PAGE 1 1 1 1-2 2-3 3 3 4 4 4 4-5 5 MINUTES OF A RECULAR MEETING OF THE CITY OF TUSTIN PLANNING COMMISSION MAY 22, 1972 The regular meeting of the City of Tustin Planning Commission was held on the 22nd day of May, 1972, at the hour of 7:30 p.m., of said day in 'the Council Chambers, 275 South "C" Street, Tustin, California. The Pledge of Allegiance was led by Commissioner Dukleth. The Invocation was given by Commissioner Edelstein. ROLL CALL: Present: Absent: Others Present: Larnard, Dukleth, and Edelstein. Kenneth Fleagle, Assistant City Administrator - Community Development Director Pat Brown, Assistant Planning Director Nancy Lawton, Planning Commission Recording Secretary Cha'irman Curtis ill, not able to be here. Vice-Chairman Sharp had pressing issue at the college, requiring his attendance. Both expressed sincere regrets in not being able to attend this meeting. APPROVAL OF MINUTES OF REGULAR MEETING OF MAY 8, 1972 PUBLIC HEARINGS 1) Swimming pool heater and filter setback requirements -'amendment to Zoning Ordinance No. 157 Mr_ Fleag~e summarized Staff Report, advising that Staff has reviewed several technical publications, all of which indicate that swimming poo1 heater and filter equipment produces relatively low decibel counts, wel below normal neighborhood ambient noise levels. The rare exception wou be an older piece of equipment where, as a result of worn bearings, the motor could become noisy, but this would necessitate immediate repairs, so the situation would not be a prolonged one. It is recommended that Commission recommend to the City Council, adoption of an amendment to Section 5.16, Ordinance No. 157, as amended by Ordin- ance No. 476, by adoption of resolution No. 1266, which reads: "Heater and filter units for swimming pools shall be located in the rear or side yard areas, and shall be screened from view". Public portion of hearing was opened at 7:36 p.m. by A_c~ing Chairman Larnard; seeing and hearing no one to speak for or against the issue, the. public portion was closed at 7:37 p.m. for discussion among the commis- sioners. Moved by Commissioner Edelstein, seconded by Commissioner Dukleth, that Commission recommend approval to City Council of adoption of amendment to Section 5.16, Ordinance No. 157, as amended by Ordinance No. 476, by adoption of Resolution No. 1266. MOTION CARRIED: 3-0 2) Amendment to Noise Ordinance - Section 15-7 City Code A brief summary of Staff Report was given.by Mr. Fleagle, and it was recommended that the Commission Continue the proposed noise ordinance amendment so that Staff could delve further into this item so as to make a complete, contemporary noise ordinance for Tustin and to get more data from the Orange County Health Department. Publi~ portion of hearing was opened at 7:'43 p.m. by Acting Chairman Larnard; seeing and hearing no one to speak for or against the issue, the public portion was closed at 7:44 p.m. for discussion among the commissioners. Commissioner Edelstein moved, seconded by Commissioner Dukleth, that t~his item be continued as an open pub%ic hearing until the July 24, 1972 meeting. MOTION CARRIED: 3-0 OLD BUSINESS 1) Tentative Tract No. 7846 - Jack D. McClean - 21 lots, 5.1+ acres - R1 Subdivision. -- Location: West side of ~rospect Avenue, opposite Carlsbad Drive and running westerly to Anglin Lane. Mr. Fleagle reviewed the Staff Report of the City Engineer, outlining his fifteen conditions if the tract is approved. Mr. Fleagle's recommen- dations, and that of the Fire Department were also brought to the Commis- sion's attention. There was discussion as respects th~ pedestrian walkway from Laurinda Way to Street "A", as recommended by the Assistant School Superintendent, with the Engineering firm not in favor of it. Commissioner Edelstein moved to approve tentative Tract No. 7846, seconded by Commissioner Dukleth, subject to the following conditions: Granting of easements as shown on the map and a 56-foot width for street right-of-way with 36-foot curb to curb distance and 10-foot parkways on interior streets conforming with Anglin Lane west of the tract. Provide adequate underground conduit street lighting on Pros- pect Avenue and interior tract streets and annex entire prop- erty to Tustin Lighting District. Ail public improvements, sewers, drainage facilities and appurtenances shall be constructed to City standards and approved by the City Engineer. Design of the sewer system especially shall be closely coordinated with the City En- gineer and the Flood Control District to avoid conflict with their proposed facilities. Ail public utilities shall be installed underground in con- formance with accepted standards of utility companies. No additional poles shall be set within the property or adjac- ent street right-of-way. Street trees shall be provided and planted in accordance with City ordinances. 6. Provide water system and public sewers to serve all lots. ® Provide adequate drainage facilities to serve the tract at the south end of the interior "B" Street unless otherwise adequately served by proposed Flood Control facilities. Those segments of existing irrigation lines conflicting with or endangered by any proposed construction shall be removed and relocated or collapsed and backfilled, or otherwise made to conform to the specifications of the City of Tustin Build- ing Code or to the satisfaction of the City Engineer and the irrigation line owner. Minimum street grades within the tract must be reviewed with and approved by the City Engineer. 10. The developer shall provide ali street name signs, traffic signs, barricades and similar traffic control devices as required by the City Engineer. 11.. Dedication of vehicular access rights to Prospect Avenue '- except at street intersections.. 12.~'~bnstru~tion of a 6,8" .masonry~wall along the north line of lots 18 through 21 for flood protection together with a lock- able gate across the open drainage channel at Prospect Avenue. 13. Installation of a masonry wall along the Prospect Avenue front- ages of lots 1, 2, and 21, the design of which shall be subject to the review and approval of the Development Preview Commiss~ 14. Ail fire hydrant locations and numbers as well as size of sups_t line shall be subject to review and approval by the Fire Chief. 15. Make provision for a cul-de-sac turning area for the terminus of Laurinda Way with a pedestrian walkway from Laurinda Way to Street "A" for the benefit of school children residing on Laurinda. 16. Development Plans for structures on lots 1, 2, 3, 4 & 21 should be submitted to the Development Preview Commission for approval as related to walks, street scape and driveway locations. MOTION CARRIED: 3-0 2) Neighborhood Development Plans - Ayres Subdivision (Tract 7813) Location: South of Walnut Avenue~ north of mainline SFRR, bounded on the west by Venta Spur Line and on the east by the proposed alignment of Jamboree Road. Mr. Flea~le reviewed the Commission's policy decisions to the City Coun-. bil, and also the City Council's determinations of their May 15th, meet- .ing. The Commission showed much concern over the school site as respects traffic circulation and the row of lots on the park and school sites. They were shown two maps, Alternate A and Alternate B, for their comments and decisions, and advised that before approving the neighborhood plan, they would suggest a workshop session, jointly with the City Council. Mr. Mike Jage~ of Newport Shores Builders, and Messrs. John Sands and Douglas Unruh of the Irvine Company were interested in knowing if it was the general plan itself that was not acceptable, or just the school, and wished to have the plan (either A or B) approved. Commissioner Dukleth moved, seconded by Commissioner Edelstein, that there be a joint workshop session with the City Council on June 5th for the purpose of gaining joint approval of the concepts of the neighbor- hood plan to enable the Planning Commission to consider the Tentative Tract Map No. 7813 at its next regular meeting on June 12th. MOTION CARRIED: 3-0 3) Preliminary Draft: Open Space - Conservation - Recreation Element Ordinance. Mr. Brown requested Commission to look over the preliminary draft prior to a public hearing for any comments, additions, or deletions they m~y have. Commissioner Edelstein moved for a public hearing to be held on June 12, 1972; seconded by Commissioner Dukleth. MOTION CARRIED: 3-0 NEW BUSINESS ' 1) Final map approval Tract No. 7420 - Andrews Construction Company - development of single family residences. Location: east side of Prospect Avenue, approximately 150 feet north of Beneta Way. Mr. Brown advised that this final map conforms to Tentative Map No. 7420, which was approved on October 11, 1971. Commissioner Edelstein moved for approval to the City Council of Final Tract Map No. 7420 subject to the receipt of Labor and Material Bond, Faithful Performance Bond and Monumentation Bond and conformance to ~onditions of approval outlined for Tentative Map; seconded by Commis- sioner Dukleth. MOTION CARRIED: 3-0 2) Request for waiver of undergrounding - Robert Hall & Assoc. - Location: 17452 Irvine Boulevard Mr. Brown summarized a letter received from Robert Hall, in which Mr. Hall requested to be allowed to maintain the overhead electrical service to the subject building. This building suffered a fire on January 21, 1972 which destroyed the roof and some interior partitions; however, all of the first floor exterior walls and most of the second floor ex- terior walls are being saved. The electrical panel and riser seems to be in good order also. Commissioner Edelstein moved for waiving for undergrounding; seconded by Commissioner Dukleth. MOTION CARRIED: 3-0 CORRESPONDENCE 1) County Zone Change Cases 72-12 and 72-12, Alternate A, and Exhibit 72-3. Mr. Brown advised that Zone Changes 72-12 and 72-12, Alternate A are relative to corridor widths for certain scenic arterial highways and freeways, such as Ortega Highway, etc. Zone Change 72-12 would consider the use of a one-mile, rather than a two-mile total corridor width cen- tered on the highways; however, 72-12, Alternate A would maintain the two-mile existing corridor again centered on these highways. Exhibit 72-3 proposes to amend certain sections of the SR "Sign Restrictions" D--~rict regulations. The only recommended amendment which would be of consequence to Tustin would be the provision that any Use Permit request within the finally established SR District Areas would have to be acted upon by the Orange County Planning Commission rather than by the Orange County Zoning Administrator. Commissioner Edelstein moved, seconded by Commissioner Dukleth, that Staff direct a letter to the Orange County Planning Commission for approval of ZC72-12, Alternate A, and Exhibit 72-3. MOTION CARRIED: 3-0 2) County Zone Change Case ZC72-37 Mr. Brown stated that this Zone Change proposes to re-zone from CC/35 ~SR) "Commercial, Community (Sign Restrictions)" District to the C1 (SR) "Local Business (Sign Restrictions)" District. These two districts are essentially the ~me, with the C1 District havin~ slightly broader aspects relative to permitted uses. This proposal is in line with other actions in this same area initiated by the County to more accurately reflect ~he General Plan. Commissioner Dukleth moved that Staff direct a letter to the Orange County Planning Commission recommending approval of the Case ZC72-37; seconded by Commissioner Edelstein. MOTION CARRIED: 3-0 3) Letter"from League of Cities - first Annual Report of the Citizens Direction Finding Commission. Moved by Commissioner Edelstein, seconded by Commissioner Dukleth, that Staff convey to the President of the League of Cities their appreciation in reviewing these comments. MOTION CARRIED: 3-0 STAFF CONCERNS Go-Cart expansion (Game Room) - request Planning Commission findings - Kartopia. Mr. Fleagle advised that on January 26, 1970, the Commission approved Use Permit No. 69-332 for a go-cart facility located at 1062 Laguna Road. Recently, the operators of this facility have contacted Staff requesting a structural expansion for the main building on this site, which will roof and enclose an area now utilized as an outdoor patio, where custo- mers wait their turn to use the vehicles. The owners have indicated that they wish this area enclosed as means of protection from the weather elements, as well as installing several types of electronic games within this enclosure. Basic concern of Staff was whether the proposed "game" use would be in concept of the original Use Permit, or whether the applicant should file a new Use Permit for this use. Mr. Harvey Lortie of Malo, Inc., representing the owner, Frank Malovich, commented that he was of the opinion that such use was approved under the original Use Permit. He stated that this was not and never will be a hazard to the community, and no loitering will be allowed. Mr. Hector Taran~o, representing the builder, advised that the game machines are already in and in use, and the enclosure is basically for protection of the machines and a waiting room. Commissioner Dukleth moved that the original Use Permit No. 69-332 did not include this use and moved for a new public hearing and amendment to the use permit for the purpose of modification of building to include the.room for games; seconded by Commissioner Edelstein.
