STORE USE IN THE CENTRAL COMMERCIAL, HEAVY COMMERCIAL AND
COMMERCIAL GENERAL ZONING DISTRICTS
SUMMARY:
A request has been received to establish a hydroponics and indoor gardening supply store
at 365 EI Camino Real. The proposed hydroponics and indoor gardening supply store is
located within the Central Commercial (C-2) and Cultural Resources Districts in Old
Town Tustin. Tustin City Code (TCC) Section 9233 related to the C-2 District does not
allow for a hydroponics and indoor gardening supply stores as permitted, conditionally
permitted, or prohibited uses. TCC Sections 9233a and 9233c related to the C-2
District allow the Planning Commission to determine whether an unlisted use is similar
to other listed uses and should be permitted, conditionally permitted, or prohibited
through a Use Determination. On September 28, 2010, the Planning Commission
adopted Resolution No. 4159, approving hydroponics and indoor gardening supply store
use as a conditionally permitted use in the Central Commercial (C-2), Heavy
Commercial (C-3), and Commercial General (CG) zoning districts. On October 7, 2010,
an appeal was filed by Mayor Pro Tem Nielsen stating that the proposed use is an
industrial and manufacturing type of use, not a retail use, and therefore is not
compatible with other businesses in the Old Town area.

RECOMMENDATION:
The City Council may take either action 1 or 2 or other action as deemed appropriate:
1) Adopt Resolution No. 10-107 upholding the Planning Commission's decision
approving Use Determination 10-003 to allow hydroponics and indoor gardening
supply store use in C-2, C-3, and CG Districts, with a conditional use permit subject
to approval by the Planning Commission (Attachment G -Uphold).
2) Adopt Resolution No. 10-107 denying Use Determination 10-003 permitting
hydroponics and indoor gardening supply store use in any commercial districts
(Attachment H -Denial).
FISCAL IMPACT:
The applicant has paid application fees related to this item.
BACKGROUND:
Tustin City Code (TCC) Section 9233 related to the C-2 District does not list a
hydroponics and indoor gardening supply store as a permitted, conditionally permitted,
or prohibited use. TCC Sections 9233a and 9233c related to the C-2 District allow the
Planning Commission to determine whether an unlisted use is similar to other listed
uses and should be permitted, conditionally permitted, or prohibited through a Use
Determination.
Pursuant to Tustin City Code, those uses listed within the lower rank districts as either
permitted or conditionally permitted would be allowed to locate as permitted or
conditionally permitted uses in the higher or more intense districts. For example, a
furniture consignment business is permitted in the C-2 District; therefore, this use is also
permitted within the Heavy Commercial (C-3) and Commercial General (CG) districts.
Accordingly, Planning Commission determination of the proposed use would also
impact the C-3 and CG Districts.
On September 28, 2010, the Planning Commission held a public meeting on the
proposed use determination. At the meeting, the Planning Commission members
expressed that the proposed use is new to the City of Tustin and that they are willing to
support the proposal provided that future Conditional Use Permit applications would
include more comprehensive background information about the proposed business
such as:
• survey of other similar uses in Orange County;
• coordination with Police Department;
• sensitivity to areas within the Cultural Resources Overlay District;
• limiting deliveries, noise, and lighting;

• provision of a business plan and more thorough financial review relating to
Orange County.
At the conclusion of the discussion of the subject proposal, the Planning Commission
adopted Resolution No. 4159 (Attachment A), approving hydroponics and indoor
gardening supply store use as a conditionally permitted use in the C-2, C-3, and CG
zoning districts. Minutes from the September 28, 2010, Planning Commission meeting
are provided as Attachment B.
On October 7, 2010, Mayor Pro Tem Nielsen appealed the Planning Commission
decision, expressing concern about the appropriateness of the proposed use in the Old
Town area (Attachment C). Pursuant to the Tustin City Code Section 9294c, an appeal
hearing shall be de novo and the City Council may approve, approve with conditions,
disapprove the matter, or remand the matter to the Planning Commission for further
proceedings in accordance with directions of the City Council. A decision of the City
Council at the conclusion of the hearing shall be final.
Site and Surrounding Properties
The proposed site at 365 EI Camino Real is bounded by commercial uses to the north,
south, and west. The Prospect Village Planned Community development is to the east
of the proposed hydroponics supply store (Attachment D -Location Map).
The C-2 zoned properties within the City are generally located south of First Street, north
of Newport Avenue, west of Prospect Avenue and east of "C" Street. Other C-2 zones
include the areas adjacent to the intersections of Red Hill Avenue and the north side of the
I-5 Freeway, Walnut and Red Hill Avenues, First Street and west of the 55 Freeway,
Newport Avenue and Main Street, Newport Avenue and Old Irvine Blvd., and Seventeenth
Street and North Yorba Street. Although the Tustin City Code includes C-3 District, the
City no longer has properties zoned C-3.
Properties within CG districts are spread out in relatively small clusters. In general, CG
zones are located on the east side of Newport Avenue between EI Camino Real and San
Juan Street, and at the intersections of Seventeenth Street and Carroll Way, Newport and
Mitchell Avenues, Newport and Walnut Avenues, and Red Hill and Walnut Avenues.
Figure 1 only shows the C-2 and CG zones within the City since there are currently no
properties zoned as C-3 within the City.

DISCUSSION:
Proposed Use
Hydroponics is the cultivation of plants by putting the plant roots in liquid nutrient solutions
instead of soil. Indoor gardening is the cultivation of plants inside an enclosed structure by
using grow lights, nutrients, soils, and other methods of controlling the plant's environment.
The applicant proposes to operate a hydroponics and indoor gardening supply store and
has submitted a business plan and floor plan (Attachment E). As proposed, the store
would sell items such as lights, timers, tubing and fittings, pumps, water filters, seeds, soil,
soil pots, nutrients, growing medium, books, and videos related to hydroponics and indoor
gardening. The applicant does not propose to grow plants for sale. However, the
applicant has indicated that approximately five (5) percent of the retail store would be used
to grow plants for the purpose of display and product demonstration. The applicant
indicated that they intend to strictly be a supply store. Attachment F includes catalog
pages from the applicant's product supplier, Sunlight Supply, Inc.
Currently there is no hydroponics and indoor gardening supply business located in the City
of Tustin. However, some nurseries and home improvement stores located in Tustin sell a
very limited amount of hydroponics equipments and supplies. As mentioned, C-2 districts
typically allow retail establishments to locate as permitted uses. The C-2 District
regulations also require conditional use permits for more intense retail uses such as
convenience stores, wholesale bakeries, specialty stores, outdoor markets, etc.

Hydroponic businesses in other cities
Staff researched other cities with similar hydroponics and indoor gardening supply
businesses within its jurisdiction. The following table reflects the results of staffs research.

Generally, this type of use is located within industrial areas of the respective city with the
exception of the one business located in the City of Fountain Valley. Staff contacted cities
in which these businesses are located and were told that they do not experience any
problems with this type of business, with the exception of one store located in Fountain
Valley. This one particular store has been reported with problems associated with loitering,
people smoking marijuana in the adjacent alley, stabbing incident, and complaints from
adjacent businesses. The City of Fountain Valley is currently in the process of amending
its city code to list hydroponics store use as a conditionally permitted use in commercial
zones. In the staff report to the Fountain Valley Planning Commission dated September
22, 2010, Fountain Valley staff indicated that "hydroponic stores differ from general retail
stores in that they have the potential to create secondary impact such as illegal marijuana
growing and/or consumption, crime, economic blight, and require additional law
enforcement patrol." The Fountain Valley proposed code amendment is scheduled for the
Fountain Valley City Council hearing on November 16, 2010. The following photos are
from the Fountain Valley business' website and shows how products could be displayed
and stocked.

The following photos were taken during a site visit to a hydroponics store in Huntington
Beach.
Compatibility of Proposed Use and Cultural Resources Overlay District
The appeal by Mayor Pro Tem Nielsen expressed concern about the appropriateness of
the proposed use in the Old Town area. Mayor Pro Tem Nielsen indicated the
proposed use is an industrial and manufacturing type of use, not a retail use.
The proposed project site is also located within the Cultural Resources Zoning District
(CR), also known as Old Town Tustin, and includes a large portion of C-2 zoned
properties located along EI Camino Real and Main Street. The CR zoning district was
created generally to safeguard the heritage of the City by preserving cultural resources
and to promote enjoyment, use, and preservation of culturally significant neighborhoods.
The CR overlay district provides additional design and development standards for
residential and commercial uses to promote compatibility of new structures and uses with
existing culturally significant neighborhoods.

While the CR District allows for uses that are authorized in the underlying commercial
district, CR District also authorized and encouraged commercial uses that help create a
commercial village atmosphere with pedestrian oriented activities. The following uses are
some examples of authorized and encouraged uses identified in the CR District:
• wine tasting hobby shops delicatessens
rooms lamp shops • leather goods
• coffee shops art galleries knit shops
• boutiques yardage goods
The applicant for the proposed hydroponics business indicated that he looks forward to
bringing the new technology to Tustin since more homes are built with limited outdoor
spaces and that the indoor hydroponics method of growing plans provides alternatives to
the growing population concerned with the origin and cost of produce. Should the Council
wishes to uphold the Planning Commission determination, the proposed hydroponics
businesses could be considered similar to specialty store or hobby shops that are
authorized and encouraged in the CR overlay district.
CR District does not allow for industrial and/or manufacturing uses. As mentioned, the
majority of other hydroponics stores located in Orange County are located within the
industrial area. While the applicant has indicated that the proposed use is retail in nature,
the proposed use is unique and more of a destination/specialty retail; thus, may not be
pedestrian oriented type of commercial uses that Old Town may envisioned.
Conditional Use Permit
If the City Council approves Use Determination 10-003 to allow hydroponics and indoor
gardening supply store as a conditionally permitted use in the C-2 zoning district, staff
recommends that City Code Section 9233c be amended in conjunction with the pending
zoning code amendment cleanup for use determinations.
Staff recommends that typical conditions of approval for a hydroponics and indoor
gardening supply store use be established. Typical conditions of approval could be as
follows:
1) The use shall be limited to retail sales of supplies and equipment for hydroponics
and indoor gardening. Other uses such as, but not limited to, warehouse,
distribution, storage and office shall be ancillary and supportive to the primary
retail use.
2) Business hours shall be compatible with the hours of other businesses in the
area.
3) Window areas shall not be covered or made opaque in any way except as allowed
under Tustin Code Section 9403e8 regarding window signs.

4) "No Loitering" signs shall be placed near entrances on the outside of the premises
or in other specified locations and in accordance with any applicable local, State
and Federal regulations.
5) The use shall operate in compliance with Tustin City Code Section 9298f regarding
uses being consistent with local, state and federal laws.
6) The use may be reviewed on an annual basis, or more often if necessary, by the
Community Development Director. The Community Development Director shall
review the use to ascertain compliance with conditions of approval. If the use is not
operated in accordance with the conditions of approval, or is found to be a nuisance
or negative impacts are affecting the surrounding tenants or neighborhood, the
Community Development Director shall impose additional conditions to eliminate
the nuisance or negative impacts or may initiate proceedings to revoke the
Conditional Use Permit.
Environmental Review
1) If the City Council upholds the Planning Commission decision in approving UD 10-
003, the following exemption is appropriate:
Proposed Use Determination 10-003 is exempt from environmental review under
CEQA pursuant to Section 15061(b)(3) of the State CEQA Guidelines. This section
provides that a project is exempt from environmental review where it can be seen
with certainty that there is no possibility that the activity in question may have a
significant effect on the environment. If approved, the proposed use determination
would allow the establishment of a hydroponic and indoor gardening supply store as
a conditionally permitted use in the C-2, C-3, and CG Districts and would not have
an effect on the environment.
2) If the City Council denies UD 10-003, the following CEQA exemption would be
applicable:
Pursuant to Section 15270(a) of the California Code of Regulations, the California
Environmental Quality Act does not apply to projects that a public agency rejects or
disapproves.
RESOLUTIONS
Should the City Council decide to uphold the Planning Commission decision and approve
the proposed Use Determination, Resolution No. 10-107 with findings (Attachment G) is
included for City Council consideration.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, APPROVING USE DETERMINATION 10-003 TO ALLOW A
HYDROPONICS AND INDOOR GARDENING SUPPLY STORE AS A
CONDITIONALLY PERMITTED USE IN THE CENTRAL COMMERCIAL,
HEAVY COMMERCIAL, AND COMMERCIAL GENERAL ZONING
DISTRICTS.
The Planning Commission does hereby resolve as follows:
The Planning Commission finds and determines as follows:
A. That a proper application far Use Determination 10-003 was filed by Nic
Seid to request a use determination from the Planning Commission for the
establishment of a hydroponics and indoor gardening supply store use at
365 EI Camino Real.
B. According to Tustin City Code (TCC) Section 9233, hydroponics and indoor
gardening supply store is not a listed use in the Central Commercial (C-2),
Heavy Commercial (C-3) and Commercial General (CG) zoning districts
and requires a use determination by the Planning Commission as stated in
TCC Sections 9233a, 9233c, 9234a, 9234c, 9235a and 9235c.
C. The Planning Commission finds that approval of a use determination to
allow a hydroponics and indoor gardening supply store as a conditionally
permitted use in the C-2, C-3 and CG zoning designations can be
supported by the following findings:
1) The proposed use is consistent with the intent of commercially
designated districts.
2) The proposed use is similar to other specialty retail stores which are
conditionally permitted uses within the C-2, C-3 and CG Districts.
3) The proposed use is subject to TCC Section 9298f regarding uses
being consistent with local, state and federal laws.
4) The proposed use would not have a detrimental effect on the public
health, safety, and general welfare of the community in that the
proposed use could be appropriately conditioned as follows:
a. The use shall be limited to retail sales of supplies and
equipment for hydroponics and indoor gardening.
b. Business hours shall be compatible with the hours of other
businesses in the area.

Captain Lewis indicated that the Police Department had reviewed
the application and is comfortable with the requirement of a
conditional use permit for these types of proposals.
Further discussion ensued.
Nic Seid, the applicant, indicated he looks forward to bringing this
new technology to Tustin.
Arnold Surfas, property owner, stated his belief that this is a good
use for Old Town and for the City of Tustin.
Acting Chair Kozak stated that the following should be included in
any conditional use permit:
• survey of other similar uses in Orange County;
• coordination with the Police Department;
• sensitivity to areas within the Cultural Resources Overlay
District;
• limiting of deliveries, noise, and lighting;
• provision of a business plan and more thorough financial
review relating to Orange County.
It was moved by Puckett, seconded by Kasalek, to adopt
Resolution No. 4159, with the change requested by the City
Attorney. Motion carried 3-0.

The Assistant Director referred to the following:
• Item No. 16: the Neighborhoods of Tustin Town Center: A New
Beginning, a Strategic Guide for Development identified a
number of goals and strategies providing staff and the Council
with methods to improve the Central neighborhoods;
• Item No. 18: the Council appointed a new City Manager to
replace retiring Bill Huston; the Manager is David Biggs,
currently with Redondo Beach;
• Item No. 1 under Public Hearings: the Council considered
Tentative Parcel Map 2008-138, Design Review 08-011, and
Conditional Use Permit 08-017, the project at 14611 Prospect
Avenue; the Council supported the Planning Commission
recommendation.

Who we are, location:
Go Green Hydroponics & Organics is owned equally by Nicholas Seid and Chris Hodge. Go Green will lease 365 EI Camino
Real from property owner Arnold Surfas for $31,680 per year. Go Green Hydroponics & Organics will generate
ecommerce with a website, Ebay and Amazon accounts.
Currently Chris Hodge owns "High Country Hydroponics" a successful startup and functioning indoor gardening retail
store in Montrose Colorado.
What we sell:
Go Green Hydroponics & Organics is an indoor gardening retail store. Go Green Hydroponics & Organics will offer its
customers lighting, timers, pumps, water filtration, plumbing, tubing & fittings, nutrients, organic nutrients, soil pots,
trays, water pumps, soil, hand tools, books & videos, water testing equipment, temperature & humidity gauges, self
contained growing kits, growing medium.
Where we get our product:
The major distributors of hydroponic & organic supplies include BWGS, HydroFarm, Sunlight Supply. It is typical for a
store to be directly linked to only one of the distributors. Due to local competition and established business relations we
have chosen Sunlight Supply. Sunlight Supply has a minimum six mile radius territory requirement; Sunlight Supply has
acknowledged and accepted our proposal for a location in the Tustin area. Sunlight Supply also has a very strict policy
that marijuana is not to be discussed in the store otherwise they will abruptly cut off supply to any store doing so. As
well it is Sunlight Supply's policy that each store they sell to display a sign stating that marijuana is not to be discussed or
the customer will be asked to leave the premises.
Target market:
Target market includes male and female ages 25 to 80 years of age. Of this group our customers will include the
enthusiast green thumb and the ever growing population concerned with the origin and cost of their produce.
Supermarkets now sell produce which has been grown using hydroponic & organic methods due to the expanding
demand for better quality. People whom enjoy gardening is not a new concept, however the hydroponics & organics
market is an emerging and growing market. People are learning that growing with hydroponic & organic methods can
reduce costs, reduce ecological and environmental stress, and yield better quality plants.
Startup Cost:
Go Green Hydroponics & Organics is startup using cash from both Nicholas Seid and Chris Hodge. First and last month's
rent with be required by lessor Arnold Surfas, which shall total $5,280. Approximately $5,000 will be spent on building
renovation costs. Our supplier Sunlight Supply requires that any new store must purchase a minimum of $35,000 for the
first order, we plan to purchase a total of $45,000 of initial inventory.
Projected Financials:
Due to the successful startup and operation of High Country Hydroponics in Colorado we have based the following
financial assumptions for revenue from the actual stores financials taking into consideration the difference in population
in Montrose, Colorado versus the population in the city of Tustin and surrounding cities whose population will
contribute to revenues. As well we have included the estimated revenues that may come from the ecommerce we plan
to generate using a website, eBay and Amazon.
Operating Procedures:
Go Green Hydroponics & Organics will be open seven days a week however closed during major holidays. Hours of
operation will include 10am to 7pm Monday through Sunday. Opening and closing of doors may be the responsibility of
any given employee working during those hours.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, UPHOLDING THE PLANNING COMMISSION
DECISION AND APPROVING USE DETERMINATION 10-003
TO ALLOW A HYDROPONICS AND INDOOR GARDENING
SUPPLY STORE AS A CONDITIONALLY PERMITTED USE
IN THE CENTRAL COMMERCIAL, HEAVY COMMERCIAL,
AND COMMERCIAL GENERAL ZONING DISTRICTS.
The City Council does hereby resolve as follows:
I. The City Council finds and determines as follows:
A. That a proper application for Use Determination 10-003 was filed by Nic Seid to
request a use determination from the Planning Commission for the establishment
of a hydroponics and indoor gardening supply store use at 365 EI Camino Real.
B. That the subject property is located within the Central Commercial (C-2)
District, the Cultural Resources (CR) overlay District and within an area
designated by the General Plan as Old Town Commercial.
C. That according to Tustin City Code (TCC) Section 9233, hydroponics and indoor
gardening supply store is not a listed use in the Central Commercial (C-2), Heavy
Commercial (C-3) and Commercial General (CG) zoning districts and requires a
use determination by the Planning Commission as stated in TCC Sections
9233a, 9233c, 9234a, 9234c, 9235a and 9235c.
D. That a public meeting was held for Use Determination 10-003 on September
28, 2010, by the Planning Commission, at which time the Planning
Commission adopted Resolution No. 4159, approving Use Determination 10-
003.
E. That on October 7, 2010, Mayor Pro Tem Nielsen submitted a Request for a
Hearing of the Planning Commission's approval of Use Determination 10-003.
F. A public hearing was duly called, noticed, and held for Use Determination 10-
003 on November 16, 2010, by the City Council.
G. That the establishment, maintenance, and operation of the proposed use will
not, under the circumstances of this case, be detrimental to the health, safety,
morals, comfort, or general welfare of the persons residing or working in the
neighborhood of such proposed use, nor be injurious or detrimental to the
property and improvements in the neighborhood of the subject property, or to
the general welfare of the City of Tustin in that:
1. The proposed use is consistent with the intent of commercially designated
districts.
2. The proposed use is similar to other specialty retail stores which are
conditionally permitted uses within the C-2, C-3 and CG Districts.

that the proposed use could function as a specialty retail store similar to
hobby shops, knit shops, lamp shops, etc.
4. The proposed use is subject to TCC Section 9298f regarding uses being

5. The proposed use could be appropriately conditioned as follows:
a. The use shall be limited to retail sales of supplies and equipment for
hydroponics and indoor gardening.
b. Other uses such as, but not limited to, warehouse, distribution,
storage and office shall be ancillary and supportive to the primary
retail use.
c. Window areas shall not be covered or made opaque in any way except
as allowed under Tustin Code Section 9403e8 regarding window signs.
d. "No Loitering" signs shall be placed near the entrance on the outside of
the premises or in other specified locations and in accordance with any
applicable local, State and Federal regulations.
e. The use shall operate in compliance with Tustin City Code Section
9298f regarding uses being consistent with local, state and federal laws.
f. The use may be reviewed on an annual basis, or more often if
necessary, by the Community Development Director. The Community
Development Director shall review the use to ascertain compliance with
conditions of approval. If the use is not operated in accordance with the
conditions of approval, or is found to be a nuisance or negative impacts
are affecting the surrounding tenants or neighborhood, the Community
Development Director shall impose additional conditions to eliminate the
nuisance or negative impacts or may initiate proceedings to revoke the
Conditional Use Permit.
6. A Conditional Use Permit would allow a proposed hydroponics and indoor
gardening supply store to be considered on a case-by-case basis.
H. That this project is exempt pursuant to Section 15061(b)(3) of the California
Environmental Quality Act.
II. The City Council hereby upholds the Planning Commission decision and approves
Use Determination 10-003 to allow hydroponics and indoor gardening supply store
use in C-2, C-3, and CG Districts, with a conditional use permit subject to approval by
the Planning Commission.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, DENYING USE DETERMINATION 10-003 TO
ALLOW HYDROPONICS AND INDOOR GARDENING
SUPPLY STORE USES IN COMMERCIALLY ZONED
DISTRICTS.
The City Council does hereby resolve as follows:
I. The City Council finds and determines as follows:
A. That a proper application for Use Determination 10-003 was filed by Nic Seid to
request a use determination from the Planning Commission for the establishment
of a hydroponics and indoor gardening supply store use at 365 EI Camino Real.
B. That the subject property is located within the Central Commercial (C-2)
District, the Cultural Resources (CR) overlay District and within an area
designated by the General Plan as Old Town Commercial.
C. That according to Tustin City Code (TCC) Section 9233, hydroponics and indoor
gardening supply store is not a listed use in the Central Commercial (C-2), Heavy
Commercial (C-3) and Commercial General (CG) zoning districts and requires a
use determination by the Planning Commission as stated in TCC Sections
9233a, 9233c, 9234a, 9234c, 9235a and 9235c.
D. That a public meeting was held for Use Determination 10-003 on September
28, 2010, by the Planning Commission, at which time the Planning
Commission adopted Resolution No. 4159, approving Use Determination 10-
003.
E. That on October 7, 2010, Mayor Pro Tem Nielsen submitted a Request for a
Hearing of the Planning Commission's approval of Use Determination 10-003.
F. A public hearing was duly called, noticed, and held for Use Determination 10-
003 on November 16, 2010, by the City Council.
G. That the establishment, maintenance, and operation of the proposed use will,
under the circumstances of this case, be detrimental to the health, safety,
morals, comfort, or general welfare of the persons residing or working in the
neighborhood of such proposed use, be injurious or detrimental to the property
and improvements in the neighborhood of the subject property, or to the
general welfare of the City of Tustin in that:
1. The proposed use is not consistent with the intent of commercially
designated districts in that the proposed use is more compatible with
industrial/manufacturing supplies businesses.
2. The proposed use is not compatible with uses encouraged in the CR
District in that the proposed use is a destination or a specialty store which
do not encourage pedestrian activities as envisioned for Old Town Tustin.

3. The proposed use is not consistent with other authorized and encouraged
uses in the CR District, in which the interest is to create a commercial
village atmosphere.
H. That the Community Development Director has reviewed the project's potential
effects on the environment, and has recommended that the project be found
statutorily exempt in accordance with Section 15270 of the California Public
Resources Code, which specifies that the California Environmental Quality Act
does not apply to any project that the public agency rejects or disapproves.
II. The City Council hereby denies Use Determination 10-003 to allow hydroponics and
indoor gardening supply store uses in commercially zoned districts.
