council Action
~ Agenda.
COMMISSION CONCERNS
Kasalek Reminded everyone that tomorrow at 7:00 p.m. the Candidates'
Forum takes place in the Council Chamber;
• Noted that the Old Town Art Walk takes place October 23;
• Offered congratulations to everyone involved in a very successful
Tustin Tiller Days.
Kozak Thanked fellow Commissioner Puckett for teaching him the
proper wave and squirt gun etiquette when riding in a parade;
thanked Dave Wilson, Sharon Cebrun, and all the Parks and
Recreation staff and volunteers for a great event;
• Noted that the Old Town Art Walk was a wonderful event last
year and is expected to be even better this year;
• Indicated he is looking forward to the Planning Officials Forum;
• Reminded everyone that the Tustin Community Foundation
sponsors CPR training November 6th in the Clifton Miller
Community Center; donation: $25; register online at
www.tustincommunityfoundation.orq.
Puckett • Added that riding in the back of a new F-150, sitting on a bale of
hay, waving squirt guns, and not having one egg thrown was
quite an experience;
• Thanked Dave Wilson and City staff for their tremendous job
putting on Tiller Days;
• Thanked Cherrill Cady for her dedication and hard work over the
years to help make Tiller Days a huge success;
• Reminded everyone that the Tustin Community Foundation is
now selling raffle tickets for the Acura TSX; fora $50 ticket, the
winner gets a chance for athree-year lease on the TSX, or
$15,000 toward any other Acura on the lot, or $10,000 cash.
Thompson • Noted that a brief gathering on Thursday evening before the
crowds at Tiller Days was somewhat surreal, very quiet before
being filled with people, food, laughter, etc.; kudos to the City for
making that event happen;
• Attended the 9th Annual Building Industry Legal Defense
Foundation on October 6; the speakers were excellent; the focus
was on SB 375;
• Attended on October 9 the "Date with Nature" event hosted by
the reserve at Rancho Mission Viejo; learned that Orange County
has its own zoo at Irvine Park;

Thompson continued . Stated that he will be a tour guide for the Art Walk, which will also
include stopping at the following historical moments: the site
where a National Bank robber was shot and killed dead on the
spot, the location where another bank robber was fumigated to
death, and, most colorful of all, the site where Fricker's Saloon
was replaced with a church.
7:37 p.m. ADJOURNMENT
The next regular meeting of the Planning Commission is scheduled
for Tuesday, October 26, 2010, at 7:00 p.m. in the City Council
Chamber at 300 Centennial Way.
