AUGUST 14, 1972
The regular meeting of the City of Tustin Planning Commission was
held on the 14th day of August, 1972, at the hour of 7:30 p.m.,
of said day in the Council Chambers, 275 South "C" Street, Tustin,
Californi'a.
The Pledge of Allegiance was led by Commissioner Edelstein.
The invocation was given by Commissioner Larnard.

JULY 24, 1972
PUBLIC HEARINGS
UP-72-389 - Robert C. Muir et al. - to permit the use of a train-
ing ski slope for clubs, schools, private commercial
purposes, etc.
Location:
Site fronts approximately 43' on the southeast side
of Newport Avenue, has a depth of approximately 466',
and is generally located southwesterly of the Tustin
Heights Shopping Center.
Mr. Brown advised that the subject property is presently zoned PC (Com-
mercial), with the only existing structure located on the property
being a one-story, corregated iron building. Ski slope is to be
erected just southwesterly of the existing warehouse structure. The
facility would be operated under the auspices of the Tustin Heights
Sporting Goods store located in the Tustin Heights Shopping Center,
and would be for purposes of training skiers from various clubs,
schools, or on an individual instructional basis.
The facility itself would be essentially of wood construction; have a
60' long, 20' wide slope area with an outdoor carpet surface; have a
maximum he{ght of 5' at the beginning of the slope; and, would be en-
closed by a chainlink fence.
Mr.'Brown stated that Staff and the other departments of the city would
~e no objection to the use as proposed for the following reasons:
Its basic instructional use serves a beneficial community
purpose.
Its design is such that there would be a minimal safety or
hazard element involved.
Its total dimensions and location on subject site are such
that it will have little or no public exposure relative to
aesthetics.
That for all intents and purposes, this is an interim use
of this large vacant commercial parcel.
Mr. Brown commented on the City Engineer's recommendations, which were:

the City Attorney providing access from the proposed site
across Tustin Heights Shopping Center to Irvine Boulevard.
Any approval be subject to the construction of curb ~nd gut-
ter, sidewalk and necessary AC pavement on the 42' ~ewport
Avenue frontage and that vehicular access be denied at this
point.

It was recommended that Commission grant UP-72-389 for a one-year
period, subject to further six-month extensions of time at the dis-
crction ~f LI~ Pi~i~3 Commission, Dy a~optlon of Resolution No. 1277.
Vice-Chairman Sharp opened the public portion of the hearing at 7:40 p.m.
Dick Griset, speaking for his mother, Blanche Griset, stated that she
· s the owner of property to the east of proposed ski slope, and has an
easement along the northeast side. tie advised that they were not
against this proposal, but asked if this were approved, full considera-
tion be given to the property rights, access and easements of the other
owners in the area. They were concerned with the stores in the'sh'op-
ping center dumping and storing things on their east easement, and
wished to see this stopped.
Merle Griset, also speaking for his mother, reiterated what his brother
had said, stating that Mrs. Griset has had nothing but trouble with her
property rights.
The public portion of the hearing was closed at 7:55 for discussion
among the Commissioners.
· Upon questioning from Commissioner Edelstein, Mr. Brown advised that
today was the first he had heard of this dumping, etc., &nd these
problems were ancillary to this application and would be dealt with
separately by the City Staff.
Mr. John Mullens, of Tustin Heights Sporting Goods, said that if they
could not get a permit in the next few weeks, they wouldn't be able
to build this year.
There was much discussion as respects the City Engineer's recommenda-
tion that the access from Newport Avenue be denied, as Commission was
advised by the Griset's that most of the deliveries to the stores are
from this Newport Avenue drive access. Commissioner Dukleth also
questioned the economic feasibility of improving the Newport Avenue
entrance for a one-year, or short-term, operation.
Commissioner Larnard moved to continue this item for two weeks, to
their August 28, 1972 meeting, for further discussion of Staff with
the City Engineer as respects the traffic on Newport Avenue; seconded
by Commissioner Edelstein.

UP-72-379 - Ethel F. Doty - an amendment to Condition 2(b),
Resolution No. 1256, UP-72-379, to permit the devel-
opment of subject property by removing any and all
requirements for improvement and/or development of
any adjoining parcel or parcels.
Location:
Site has a frontage of approximately 622' on the
south side of 17th Street, and is located approxi-
mately 600' west of the centerline of Prospect Avenue.
Mr. Brown advised that at the Commission's July 10, 1972 meeting, Reso-
lution No. 1256 was adopted denying subject amendment. An appeal was
made to the City Council at their meeting on August 7, 1972, at which
time they upheld the Commission's denial. However, the City Council
did amend paragraph 2(b) of this resolution. The original paragraph
read:
"The dedication and improvement of total street system 'for the
total area indicated on the master plan prior to occupancy of
any structure on any part of portion of the area not heretofore
approved."
This paragraph now reads:

"The dedication and improvement of necessary streets, in accord-
ance with an approved master plan, on parcel or parcels the
subject of a building permit."
The intent of this amendment is to relieve the property owner of re-
sponsibility for improvements on any property other than his own.
Vice-Chairman Sharp opened the public portion of the hearing at 8:26 p.m.
Warren TenEvck, representing the applicant, stated he was available if
Commission ~ad any questions.
Public portion of hearing was closed at 8:27 p.m., for discussion among
the Commissioners.
Commissioner Larnard moved for concurrence with the Council action;
seconded by Commissioner Edelstein.
MOTION CARRIED: 4-0
OLD BUSINESS
1. Bicycle Plan for the City of Tustin and it's Sphere of Influence
Mr. Brown told the Commission that they were given copies of this
plan at a previous meeting for review. He presented this plan to the
Parks & Recreation Commission at their July 26, 1972 meeting, and they
were in general concurrence with the plan as presented. However, they
did recommend certain priorities which they felt would be essential
to the development of such a system:
That as a result of limited City funds, needed for both
the acquisition and development of off-street trails,
it would be best to initiate an~, such program using, the
existing street system. This, for the most part, would
involve the secondary system as shown on the specific
plan.
Although this developmental priority would be necessary
at this time, the Parks and Recreation Commission felt
quite strongly that the City should not lose sight of or
procrastinate on serious endeavors and forward thinking
towards eventual development of the primary system, which
was primarily concerned with off-street trails.

That in the initial development of the secondary system
primary consideration should be given to the downtown
area from both a recreational and transportational stand-
point.
That the future development of the Venta Spur Line and
adjacent City owned flood channel should remain a part
of the primary trail system.

To cooperate in all ways, financially and physically
feasible, with the County and surrounding jurisdictions
in joint acquisition, development, and maintenance of a
master connecting system of such trails and ways.
Commissioner Larnard moved to set this item for Public Hearing on
September 25, 1972; seconded by Commissioner Dukleth.

NEW BUSINESS
1. Environmental Impact Statement - Red Hill Storm Drain from AT&SF
Tracks to Walnut Avenue.

Mr. Brown advised that basically, this joint project calls for the in-
s~laLio~ uf ~ stu~m drain in ~eo Hill Avenue ~rom the Santa Fe Rail-
road tracks to 700' north of Sycamore and at the Walnut Avenue inter-
section.
Commissioner Larnard moved to have Staff direct a letter to the Orange
County Road Department recommending approval of this Statement, in that
it is not in conflict with the Tustin Area General Plan and has no
negative environmental impact; seconded by Commissioner Edelstein.

2. Conformance with General Plan - Tract 7420 Easement, Beneta Way
Mr. Brown advised of a letter from the Orange County Department of
Real Services as respects:
1.Eastward relocation of the easement access from Beneta Way
over the Flood Channel to Tract No. 7420; and,
2. Use of the surplus Orange County Flood Control District
land for City of Tustin park and open space purp'oses.
Commissioner Edelstein moved for concurrence with the County of Orange
m~n that these proposals are in conformance with the City's General Plan
pursuant to Section 65402 of the Government Code, and Section 21151 of
the Public Resources Code as related to the adopted Conservation Ele-
ment; seconded by Commissioner Larnard.
