ORDINANCE NO. 727
AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
ADOPTING AND ENACTING A RECODIFICATION AND RE-
VISION OF THE ORDINANCES OF THE CITY OF TUSTIN
ENTITLED "TUSTIN CITY CODE", AND PROVIDING
FOR THE REPEAL OF CERTAIN ORDINANCES NOT IN-
CLUDED THEREIN EXCEPT AS HEREIN EXPRESSLY
PROVIDED.
~e City Council of the City of Tustin, California, does hereby
ordain as follows:
1. There is hereby adopted all of the provisims of that certain
Code entitled "Tustin City Code" c~n~s~ning the ordinances of the City
Of Tustin of a general and permanent nature as ccmpiled, reccmpiled,
consolidated, reccmsolidated, codified and recodified and indexed in
Articles 1 through 9, inclusive, of which said Code not less than three
copies have bcan, and are now, on file in the office of the City Clerk,
is hereby adopted and rode a part of this ordinance as though fully set
forth herein.
2. The provisions of the Tustin City Code shall be in force and
effect on and following July 20, 1977, and all ordinances of a general
~nd permanent nature adopted on final reading and passage prior to June
1, 1977, and not c~ntained in such Code, are hereby repealed effective
July 20, 1977, except as hefeinafter provided.
3. That the repeal provided for in Section 2 hereof shall not
affect the follc~ing:
(1) Any offense or act ccnxnitted or dcne or any penalty or
forfeiture incurred or any contract or right established or accrd/ng
before the operative date of this ordinance;
(2) Any ordinance or resolution prcrnising or ~aranteeing the
payment of money for the City, or authorizing the issue of any
bc~f~ of the City or any evidence of the City' s indebtedness, or
any contract or obligaticas as~ by the City;
(3) The administrative ordinances or resolutions of the City
Council not in ccaf!ict or inconsistent with the provisions of such
Code;
{4) Any right of franchise granted by any ordinance or resolution
-of the City Council to any person, firm or oorporation;
(5) Any ordinance dedicating, naming, establishing, locating,
relocating, opening, paving, widening, vacating or repairing any
street or public way in the City;
(6) The annual appropriation orainance;
(7) Any ordinance levying or imposing taxes;
(8) Any zoning ordinance or amendment to ordinance zoning or
pre-zoning property to specific zones or districts;
(9) Any ord/nance establishing and prescribing the street grades
of any street in the City;
(10) Any ordinance p~o~iding for local improvements and assessing
ta~es therefor;
(11) Any ordinance dedicating or accepting any plat or subdivision
in the City;
(12) Any ordinance providing for parking or traffic regulations
on specific streets or areas.
(13) Any ordinance annexing territory to the City.
Such repeal shall not be construed to revive any or~ance or
part thereof that has been repealed by a subsequent ordinance w~ich is
repealed by this ordinance.' Each of the above-mentioned ordinances shall
in no way be repealed by this Code except as the same may be in conflict
with the provisions of this Code.
4. Whenever in the Code adopted by this ordinance or Ln any other
orainance of the City or in any rule, regulation or order promulgated by
any officer or agency of the City ~nder authority duly vested in him or it
any act is prohibited or is made or declared to be unlawful or an offense
or misdemeanor, or the doing of any act is required or the failure to do
any act is declared to be unlawful or an offense or a misdeTeanor, where no
specific penalty is provided therefor, the violation of any such provision
of such Code or any other ordinance of the City or such rule, regulation or
order shall be punished by a fine not exceeding FIVE HUNDRED DOLLARS
($500.00) or imprisonment for a term no~ exceeding six (6) reenths, or by
both such fine ~.nd imprisonment.

Except where otherwise provided, every day any violation of
such Code or any other ordinance of the City or such rule, zegulation or
order shall continue shell constitute a separate offense.
5. It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of this
ordinance and the Code hereby adopted are severable, and if any phrase,
clause, sentence, paragraph or section of the ordinance or the Code
hereby adopted shall be declared unconstitutional or otherwise invalid
by the valid judgment or decree of a court of cu,~etent jurisdiction,
such unconstitutionality or invalidity shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance or the Cede hereby adopted.
PASSED AND ADOPTED at a regn]__ar meeting of the City Council, City
of Tustin, California, held on the 20th day of June, 1977.
